The Tribunal<br \/>\n\thaving deleted the addition in relation to processing charges of<br \/>\n\tRs.12,54,766\/-, held that the penalty of Rs.10=00 lakhs sustained by<br \/>\n\tCommissioner (Appeals) under Section 271 (1)(c) of Income Tax Act,<br \/>\n\t1961 (the Act) cannot be upheld.\n<\/p>\n<p>\tToday,<br \/>\n\tby a separate order of even date between the same parties, for the<br \/>\n\tvery same Assessment Year, the Tribunal&#8217;s order on this count in<br \/>\n\tquantum proceedings being Question No.3 in Tax Appeal No. 19 of 1999<br \/>\n\thas been answered against the Revenue, holding that Tribunal had not<br \/>\n\tcommitted any error in deleting the addition in question. In the<br \/>\n\tcircumstances, the impugned order of Tribunal deleting penalty under<br \/>\n\tSection 271 (1)(c) of the Act does not call for interference.<br \/>\n\tAccordingly, the question in the present appeal is answered in the<br \/>\n\taffirmative, i.e., in favour of the Assessee and against the<br \/>\n\tRevenue.  Appeal stands disposed of according, with no order as to<br \/>\n\tcosts.\n<\/p>\n<p>                                                             [<br \/>\nD.A.
