No. 6348 of 2010<\/p>\n<p>                                 This application under Section 5 of the<\/p>\n<p>                    Limitation Act is filed by the appellant for condonation of<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>delay of 125 days occurred in filing the Appeal.<\/p>\n<p>                On the facts and in the circumstances of the<\/p>\n<p>case, the delay is condoned. Application stands disposed<\/p>\n<p>of.\n<\/p>\n<p>                This appeal arises from the order dated<\/p>\n<p>25.01.2010 made by the learned Single Judge in the<\/p>\n<p>above C.W.J.C. No. 10336 of 2005.\n<\/p>\n<p>                The appellant-writ petitioner is the retired<\/p>\n<p>employee of the State Government. He filed the above<\/p>\n<p>writ petition to challenge the decision of the State<\/p>\n<p>Government to retire him from service in the year 2004 on<\/p>\n<p>reaching the age of superannuation considering his date<\/p>\n<p>of birth as that of 2nd July 1946.        The claim of the<\/p>\n<p>appellant was that his date of birth recorded in the service<\/p>\n<p>book was 2nd July 1948 and was unilaterally altered by<\/p>\n<p>the respondent-authority      to that of 2nd July 1946. The<\/p>\n<p>claim has been rejected by the learned Single Judge.<\/p>\n<p>The entry &#8220;1948&#8221; made in the service book is found to be<\/p>\n<p>interpolated.      Learned Single Judge dismissed the<\/p>\n<p>petition as the date of birth of the petitioner becomes<\/p>\n<p>disputed question of fact. Therefore, the present appeal.<\/p>\n<p>                We have heard learned advocates appearing<\/p>\n<p>for the parties.     We have perused the certificate dated<\/p>\n<p>26th May 1969 produced at Annexure-4 by the appellant.<\/p>\n<p>We have noticed interpolation also in the certificate<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>         dated 26th May 1969 produced by the appellant.<\/p>\n<p>                        Appeal is dismissed in limine.     I.A. stands<\/p>\n<p>         disposed of.<\/p>\n<pre>\n\n\n                                      (R.M.
