Leave granted.\n<\/p>\n<\/p>\n<p>2.    Challenge in these appeals is to the judgment of a learned Single<\/p>\n<p>Judge of the Karnataka High Court dismissing the appeals filed by the<\/p>\n<p>appellant under Section 54(1) of the Land Acquisition Act, 1894 (in short<\/p>\n<p>the `Act&#8217;). In all these cases the judgment and award passed in the<\/p>\n<p>concerned land acquisition case by learned Principal Civil Judge (Senior<\/p>\n<p>Division), Gulbarga, was questioned. The Reference Petition for enhanced<\/p>\n<p>compensation was partly accepted. Before the High Court the stand was that<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><br \/>\nwhile evaluating the value of the structures no basis was indicated and by<\/p>\n<p>roughly exorbitant estimation amount of compensation was fixed. The High<\/p>\n<p>Court did not find any substance in the plea and dismissed the appeals.<\/p>\n<p>3.    Learned counsel for the appellant submitted that though some amount<\/p>\n<p>of guesswork may be involved there has to be a rational basis indicated for<\/p>\n<p>fixing the quantum. Therefore, when without any discussion and justifiable<\/p>\n<p>data the Reference Court had fixed the amount of compensation in respect<\/p>\n<p>of the structures the High Court should have interfered and, therefore, the<\/p>\n<p>judgment is clearly unsustainable.\n<\/p>\n<\/p>\n<p>4.    Learned counsel for the respondent in each case however submitted<\/p>\n<p>that in some cases involving similar dispute the appellant has not filed any<\/p>\n<p>appeal and therefore these appeal deserve to be dismissed. Additionally, it is<\/p>\n<p>submitted that there was no material before the Reference Court and<\/p>\n<p>therefore estimation has to be made.\n<\/p>\n<\/p>\n<p>5.    Learned counsel for the appellant has referred to the Schedule of<\/p>\n<p>Rates of Gulbarga specifically referring to various items and the units and<\/p>\n<p>the rates in respect of particular items described in the Schedule. According<\/p>\n<p><span class=\"hidden_text\">                                       3<\/span><br \/>\nto learned counsel for the appellant, the same provides a foundation for<\/p>\n<p>making a valuation. The Engineer who was examined had in fact referred to<\/p>\n<p>such documents but the Reference Court without any basis or reasons<\/p>\n<p>discarded the same.\n<\/p>\n<\/p>\n<p>6.    Learned counsel for the respondent in each case however submitted<\/p>\n<p>that they may provide for a foundation, but the valuation done by the<\/p>\n<p>Reference Court cannot be called to be arbitrary. When data is available<\/p>\n<p>from some sources, for example, Schedule of Rates adopted by PWD of a<\/p>\n<p>particular survey, that certainly provides a foundation for making the<\/p>\n<p>valuation. In the instant case that does not appear to have been noticed. In<\/p>\n<p>the circumstances, we set aside the impugned judgments of the High Court<\/p>\n<p>and remit the matter to the Reference Court to make the valuation on the<\/p>\n<p>basis of Schedule of Rates of PWD, Gulbarga Circle for the relevant period.<\/p>\n<p>Since the matter is pending since long, the Reference Court would do well<\/p>\n<p>to make the valuation and make fresh award within four months from the<\/p>\n<p>receipt of this order. The amount of interest payable would be consequential<\/p>\n<p>to the determination of the award.\n<\/p>\n<p><span class=\"hidden_text\">                                     4<\/span>\n<\/p>\n<p>7.
