\tThis
\nis a second writ petition filed by an industrialist in the grab and
\nunder the caption  Public Interest Litigation , who also argued
\nin person.  He alleged that air pollution has been causing by the
\nunit of 2nd respondent.  Earlier the petitioner moved this
\nCourt by filing SCA No. 394 of 2010, which was disposed of on 20th
\nJanuary, 2010, for the reasons mentioned therein, and the Court
\npassed an order allowing the petitioner to approach first respondent
\n  Gujarat Pollution Control Board.  The said order is quoted
\nbelow:-\n<\/p>\n
 1.\tWrit
\npetition has been preferred by the petitioner alleging inaction on
\nthe part of respondent No.1 to take action for closing the unit run
\nby respondent No.2.\n<\/p>\n
2.\tLearned
\ncounsel for the petitioner while referred to the Development Plan,
\nGandhinagar, 2011 AD, submitted that, under clause 2.3.20, obnoxious
\nand hazardous industries could not have been granted permission to
\nrun such industry at Gandhinagar. It is alleged that the second
\nrespondent- industry is dealing with hazardous substance and emitting
\ntoxic and obnoxious gases and in spite of repeated requests no action
\nhas been taken by respondent No.1.\n<\/p>\n
3.\tWe have
\nheard the learned counsel appearing on behalf of the petitioner and
\nperused the record.\n<\/p>\n
4.\tFrom the
\nrecord, it is evident that the second respondent-industry was granted
\nconsents and authorization to run the unit as back as on 27.11.2006
\nby the Gujarat Pollution Control Board. After three years, the
\npetitioner has indirectly challenged the same. That apart, we also
\nfound that the petitioner is the Chairman and Managing Director of
\nanother industry and is neighbour. Except allegation, no specific
\ncase has been made out against the respondent. Under these
\ncircumstances, while we are not inclined to interfere with the order
\nof consent granted by the Gujarat Pollution Control Board, liberty is
\ngiven to the petitioner  to approach the first respondent, who may
\nmake necessary inspection  and pass appropriate orders in accordance
\nwith law after notice to respondent No.2.\n<\/p>\n
5.\tThis
\npetition stands disposed of, but there shall be no order as to
\ncosts.\n<\/p>\n
2.\tThe
\nsame relief has been sought for in this second writ petition, for
\ndirection to Gujarat Pollution Control Board to take appropriate
\naction against second respondent   polluting unit in order to close
\ndown the said unit.  This time, instead of representing through
\nlawyer, petitioner has appeared in person and alleged about pollution
\ncaused by 2nd respondent. By filing an affidavit,
\nrespondent Pollution Control Board has brought to the notice of the
\nCourt that pursuant to the observation made by this Court on 20.1.10,
\npetitioner represented before Pollution Control Board and the Board
\nin its turn got the premises of second respondent inspected on
\n23.4.2010 and in the said report, the team observed that at the time
\nof visit production of Zink oxide was going on and the ambient air
\nquality was found to be normal.  The report has been enclosed as
\nAnnexure  B  to the reply affidavit.\n<\/p>\n
3.\tWe
\nnoticed that to be on the safer side, Gujarat Pollution Control
\nBoard, under Section 31-A of the Air (Prevention and Control of
\nPollution) Act, 1981, ordered Environmental Engineering Department,
\nL.D. College of Engineering, Ahmedabad to inspect the unit run by
\nsecond respondent, and accordingly the said Environmental Engineering
\nDepartment of L.D. College of Engineering, Ahmedabad submitted a
\nreport under the caption  Identification and Assessment of Air
\nPollution Sources from M\/s. Uttam Industry  – 2nd
\nrespondent.  The report is satisfactory and there is no adverse
\nremark.  At paragraph 5.3, the following observation has been made
\nwith regard to petitioner   complainant.\n<\/p>\n
 5.3\tAmbient
\nAir Quality Monitoring:  It was
\nintended to carry out the ambient air quality monitoring twice at the
\npremises of the complainant M\/s. Biocare Remedies.  However, there
\nwas complete non-cooperation on the part of complainant in this
\nregards.  During the first monitoring the complainant switched off
\nthe machine after 4 hours and during the second monitoring, the
\npermission to keep the machine was not given.  So second monitoring
\ncould not be done.  The results of first ambient air quality
\nmonitoring are given at Table No.7 <\/p>\n
\tFrom
\nboth the said reports, it would be evident that there is no emission
\nof toxic and obnoxious gases and the ambient air quality is normal
\nand  there is no air pollution.\n<\/p>\n
4.\tIt
\nis also not in dispute that the petitioner has also filed a Suit
\nagainst second respondent industry.  Petitioner, in spite of the
\nCourt’s order, failed to justify that second respondent industry is
\nrunning without proper permission.\n<\/p>\n
5.\tIn
\nview of the fact that no public interest is involved, and it is an
\nadversary litigation appears to have been filed to malign second
\nrespondent, for which earlier case was not entertained, for same
\nrelief second writ petition has been filed.  After a Suit has also
\nbeen filed against second respondent, it will be evident that
\npetitioner is now trying to take undue advantage under Article 226 of
\nthe Constitution.  For the reason aforesaid, while we dismiss the
\nwrit petition, impose costs of Rs. 25,000\/- on the petitioner for
\npayment in favour of Indian Law Institute, Gujarat State, Gujarat
\nHigh Court Campus.  The amount to be paid within a month, failing
\nwhich the competent authority will take up the matter with the
\nCollector for recovery of the amount by way of arrears of land
\nrevenue.\n<\/p>\n
