Shukla, learned A.P.P. waives service of notice of Rule on<br \/>\n\tbehalf of the Respondent-State.\n<\/p>\n<p>\tThe<br \/>\n\tpresent application has been filed under Section 438 of the Code of<br \/>\n\tCriminal Procedure, 1973 for the grant of anticipatory bail in<br \/>\n\tconnection with I-C.R.No.146\/2010 registered with Chandkheda Police<br \/>\n\tStation for the offences punishable under Sections 392 and 114 of<br \/>\n\tthe Indian Penal Code.\n<\/p>\n<p>\tLearned<br \/>\n\tcounsel, Mr.Bhavik Patel for the applicant referred to the FIR as<br \/>\n\twell as other papers and submitted that the applicant is sought to<br \/>\n\tbe implicated though in past, he has been acquitted for the similar<br \/>\n\toffence. He, therefore, submitted that the present application may<br \/>\n\tbe allowed as he is apprehending his arrest.\n<\/p>\n<p>\tLearned<br \/>\n\tA.P.P., Mr.Shukla resisted the application.\n<\/p>\n<p>\tHaving<br \/>\n\theard learned counsel appearing for the applicant-accused and<br \/>\n\tlearned A.P.P. and having considered the papers and also guidelines<br \/>\n\twith regard to grant of anticipatory bail under Section 438 of the<br \/>\n\tCriminal Procedure Code, the present application deserves to be<br \/>\n\tallowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tthe present application is allowed. The applicant is ordered to be<br \/>\n\treleased on bail in the event of his arrest in connection with<br \/>\n\tI-C.R.No.146\/2010 registered with Chandkheda Police Station in<br \/>\n\trespect of the offence alleged against him on his executing bond of<br \/>\n\tRs.5,000\/- (Rupees Five thousand only) with one solvent surety of<br \/>\n\tthe like amount, by him, by the concerned Police Officer and on<br \/>\n\tconditions that he shall;\n<\/p>\n<p> a)\tremain present before the trial Court regularly as \tand when directed on the dates fixed;\n<\/p>\n<p>b)\tremain present at the concerned Police Station on 23.09.2010 between 11.00 a.m. and 2.00 p.m;\n<\/p>\n<p>c)\tmake himself available for interrogation by Police Officer, whenever and wherever required;\n<\/p>\n<p>d)\tnot directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the \tcase so as to dissuade him from disclosing such facts to the \tCourt or to any Police Officer;\n<\/p>\n<p>e)\tnot to obstruct or hamper the police investigation \tand not to play mischief with the evidence collected or yet to be collected by the police;\n<\/p>\n<p>f)\tat the time of execution of bond, furnish his address to the Investigating Officer and the Courts concerned, \tand shall not change his residence till the final disposal of the case or till further orders;\n<\/p>\n<p>g)\tnot leave India without the permission of the Court and if having Passport, shall deposit the same before the trial Court within a week;\n<\/p>\n<p>h)\tIt<br \/>\nshould be open to the Investigating Officer to file an application<br \/>\nfor remand if he considers it proper and just; and the learned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.  Direct service is<br \/>\n\tpermitted.\n<\/p>\n<p>This<br \/>\n\torder will hold good if the applicant is arrested at any time within<br \/>\n\t90 days from today.
