Their name be<br \/>\ndeleted from the cause-title, as the proceedings against them shall<br \/>\nstand abated.\n<\/p>\n<p>\tBeing<br \/>\naggrieved and dissatisfied with the judgment and decree dated 26th<br \/>\nNovember, 1996 passed in Regular Civil Appeal No.40 of 1992 by the<br \/>\nlearned Joint District Judge, Bhavnagar, dismissing the said appeal<br \/>\nfiled by the appellants and confirming the judgment and decree of the<br \/>\nlearned trial Judge dated 30\/04\/1992, the present Second Appeal has<br \/>\nbeen preferred under the provisions of Section 100 of the Code of<br \/>\nCivil Procedure.  While admitting the appeal, the Court has decided<br \/>\nto frame the substantial questions of law for determination on 20th<br \/>\nJanuary, 1998.\n<\/p>\n<p>\tPending<br \/>\nthe present appeal, learned Counsel appearing for parties have<br \/>\ninformed the court that now parties have settled the matter outside<br \/>\nthe Court and they have arrived at compromise.  The said settlement<br \/>\nhas been reduced in writing and the original settlement is tendered<br \/>\nto the Court alongwith the present application.\n<\/p>\n<p>\tToday<br \/>\nthe parties are not present before the Court, but Mr.Hathi as well as<br \/>\nMr.Mehta, learned Advocates for the parties confirm that the<br \/>\nsignatures made in the settlement attached with the present<br \/>\napplication are of the persons authorized to settle the matter.  The<br \/>\nsaid parties were also identified by one lawyer viz., Mr.A.L.Trivedi<br \/>\nand said settlement has been notarized by one Notary at Bhavnagar on<br \/>\n23th June, 2008.  For the sake of convenience the Court is<br \/>\ninclined to reproduce the said settlement herein after.\n<\/p>\n<p>\t\t\t?SThe respondent<br \/>\n\t\t\tNavintbala Jethalal Trivedi, original plaintiff, has agreed to<br \/>\n\t\t\taccept half the plot no.60 situated at Village Chitra instead of<br \/>\n\t\t\tthe whole plot no.60 admeasuring 63 x 86 sq.ft. as mentioned in<br \/>\n\t\t\tthe Agreement of Sale.\n<\/p>\n<p>\t\t\tThe applicants,<br \/>\n\t\t\tthrough there power of attorney holder Shri Narendrasinh Dhirubhai<br \/>\n\t\t\thave agreed and are prepared to execute the sale deed for half of<br \/>\n\t\t\tplot no.60 admeasuring 63 x 86 sq.ft. Situated at Village chitra<br \/>\n\t\t\tand will hand over half of the said plot no.60 to the first<br \/>\n\t\t\trespondent or to any other person named by her (Shri Chetansinh<br \/>\n\t\t\tJanaksinh Sarvaiya of Bhavnagar) after completing the necessary<br \/>\n\t\t\tformalities of execution of regular sale deed in favour of the<br \/>\n\t\t\tfirst respondent or any other person authorized by her (Shri<br \/>\n\t\t\tChetansinh Janaksinh Sarvaiya of Bhavnagar) within 90 days from<br \/>\n\t\t\tthe date of the disposal of the Civil Second Appeal in Lieu of the<br \/>\n\t\t\tdecree of specific performance passed by the learned civil judge,<br \/>\n\t\t\tBhavnagar and confirmed by the learned Joint District Judge,<br \/>\n\t\t\tBhavnagar.\n<\/p>\n<p>\t\t\tThe parties agree<br \/>\n\t\t\tthat the decree of specific performance passed by the learned<br \/>\n\t\t\tCivil Judge (JD), Bhavnagar in Regular Civil suit No.796\/81 as<br \/>\n\t\t\tconfirmed in Regular Civil Appeal No.49\/92 by the learned Joint<br \/>\n\t\t\tDistrict Judge, Bhavnagar be modified and the Second Appeal may be<br \/>\n\t\t\tallowed in part while dismissing the said Suit with respect to<br \/>\n\t\t\thalf of the said plot no.60.\n<\/p>\n<p>\t\t\tA decree in terms<br \/>\n\t\t\tof this settlement will be passed in Civil Second Appeal No.7\/97.??\n<\/p>\n<p>\tThe<br \/>\ncompromise arrived at between the parties is found genuine and, it is<br \/>\nordered to be recorded accordingly.  So, accepting the settlement as<br \/>\nsubmitted by learned Counsel for the parties, original decree shall<br \/>\nstand modified and decree be drawn in terms of settlement arrived at<br \/>\nbetween the parties.  Registry is directed to draw the decree in<br \/>\nterms of settlement so that the parties to settlement can act upon<br \/>\nthe compromise decree.\n<\/p>\n<p>\tCivil<br \/>\nApplication is allowed in terms of settlement arrived at between the<br \/>\nparties <\/p>\n<p> SECOND<br \/>\nAPPEAL NO.7 OF 1997<\/p>\n<p>\tIn view of the<br \/>\nsettlement arrived at between the parties and the order passed in<br \/>\nCivil Application No.9356 of 2008, present Second Appeal is ordered<br \/>\nto be disposed of accordingly.
