Justice M.SASIDHARAN NAMBIAR\n\n Dated :21\/12\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n             W.P.(C)No.33962 of 2009 Q\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    Defacto complainant in C.C.No.351\/2000 on the<\/p>\n<p>file of Judicial First Class Magistrate&#8217;s Court-II,<\/p>\n<p>Aluva is the petitioner. This petition is filed<\/p>\n<p>under Article 226 of Constitution of India for a<\/p>\n<p>writ of mandamus directing second respondent to<\/p>\n<p>conduct  further   investigation   of   the   case,<\/p>\n<p>inclusive of comparison of the specimen signatures<\/p>\n<p>of the accused and others if any, by a handwriting<\/p>\n<p>expert of the Forensic Science Laboratory and to<\/p>\n<p>direct the learned Magistrate to commit C.C.No.<\/p>\n<p>351\/2000 to Sessions Court, Ernakulam, where, S.C.<\/p>\n<p>No.124\/1996,  corresponding  to   S.C.243\/2007   is<\/p>\n<p>pending.\n<\/p>\n<p>    2.  Petitioner  had  earlier  filed  W.P.(C)No.<\/p>\n<p>31681\/2007  for a   direction to   conduct  further<\/p>\n<p>investigation after quashing the order passed by<\/p>\n<p>the learned Magistrate, refusing to order further<\/p>\n<p><span class=\"hidden_text\">WPC 33962\/09             2<\/span><\/p>\n<p>investigation.   By  Exhibit   P4  judgment   dated<\/p>\n<p>16.1.2008,    this    Court     directed    further<\/p>\n<p>investigation, with a direction that it shall be<\/p>\n<p>commenced within one month and to be completed<\/p>\n<p>within seven months. Thereafter, a supplementary<\/p>\n<p>final report was submitted on 24.1.2008 endorsing<\/p>\n<p>the findings in the final report. Petitioner filed<\/p>\n<p>Crl.M.P.No.2544\/2009 for further investigation. It<\/p>\n<p>was dismissed by Exhibit P6 order. This petition is<\/p>\n<p>filed thereafter for further investigation of the<\/p>\n<p>case contending that learned Magistrate omitted to<\/p>\n<p>take note of the fact that there was no proper<\/p>\n<p>investigation.\n<\/p>\n<p>     3. Petitioner was heard in person and learned<\/p>\n<p>Government Pleader was also heard.\n<\/p>\n<p>     4. This Court, in Exhibit P4 judgment itself,<\/p>\n<p>found that the case has to be investigated properly<\/p>\n<p>as the very case of the petitioner is that the<\/p>\n<p>signature seen in the F.I. Statement is not his<\/p>\n<p>signature and the facts stated therein are not the<\/p>\n<p><span class=\"hidden_text\">WPC 33962\/09             3<\/span><\/p>\n<p>facts disclosed by him and he has a case that it is<\/p>\n<p>not only the Head Constable, but police officers,<\/p>\n<p>higher ups in rank, are also involved. When the<\/p>\n<p>report of the expert shows that the signature of<\/p>\n<p>the first informant seen in the FIR prepared by the<\/p>\n<p>police is not that of the petitioner, there should<\/p>\n<p>have   been  a proper  investigation  as  to  whose<\/p>\n<p>signature it is. Signature could be obtained in the<\/p>\n<p>FIR only by the officer, who recorded the F.I.<\/p>\n<p>Statement. When the signature seen therein is not<\/p>\n<p>that of the petitioner, the real author of the<\/p>\n<p>signature should have been found out. A proper<\/p>\n<p>investigation should have been made to find out<\/p>\n<p>whether the signature purported to be that of the<\/p>\n<p>petitioner is that of the officer who prepared the<\/p>\n<p>FIR or any other police officer. Unfortunately,<\/p>\n<p>this aspect was not investigated. If it is found<\/p>\n<p>that the signature seen in the F.I. Statement is<\/p>\n<p>not that of the officer, who prepared the FIR, it<\/p>\n<p>should necessarily be pursued further to find out<\/p>\n<p><span class=\"hidden_text\">WPC 33962\/09              4<\/span><\/p>\n<p>as to whether it is the signature of any other<\/p>\n<p>police officer present in the station at that time.<\/p>\n<p>These aspects were not properly investigated at<\/p>\n<p>all. Interest of justice warrants that further<\/p>\n<p>investigation is to be made on these aspects.<\/p>\n<p>     5.     In such circumstances, third respondent<\/p>\n<p>Superintendent   of   Police, CBCID,  Ernakulam  is<\/p>\n<p>directed to conduct a further investigation as<\/p>\n<p>provided under Section 173(8) of Code of Criminal<\/p>\n<p>Procedure.    It   is   made  clear  that   further<\/p>\n<p>investigation must be directed to find out the<\/p>\n<p>actual person who provided the signature in the<\/p>\n<p>F.I. Statement, to make it appear that it is the<\/p>\n<p>signature of the petitioner. It should also be<\/p>\n<p>investigated who are all involved in manipulating<\/p>\n<p>the records. Without finding a person who affixed<\/p>\n<p>his   signature,   purporting to  be  that  of the<\/p>\n<p>petitioner, investigation will not be completed.<\/p>\n<p>Third respondent should make all effort to arrive<\/p>\n<p>at the truth, as it affects the very criminal<\/p>\n<p><span class=\"hidden_text\">WPC 33962\/09             5<\/span><\/p>\n<p>justice system as the F.I. Statement itself has<\/p>\n<p>been found to be forged. Investigation is to be<\/p>\n<p>completed as expeditiously as possible. Judicial<\/p>\n<p>First Class Magistrate-II, Aluva is directed to<\/p>\n<p>stay C.C.No.351\/2000 till further investigation is<\/p>\n<p>completed.
