Challenge in this writ petition is against<\/p>\n<p>proceedings initiated by the respondents under the<\/p>\n<p>provisions of the Securitization and Reconstruction of<\/p>\n<p>Financial Assets and Enforcement of Security Interest Act,<\/p>\n<p>2002 (SARFAESI Act). The petitioner had availed a loan<\/p>\n<p>from the respondent Bank to the tune of Rs.55 lakhs during<\/p>\n<p>the year 2007. According to the petitioner due to failure in<\/p>\n<p>business activities, regular repayments in the loan account<\/p>\n<p>could not be continued.            Consequently the respondents<\/p>\n<p>initiated proceedings under the SARFAESI Act and Exts.P1<\/p>\n<p>&amp; P2 notices were issued. Challenging those proceedings<\/p>\n<p>the petitioner had approached the Debts Recovery Tribunal<\/p>\n<p>and an interim stay was granted on condition of deposit of<\/p>\n<p>Rs.3 lakhs on or before 10.08.2009. Since the petitioner<\/p>\n<p>could not remit the amount, an extension application was<\/p>\n<p>W.P.(C)No. 26322 of 2009<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>filed, and extension was granted. Still the petitioner could<\/p>\n<p>not effect payment of the said amount within the time<\/p>\n<p>stipulated by the Tribunal. Eventhough he had tendered the<\/p>\n<p>amount after the time stipulated, the Bank had refused to<\/p>\n<p>accept it.       Thereafter the respondent proceeded with<\/p>\n<p>further steps and approached the Chief Judicial Magistrate<\/p>\n<p>invoking Section 14 (1). An Advocate Commissioner was<\/p>\n<p>appointed to take over possession of the secured assets. At<\/p>\n<p>this stage the petitioner had filed this writ petition seeking<\/p>\n<p>direction for permitting him to pay off the defaulted<\/p>\n<p>installments in order to regularise the account.<\/p>\n<p>      2.    This court through interim orders dated 18.09.09<\/p>\n<p>and 25.09.09 directed the petitioner to make payment of<\/p>\n<p>Rs.3 lakhs and Rs.5 lakhs respectively. It is submitted by<\/p>\n<p>both sides that the interim orders had already been<\/p>\n<p>complied with and a total amount of Rs.8 lakhs was paid.<\/p>\n<p>The learned counsel for the respondents submitted that the<\/p>\n<p>amount pertaining to the defaulted installments along with<\/p>\n<p>over due interest and expenses at present outstanding, will<\/p>\n<p>W.P.(C)No. 26322 of 2009<br \/>\n<span class=\"hidden_text\">                              -3-<\/span><\/p>\n<p>be around Rs.4 lakhs. Learned counsel for the petitioner<\/p>\n<p>submits that he is ready and willing to pay whatever amount<\/p>\n<p>due for regularising the loan account within a short period.<\/p>\n<p>      3.    Under the above circumstances, I am of the<\/p>\n<p>opinion that some indulgence can be shown in the matter<\/p>\n<p>for permitting the petitioner to regularise the account by<\/p>\n<p>paying defaulted amounts and in permitting the petitioner<\/p>\n<p>to continue repayment in the loan account as per the<\/p>\n<p>original schedule.\n<\/p>\n<p>      4.    Accordingly the writ petition is disposed of<\/p>\n<p>directing the petitioner to make payment of the amount<\/p>\n<p>pertaining to the defaulted installments along with over due<\/p>\n<p>interest and expenses if any liable, in four (4) equal monthly<\/p>\n<p>installments falling due on or before 15th December, 2009<\/p>\n<p>and on or before the 15th day of succeeding three (3)<\/p>\n<p>months. The petitioner shall make payment of the regular<\/p>\n<p>installments due from December 2009 onwards along with<\/p>\n<p>the above payments. If the petitioner makes payment of the<\/p>\n<p>amounts as insisted above, the respondent shall permit him<\/p>\n<p>W.P.(C)No. 26322 of 2009<br \/>\n<span class=\"hidden_text\">                               -4-<\/span><\/p>\n<p>to continue repayment in the loan account with respect to<\/p>\n<p>the future installments as per the original schedule of<\/p>\n<p>repayment.\n<\/p>\n<p>      5.    It is made clear that on the event of failure to pay<\/p>\n<p>any of the installments as stipulated as above, the<\/p>\n<p>respondents will be free to proceed with further steps<\/p>\n<p>pursuant to the order already issued by the Chief Judicial<\/p>\n<p>Magistrate Court, and on any such event the petitioner will<\/p>\n<p>be precluded from raising any further challenge against the<\/p>\n<p>proceeding initiated under the SARFAESI Act, before this<\/p>\n<p>court or before any other forum.\n<\/p>\n<\/p>\n<p>                                          C.K.
