SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/05\/2011 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThe<br \/>\npresent First Appeal arises out of the impugned order dated<br \/>\n30\/12\/2010 passed by learned Motor Accident Claims Tribunal (Aux.),<br \/>\nAnand in Application below Exh.6 in Motor Accident Claim Petition<br \/>\nNo.1726\/2006 awarding a sum of Rs.25,000\/- to the original claimant<br \/>\nwith interest at the rate of 7.5 % per annum from the date of<br \/>\napplication till realization by way of interim compensation under<br \/>\nSection 140 of the Motor Vehicles Act for &#8220;No Fault Liability&#8221;.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard Mr.Mehta, learned advocate appearing on behalf of the appellant\n<\/p>\n<p>&#8211; original Opponent No.2 &#8211; National Insurance Company, as the<br \/>\nimpugned order is passed under Section 140 of the Motor Vehicles Act,<br \/>\nby which the Tribunal has awarded interim compensation under Section<br \/>\n140 of the Motor Vehicles Act, the present appeal is not entertained.<br \/>\nHowever, it is observed that deposit of any amount pursuant to the<br \/>\nsaid order, the same shall be without prejudice to the rights and<br \/>\ncontentions of the respective parties in the main claim petition and<br \/>\nall the defences and contentions, which are available to the<br \/>\nrespective parties are kept open and the same shall be considered by<br \/>\nthe Tribunal while deciding the main claim petition. However, as far<br \/>\nas the amount to be deposited by the appellant as per the order<br \/>\npassed by the Tribunal is concerned, it appears that while passing<br \/>\noperative portion of the order, the Tribunal has directed to invest<br \/>\n70% amount in any Nationalised Bank and balance amount of 30% is<br \/>\ndirected to be paid to the claimant by Account Payee Cheque, the same<br \/>\nis modified to the extent that the Tribunal is directed to invest the<br \/>\nentire amount in any Nationalized Bank initially for a period of five<br \/>\nyears and the claimant shall be entitled to get periodical interest<br \/>\non the same, which shall be paid to the claimant by Account Payee<br \/>\nCheque.\n<\/p>\n<p>3.\t\tWith<br \/>\nthese, the present First Appeal is disposed of.
