Public Prosecutor waives service of<br \/>\n\tnotice of rule on behalf of the respondent &#8211; State of Gujarat.\n<\/p>\n<p>2.\tHaving<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>3.\tThe<br \/>\n\tapplicant &#8211; convict prisoner, who, by judgment and order dated<br \/>\n\t8.2.2008 rendered in Sessions Case No.19 of 2000 by the learned<br \/>\n\tAdditional Sessions Judge,<br \/>\n\tFast Track Court No.7, Rajkot at Gondal camp at<br \/>\n\tDhoraji has been convicted for the offence punishable under Section<br \/>\n\t302 etc. of the Indian Penal Code and sentenced imprisonment of<br \/>\n\tlife, has filed this application through his wife Sharifa Jamilbapu<br \/>\n\tKadri praying to enlarge him on temporary bail for a period of 30<br \/>\n\tdays, to enable him to construct the grave of his mother, who has<br \/>\n\tdied on 15.10.2010.\n<\/p>\n<p>4.\tWe<br \/>\n\thave considered submissions advanced by  Sharifa Jamilbapu Kadri,<br \/>\n\tparty-in-person and Mr. LB Dabhi, learned APP for the respondent &#8211;<br \/>\n\tState of Gujarat.  We have also considered the averments made in the<br \/>\n\tapplication and the supporting document as well as the earlier order<br \/>\n\tpassed by this Court so also the jail remark sheet.\n<\/p>\n<p>5.\tUpon<br \/>\n\tperusal of the jail remark sheet, we have noticed that the applicant<br \/>\n\thas undergone total period of 2 years 11 months imprisonment as<br \/>\n\tagainst the imprisonment of life.  During the short span of<br \/>\n\timprisonment, he was granted temporary bail on four occasions and<br \/>\n\talso granted one furlough leave.  He was also released on temporary<br \/>\n\tbail to perform the after death ceremony of his mother vide order<br \/>\n\tdated 15.11.2010 rendered in Criminal Misc. Application No.13657 of<br \/>\n\t2010 by the Coordinate Bench of this Court from the date of passing<br \/>\n\tthe order to 25.11.2010.\n<\/p>\n<p>6.\tIn<br \/>\n\tview of this, since the applicant was released in resent past to<br \/>\n\tperform the after death ceremony of his mother, we are not inclined<br \/>\n\tto grant temporary bail in favour of the applicant.\n<\/p>\n<p>7.\tFor<br \/>\n\tforegoing reasons, the application fails and it is accordingly<br \/>\n\trejected.
