No. 5233 of 2010<\/p>\n<p>                                This application under Section 5 of the<\/p>\n<p>                   Limitation Act is filed by the appellant for condonation of<\/p>\n<p>                   delay of 38 days occurred in filing the Letters Patent<\/p>\n<p>                   Appeal.\n<\/p>\n<p>                                On the facts and in the circumstances of the<\/p>\n<p>                   case, the delay is condoned.\n<\/p>\n<p>                                The Interim Application stands disposed of.<\/p>\n<p>                                L.P.A. No. 934 of 2010<\/p>\n<p>                                This Appeal under Clause 10 of the Letters<\/p>\n<p>                   Patent arises from the order dated 15th February 2010<\/p>\n<p>                   made by the learned Single Judge in above C.W.J.C. No.<\/p>\n<p>                   6119 of 2007.\n<\/p>\n<p>                                The learned Single Judge has refused to<\/p>\n<p>                   interfere in the matter of allotment of retail outlet by the<\/p>\n<p>                   respondent Indian Oil Corporation on the ground that<\/p>\n<p>                   pending the petition the respondent no. 6 has been allotted<\/p>\n<p>                   the retail outlet and that has become functional.<\/p>\n<p>                                Mr.   Shailesh    Kumar     Sharma,    learned<\/p>\n<p>                   advocate appearing on behalf of the appellant, in support<\/p>\n<p>                   of his contention has relied upon the judgment of Supreme<\/p>\n<p>                   Court in the case of Onkar Lal Bajaj etc. Versus Union<\/p>\n<p>                   of India and another etc. reported in A.I.R. 2003 S.C.<\/p>\n<p>                   2562.\n<\/p>\n<p>                                In our opinion, the learned Single Judge has<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>         rightly exercised the discretion under Article 226 of the<\/p>\n<p>         Constitution. No case for interference is made out. The<\/p>\n<p>         appeal is dismissed in limine.<\/p>\n<pre>\n\n\n\n                                (R.M.
