Shri\u00a0K.\u00a0B.\u00a0Jain \u00a0submitted\u00a0RTI\u00a0application\u00a0dated\u00a0<br \/>\n13 \u00a0 September \u00a0 2010 \u00a0 before \u00a0 the \u00a0 CPIO, \u00a0 State \u00a0 Bank \u00a0 of\u00a0<br \/>\nIndia, \u00a0 Chandigarh \u00a0 and \u00a0 Mumbai \u00a0 respectively, \u00a0 seeking\u00a0<br \/>\ninformation \u00a0 relating \u00a0 to \u00a0 the \u00a0 cases \u00a0 where \u00a0 various\u00a0<br \/>\nbranches \u00a0 of \u00a0 the \u00a0 Bank \u00a0 under \u00a0 their \u00a0 respective\u00a0<br \/>\njurisdiction \u00a0 had \u00a0 compromised\/settled \u00a0 with \u00a0 the\u00a0<br \/>\ndefaulting \u00a0 parties, \u00a0 during \u00a0 the \u00a0 last \u00a0 three \u00a0 years\u00ad<br \/>\neither\u00a0through\u00a0court\u00a0or\u00a0through\u00a0private\u00a0negotiations-\u00a0<br \/>\nenclosed\u00a0herewith\u00a0as\u00a0Annexure\u00a0A.\n<\/p>\n<p>2.   The \u00a0 appellant \u00a0 specifically \u00a0 submits \u00a0 that \u00a0 if \u00a0 the\u00a0<br \/>\npublic \u00a0 authority \u00a0 feels, \u00a0 it \u00a0 can \u00a0 avoid \u00a0 disclosing \u00a0 the\u00a0<br \/>\nnames \u00a0 of \u00a0 the \u00a0 parties \u00a0 on \u00a0 the \u00a0 account \u00a0 of \u00a0 protecting\u00a0<br \/>\ntheir\u00a0personal\u00a0information.\u00a0\u00a0\n<\/p>\n<p>3.    Vide \u00a0 CPIO \u00a0 order \u00a0 dated \u00a0 13 \u00a0 October \u00a0 2010,\u00a0<br \/>\ninformation\u00a0was\u00a0not\u00a0provided\u00a0to\u00a0the\u00a0appellant,\u00a0as\u00a0the\u00a0<br \/>\nRTI \u00a0 application \u00a0 constitutes \u00a0 information \u00a0 of\u00a0<br \/>\n&#8220;commercial\u00a0confidence&#8221;\u00a0of\u00a0third\u00a0party\u00a0u\/s\u00a08\u00a0(1)\u00a0(d)\u00a0<br \/>\nof\u00a0the\u00a0RTI\u00a0Act,\u00a0the\u00a0Order\u00a0further\u00a0said\u00a0that\u00a0otherwise\u00a0<br \/>\nalso,\u00a0the\u00a0information\u00a0sought\u00a0is\u00a0not\u00a0readily\u00a0available\u00a0<br \/>\nin\u00a0the\u00a0manner\u00a0as\u00a0sought\u00a0and\u00a0collection\/compilation\u00a0of\u00a0<br \/>\nsuch \u00a0 information \u00a0 will \u00a0 disproportionately \u00a0 divert \u00a0 the\u00a0<br \/>\nresources\u00a0of\u00a0the\u00a0Bank.\n<\/p>\n<p>                          \u00a0\u00a0\u00a0Appeal\u00a0:\u00a0No.\u00a0CIC\/AT\/A\/2010\/001238\u00adDS\u00a0&amp;\u00a0<br \/>\n                                            CIC\/AT\/A\/2010\/001230\u00adDS\u00a0<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>4.   Not \u00a0 satisfied \u00a0 with \u00a0 the \u00a0 order, \u00a0 Appellant\u00a0<br \/>\npreferred \u00a0 appeal \u00a0 dated \u00a0 18 \u00a0 October \u00a0 2010, \u00a0 before \u00a0 the\u00a0<br \/>\nfirst\u00a0appellate\u00a0authority.\n<\/p>\n<p>5.   Vide \u00a0 FAA \u00a0 order \u00a0 dated \u00a0 12 \u00a0 October \u00a0 2010, \u00a0 the\u00a0<br \/>\ninformation\u00a0was\u00a0not\u00a0disclosed\u00a0to\u00a0the\u00a0appellant\u00a0as\u00a0its\u00a0<br \/>\nexemption\u00a0is\u00a0available\u00a0u\/s\u00a08\u00a0(1)\u00a0(d)\u00a0and\u00a08\u00a0(1)\u00a0(j)\u00a0of\u00a0<br \/>\nthe\u00a0Act.\n<\/p>\n<p>6.   Being \u00a0 aggrieved \u00a0 and \u00a0 not \u00a0 being \u00a0 satisfied \u00a0 by \u00a0 the\u00a0<br \/>\nabove \u00a0 orders \u00a0 the \u00a0 appellant \u00a0 preferred \u00a0 second \u00a0 appeal\u00a0<br \/>\nbefore\u00a0the\u00a0Commission.\n<\/p>\n<p>7.   The \u00a0 Appellant \u00a0 was \u00a0 present \u00a0 through \u00a0 audio\u00a0<br \/>\nconferencing. \u00a0 \u00a0 Respondents \u00a0 were \u00a0 present \u00a0 through\u00a0<br \/>\nvideoconferencing \u00a0 at \u00a0 Chandigarh \u00a0 and \u00a0 Mumbai\u00a0<br \/>\nrespectively. \u00a0 The \u00a0 Respondent \u00a0 submits \u00a0 that \u00a0 the\u00a0<br \/>\ninformation \u00a0 sought \u00a0 pertains \u00a0 to \u00a0 the \u00a0 &#8220;commercial\u00a0<br \/>\nconfidence&#8221; \u00a0 of \u00a0 the \u00a0 third \u00a0 party \u00a0 and \u00a0 also \u00a0 is \u00a0 personal\u00a0<br \/>\ninformation\u00a0u\/s\u00a08\u00a0(1)\u00a0(j)\u00a0of\u00a0the\u00a0RTI\u00a0Act.\u00a0They\u00a0also\u00a0<br \/>\ndirected \u00a0 the \u00a0 Commission \u00a0 to \u00a0 the \u00a0 earlier \u00a0 order \u00a0 of \u00a0 the\u00a0<br \/>\nCommission     \u00a0 dated      \u00a0    8th \u00a0       November       \u00a0 2007\u00a0<br \/>\n(CIC\/PB\/A2007\/01082) \u00a0 and \u00a0 8th \u00a0 September \u00a0 2009\u00a0<br \/>\n(CIC\/PB\/A\/2008\/01206\/SM) \u00a0 claiming \u00a0 that \u00a0 the \u00a0 said\u00a0<br \/>\ninformation \u00a0 could \u00a0 not \u00a0 be \u00a0 disclosed \u00a0 since \u00a0 such\u00a0<br \/>\ninformation\u00a0held\u00a0by\u00a0the\u00a0bank\u00a0in\u00a0commercial\u00a0confidence\u00a0<br \/>\nand\u00a0disclosure\u00a0of\u00a0such\u00a0information\u00a0could\u00a0have\u00a0adverse\u00a0<br \/>\nimpact \u00a0 on \u00a0 the \u00a0 competitive \u00a0 position \u00a0 of \u00a0 those\u00a0<br \/>\ncustomers.\u00a0\n<\/p>\n<p>8.   The \u00a0 respondents \u00a0 maintained \u00a0 that \u00a0 even \u00a0 otherwise\u00a0<br \/>\nalso,\u00a0the\u00a0information\u00a0sought\u00a0is\u00a0not\u00a0readily\u00a0available\u00a0<br \/>\nwith\u00a0the\u00a0Bank.\n<\/p>\n<p>                        Decision\u00a0notice<\/p>\n<p>9.    After\u00a0hearing\u00a0both\u00a0the\u00a0parties\u00a0the\u00a0Commission\u00a0is\u00a0<br \/>\nof \u00a0 the \u00a0 view \u00a0 that \u00a0 the \u00a0 information \u00a0 sought \u00a0 is \u00a0 neither\u00a0<br \/>\nagainst \u00a0 the \u00a0 &#8220;commercial \u00a0 confidence&#8221; \u00a0 nor \u00a0 &#8220;personal\u00a0<br \/>\ninformation&#8221;\u00a0of\u00a0the\u00a0third\u00a0party.\u00a0The\u00a0RTI\u00a0application\u00a0<br \/>\nspecifically\u00a0states\u00a0that\u00a0the\u00a0disclosure\u00a0of\u00a0the\u00a0Names\u00a0<br \/>\nof \u00a0 the \u00a0 defaulting \u00a0 parties \u00a0 can \u00a0 be \u00a0 omitted \u00a0 in \u00a0 the\u00a0<br \/>\ninformation\u00a0provided\u00a0by\u00a0the\u00a0Bank.\u00a0Thus,\u00a0the\u00a0question\u00a0<br \/>\nof \u00a0 the \u00a0 disclosure \u00a0 of \u00a0 the \u00a0 personal \u00a0 information \u00a0 does\u00a0<br \/>\nnot \u00a0 arise. \u00a0 Also, \u00a0 the \u00a0 appellant \u00a0 has \u00a0 only \u00a0 asked \u00a0 the\u00a0<br \/>\nDate \u00a0 and \u00a0 total \u00a0 amount \u00a0 that \u00a0 the \u00a0 bank \u00a0 has\u00a0<br \/>\n                           \u00a0\u00a0\u00a0Appeal\u00a0:\u00a0No.\u00a0CIC\/AT\/A\/2010\/001238\u00adDS\u00a0&amp;\u00a0<br \/>\n                                             CIC\/AT\/A\/2010\/001230\u00adDS\u00a0<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>settled\/compromised \u00a0 with \u00a0 the \u00a0 defaulting \u00a0 part \u00a0 which\u00a0<br \/>\ncannot\u00a0amount\u00a0as\u00a0&#8220;commercial\u00a0confidence&#8221;\u00a0of\u00a0the\u00a0third\u00a0<br \/>\nparty \u00a0 and \u00a0 disclosure \u00a0 of \u00a0 which \u00a0 could \u00a0 have \u00a0 adverse\u00a0<br \/>\nimpact \u00a0 on \u00a0 the \u00a0 competitive \u00a0 position \u00a0 of \u00a0 those \u00a0 third\u00a0<br \/>\nparty.\u00a0\n<\/p>\n<p>10. After \u00a0 perusing \u00a0 through \u00a0 the \u00a0 Orders \u00a0 supplied \u00a0 at\u00a0<br \/>\nthe\u00a0hearing\u00a0by\u00a0the\u00a0respondents,\u00a0it\u00a0is\u00a0observed\u00a0by\u00a0the\u00a0<br \/>\nCommission \u00a0 that \u00a0 the \u00a0 said \u00a0 orders \u00a0 are \u00a0 pertaining \u00a0 to\u00a0<br \/>\ndifferent \u00a0 set \u00a0 of \u00a0 facts \u00a0 in \u00a0 which \u00a0 the \u00a0 personal\u00a0<br \/>\ninformation\/ \u00a0 individual \u00a0 details \u00a0 of \u00a0 the \u00a0 NPA \u00a0 account\u00a0<br \/>\nhave \u00a0 been \u00a0 sought \u00a0 by \u00a0 the \u00a0 applicant \u00a0 from \u00a0 the \u00a0 Bank,\u00a0<br \/>\nwhich \u00a0 indeed \u00a0 is \u00a0 held \u00a0 by \u00a0 a \u00a0 Bank \u00a0 in \u00a0 commercial\u00a0<br \/>\nconfidence \u00a0 and \u00a0 disclosure \u00a0 of \u00a0 such \u00a0 information \u00a0 could\u00a0<br \/>\nhave \u00a0 adverse \u00a0 impact \u00a0 on \u00a0 the \u00a0 competitive \u00a0 position \u00a0 of\u00a0<br \/>\nthose \u00a0 customers. \u00a0 Also, \u00a0 in \u00a0 those \u00a0 cases \u00a0 the \u00a0 RTI\u00a0<br \/>\napplicant \u00a0 has \u00a0 not \u00a0 been \u00a0 able \u00a0 to \u00a0 establish \u00a0 any \u00a0 larger\u00a0<br \/>\npublic\u00a0interest\u00a0which\u00a0warrants\u00a0the\u00a0disclosure\u00a0of\u00a0such\u00a0<br \/>\ninformation.\n<\/p>\n<p>11. While\u00a0in\u00a0the\u00a0present\u00a0case,\u00a0the\u00a0Commission\u00a0is\u00a0of\u00a0<br \/>\nthe \u00a0 view \u00a0 that \u00a0 there \u00a0 is \u00a0 Larger \u00a0 Public \u00a0 Interest\u00a0<br \/>\ninvolved \u00a0 in \u00a0 disclosing \u00a0 the \u00a0 Settlement \u00a0 amount \u00a0 of \u00a0 the\u00a0<br \/>\nBanks\u00a0with\u00a0the\u00a0Defaulting\u00a0parties\u00a0as\u00a0it\u00a0will\u00a0help\u00a0in\u00a0<br \/>\ntransparent\u00a0functioning\u00a0of\u00a0the\u00a0public\u00a0authority\u00a0which\u00a0<br \/>\nis\u00a0the\u00a0very\u00a0objective\u00a0of\u00a0the\u00a0RTI\u00a0Act.\n<\/p>\n<p>12.
