     Appellant in W.A.No.426\/2009 is the 1st respondent in<\/p>\n
W.A.No.475\/2009.     While the appellant was working as an<\/p>\n
Accountant in the Bank, he was suspended pending enquiry<\/p>\n
for various charges. The charges levelled against him is that<\/p>\n
his work as a Recovery Officer was not proper and he refused<\/p>\n
to do the work allotted to him. In fact dereliction of duty was<\/p>\n
the charge against him.          There was no allegation of<\/p>\n
misappropriation.    Misconducts were proved in a properly<\/p>\n
conducted domestic enquiry.       He was compulsorily retired<\/p>\n
from service. Issue regarding his compulsory retirement was<\/p>\n
referred to the Labour Court.         Labour Court found that<\/p>\n
misconducts were proved and enquiry was conducted fairly<\/p>\n
and properly. But however, Labour Court also analysed the<\/p>\n
evidence adduced before it and found that the punishment<\/p>\n

imposed was harsh. According to the Labour Court, there was<\/p>\n
political differences between the management of the Society<\/p>\n
and the workman and such political difference is the main<\/p>\n
reason for imposing such a heavy punishment for misconducts<\/p>\n
and dereliction of duty. Punishment of compulsory retirement<\/p>\n
was set aside but he was not reinstated as an Accountant. He<\/p>\n
was only reinstated as junior most senior clerk and he was not<\/p>\n
given any backwages or increment in the period he was out of<\/p>\n
service.   He was compulsorily retired on 31.10.1993. Award<\/p>\n
of the Labour court was on 29.11.2002. On the basis of the<\/p>\n
award, he will lose nine years full backwages as well as his<\/p>\n
promotional benefits.     Following is the operative portion of<\/p>\n
the Labour court award:\n<\/p>\n<\/p>\n
         1. The Punishment of compulsory retirement
\n         of the workman from service is set aside.\n<\/p><\/blockquote>\n
         2. The management is directed to reinstate
\n         the workman in service in the rank of the
\n         junior most senior clerk.\n<\/p><\/blockquote>\n
         3. The workman will not be entitled to any
\n         backwages or increments during the period in
\n         which he was kept out of service.\n<\/p><\/blockquote>\n

          4. The workman will be deemed to have been
\n          in continuous service without any break for
\n          the purpose of computing his retirement
\n          benefits.\n<\/p><\/blockquote>\n
Under Section 11A of the Industrial Disputes Act, in the case<\/p>\n
of dismissal or discharge of duties, Labour court has got<\/p>\n
power to interfere with the punishment and make appropriate<\/p>\n
relief if the punishment is shockingly disproportionate. The<\/p>\n
Labour court has considered the matter and found that for<\/p>\n
misconducts, compulsory retirement or termination of service<\/p>\n
is highly excessive. At the same time, it is also noted that he<\/p>\n
has got political connections and he was a social worker.<\/p>\n
Taking all these relevant circumstances and nature of gravity<\/p>\n
of   misconducts, the relief was granted.      The Labour court<\/p>\n
has got power to reinstate the appellant with backwages. The<\/p>\n
power exercised by the Labour court is within its jurisdiction.<\/p>\n
In the absence of any jurisdictional error or patent error<\/p>\n
apparent on the face of the record, the learned Singe Judge<\/p>\n
upheld the award rejecting the attack made by the<\/p>\n
management as well as the workmen. On going through the<\/p>\n
award, we fully agree with the learned Single Judge that the<\/p>\n

Labour Court has exercised jurisdiction correctly.       No<\/p>\n
grounds are made out to interfere in the impugned judgment.<\/p>\n
We are not repeating the reasoning given by the learned<\/p>\n
Single Judge as we fully agree with the views of the learned<\/p>\n
Single Judge. Hence both writ appeals are dismissed.<\/p>\n
