Singh\nRespondent:          Dep't of Personnel &amp; Training (DOPT)\n\n\nFACTS<\/pre>\n<p>       By an application of 18-6-2007 Shri Mahender Kr. Singh of Nanhey<br \/>\nPark, Uttam Nagar, New Delhi applied to the CPIO, DOPT seeking the<br \/>\nfollowing information:\n<\/p>\n<blockquote><p>       &#8220;1.    My brother Manoj Kumar Singh is a employee of Border<br \/>\n              Road Organization (BRO) which comes under Ministry of<br \/>\n              Surface Transport and is governed by Border Road<br \/>\n              Development Board (BRDB).             He is a permanent<br \/>\n              employee of the organization with effect from 1996 and<br \/>\n              working as LDC from his initial recruitment. He passed a<br \/>\n              departmental examination 4-5 years back and based<br \/>\n              upon that he is sponsored by the department for Diploma<br \/>\n              in Civil Engineering at College of Military Engineering.<br \/>\n              After completion of the program he became eligible for<br \/>\n              the suitable engineering post in the Department and is<br \/>\n              awaiting departmental promotion.          Meanwhile other<br \/>\n              candidates who is senior to my brother in the LDC cadre<br \/>\n              passed the same examination a year later than my<br \/>\n              brother based on the same scheme (Has got the diploma<br \/>\n              degree a year later than my brother but is promoted<br \/>\n              before my brother while my brother is still awaiting<br \/>\n              promotion).\n<\/p><\/blockquote>\n<blockquote><p>              a.     So my question is whether as per central<br \/>\n                     government rules the department is right in<br \/>\n                     promoting the other candidates to the engineering<br \/>\n                     post for which the minimum requirement is<br \/>\n                     Diploma in Civil Engineering is attained by my<br \/>\n                     brother a year earlier (2004) than the other<br \/>\n                     candidates (2005 or above).\n<\/p><\/blockquote>\n<blockquote><p>              b.     So whether seniority in such a case is counted on<br \/>\n                     the basis of total length in service or total length in<br \/>\n                     service after attaining the minimum requirement for<br \/>\n                     the said post.\n<\/p><\/blockquote>\n<blockquote><p>       2.     Further the Border Road Organization (BRO) comes<br \/>\n              under the preview of Border Road Development Board<\/p>\n<p><span class=\"hidden_text\">                                        1<\/span><br \/>\n               (BRDB), where the latter is exempted from the purview of<br \/>\n              RTI as per Schedule 2.\n<\/p><\/blockquote>\n<blockquote><p>              a.    So whether this immunity provided to BRDB also<br \/>\n                    applies to BRO in service\/ welfare\/ corruption<br \/>\n                    matters.&#8221;<\/p><\/blockquote>\n<p>       To this Shri Mahender Kr. Singh received a response dated 9.8.2007<br \/>\nfrom Shri P. K. Mishra, Under Secretary informing him as follows:-\n<\/p>\n<blockquote><p>       &#8220;1 (a&amp;b) The queries do not form part of information under the<br \/>\n             Right to Information Act, 2005.\n<\/p><\/blockquote>\n<blockquote><p>       2.    Since the BRO is part of BRDB is exempted from the<br \/>\n             purview of RTI Act, 2005 BRO is ,therefore, also<br \/>\n             exempted from the purview of the Act.&#8221;<\/p><\/blockquote>\n<p>       Not satisfied with this response, however, Shri Mahender Kr. Singh<br \/>\nmoved an appeal before Shri K. G. Verma, Director, DOPT on 20-8-2008 with<br \/>\nthe following plea:-\n<\/p>\n<blockquote><p>       &#8220;I have been told by the CPIO, DOPT that the queries do not<br \/>\n       form part of information under the RTI Act, 2005, in the<br \/>\n       response I have done a through revision of the RTI Act under<br \/>\n       head &#8220;What is not open to disclosure&#8221; (copy attached) on the<br \/>\n       RTI website and could not find any reason why the information<br \/>\n       has been denied to me.&#8221;<\/p><\/blockquote>\n<p>       Upon this he received an order from Ms. Anuradha S. Chagti, Deputy<br \/>\nSecretary, RTI dated 14.9.2007 as follows:-\n<\/p>\n<blockquote><p>       &#8220;The information sought by him is in the form of a query and<br \/>\n       relates to the correctness of the action taken by Border Road<br \/>\n       Organisation in the matter of promotion of his brother working in<br \/>\n       that Organisation. The matter on which the information has<br \/>\n       been sought is of a general nature and is an administrative<br \/>\n       matter to be looked into by the concerned department. Such<br \/>\n       isolated queries are not covered under the definition of term<br \/>\n       &#8216;information&#8217; under Section 2(f) of the RTI Act. The CPIO has<br \/>\n       thus rightly conveyed to this effect.\n<\/p><\/blockquote>\n<blockquote><p>       Further as regard immunity provided to the Organisations<br \/>\n       included in the Second Schedule of the RTI Act, including BRDB,<br \/>\n       the information pertaining to the allegations of corruption and<br \/>\n       human rights violations is not excluded in respect of these<br \/>\n       organizations from the purview of the Act.&#8221;<\/p><\/blockquote>\n<p>       Shri Mahender Kr. Singh has then moved his second appeal before us<br \/>\nwith the following prayer:-\n<\/p>\n<blockquote><p>       &#8220;I hereby request the CIC to direct the Public Authority to<br \/>\n       give advice regarding my queries related to promotion in<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><br \/>\n       Central Government departments, in order to simplify the<br \/>\n      question I am presenting it is the simplified version as<br \/>\n      under:-\n<\/p><\/blockquote>\n<blockquote><p>      1(a) promotion rules for GOI employees, where a<br \/>\n            employee has attained the minimum eligibility criteria<br \/>\n            for promotion to next grade (Say not technical to<br \/>\n            technical) before another senior employee of the<br \/>\n            same cadre (say both belong to LDC cadre but the<br \/>\n            second one has joined before first one in LDC cadre,<br \/>\n            but minimum educational qualification for promotion<br \/>\n            is attained by the first one earlier than the second<br \/>\n            one). And whether the action of the government<br \/>\n            department is justifiable in normal course if it has<br \/>\n            first promotes the employees who has got the<br \/>\n            requisite eligibility criteria after (one or more years)<br \/>\n            the former candidate (please advice).\n<\/p><\/blockquote>\n<blockquote><p>      1(b) whether the seniority for departmental promotion is<br \/>\n            calculated based on the total length in service in<br \/>\n            central government or total length in service after<br \/>\n            attaining the minimum qualification for the concerned<br \/>\n            post (with specific reference to group C posts).\n<\/p><\/blockquote>\n<blockquote><p>      Note: The public authority may also provide any additional<br \/>\n            documents\/ order copy\/ advices\/ circulars etc issued by<br \/>\n            the public authority to Government departments that are<br \/>\n            covered in RTI domain. The questions may further be<br \/>\n            simplified by CIC.\n<\/p><\/blockquote>\n<blockquote><p>      Q. 2 The question two is related to whether Protection\/<br \/>\n            Immunity provided to Border Road Development<br \/>\n            Board also applies to Border Road Organization in<br \/>\n            service\/welfare\/ corruption matters because it is<br \/>\n            governed by the former.\n<\/p><\/blockquote>\n<blockquote><p>      Response from Public Authority: CPIO, DOPT has told<br \/>\n      since BRO is a part of BRDB and BRDB is exempted from<br \/>\n      preview of RTI Act so BRO is also exempted.\n<\/p><\/blockquote>\n<blockquote><p>      Response from First Appellate Authority: Appellate<br \/>\n      Authority has not specifically mentioned BRO in their<br \/>\n      answer but told that &#8220;Further as regard immunity provided<br \/>\n      to the organizations included in second schedule of the RTI<br \/>\n      Act, including BRDB, the information pertaining to the<br \/>\n      allegations of corruption and human rights violations is not<br \/>\n      excluded in respect of these organizations from the purview<br \/>\n      of the Act.&#8221;<\/p><\/blockquote>\n<p>      Appellant Shri Mahender Kr. Singh has also posed some questions in<br \/>\nwhich he sought the views of Central Information Commission in regard to<\/p>\n<p><span class=\"hidden_text\">                                    3<\/span><br \/>\n various issues concerning Border Roads Organisation and its &#8220;immunity&#8221;<br \/>\nunder the Right to Information Act.\n<\/p>\n<p>       The appeal was heard on 23-7-2009. The following are present.<br \/>\n       Respondents<br \/>\n       Ms. Anuradha S. Chagti, Deputy Secretary, RTI.<br \/>\n       Shri R. K. Girdhar, Under Secretary, RTI.\n<\/p>\n<p>       Although informed of the date of hearing through our letter of 1-7-2009<br \/>\nappellant Shri Mahender Kr. Singh opted not to be present. The questions<br \/>\nasked by appellant in his initial application were discussed in detail. As<br \/>\nrespondent Ms. Anuradha Chagti DS has confirmed in the hearing there are<br \/>\nno standard rules of the nature sought by appellant on counting of seniority,<br \/>\nwith each organisation making its own arrangements. The DOPT can only<br \/>\nspeak for the CSS and the All India Services.\n<\/p>\n<p>                             DECISION NOTICE<\/p>\n<p>       Clearly information sought by appellant Shri Mahinder Kr. Singh is not<br \/>\nheld by the DOPT. The Organisation that would hold such information is the<br \/>\nBorder Roads Organisation which, as already been intimated to the appellant,<br \/>\nis part of a larger organisation already listed at serial No.21 of the 2nd<br \/>\nSchedule as amended vide GSR No. 347 of 8-10-2005 and therefore not<br \/>\n&#8220;immune&#8221;, but not covered by the RTI Act.       There remains no cause for<br \/>\nintervention by this Commission. The appeal is, therefore, dismissed.\n<\/p>\n<p>       Announced in the hearing.
