KRISHNAN, J.\n                   ...........................................\n                   M.A.C.A.No.1097 OF 2009\n                  .............................................\n           Dated this the 5th day of November, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>     This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, Kottayam in OP(MV)No.2449\/2004.                          The<\/p>\n<p>claimant, a passenger in a private car, sustained injuries in<\/p>\n<p>a road accident and he has been awarded a compensation of<\/p>\n<p>Rs.27,000\/= and the insurance company has been directed to<\/p>\n<p>pay the said    compensation. Aggrieved by the said decision,<\/p>\n<p>the insurance company has come up in appeal challenging<\/p>\n<p>the validity of such an order.\n<\/p>\n<p>     2. The claimant was a passenger in a private car and<\/p>\n<p>the vehicle was covered by a package policy. No additional<\/p>\n<p>premium has been paid to cover the risk of the passengers. It<\/p>\n<p>is  contended by the learned                counsel          for the insurance<\/p>\n<p>company that when no premium is paid for the additional<\/p>\n<p>coverage of the passengers,              the principles laid in <a href=\"\/doc\/423517\/\">United<\/p>\n<p>India Insurance Co. Ltd. v. Tilak Singh<\/a> [(2006 (2) KLT<\/p>\n<p>884 (SC)] may have to be applied to the passengers in a<\/p>\n<p>private car for the reason that their status will be that of a<\/p>\n<p><span class=\"hidden_text\">                              : 2 :<\/span><br \/>\n M.A.C.A.No.1097 OF 2009<\/p>\n<p>gratuitous passengers not covered by the policy. It is a<\/p>\n<p>contention worth considering       so far as    the payment of<\/p>\n<p>premium is concerned.\n<\/p>\n<p>     3. But the question whether there is a condition in the<\/p>\n<p>contract of insurance between      the insurer and the insured<\/p>\n<p>whereby the insurer undertakes to cover the liability with<\/p>\n<p>respect to death of or bodily injury of a person travelling in<\/p>\n<p>a motor vehicle other than for hire or reward is incorporated<\/p>\n<p>and the question whether by virtue of the terms of the<\/p>\n<p>insurance contract    the company is bound         to pay   the<\/p>\n<p>compensation had come up for          consideration before    a<\/p>\n<p>Division Bench of this Court in <a href=\"\/doc\/135962\/\">New India Assurance<\/p>\n<p>Co.Ltd. v. Hydrose<\/a> (2008 (3) KLT 778). The clause therein<\/p>\n<p>&#8221;except so far as it relates to the liability under the Motor<\/p>\n<p>Vehicles Act&#8221; was also considered by another Division Bench<\/p>\n<p>of this Court in the decision reported in     <a href=\"\/doc\/1457758\/\">Mathew v. Shaji<\/p>\n<p>Mathew<\/a> (2009 (3) KLT 813). In both             these cases, the<\/p>\n<p>Division Benches held that      by virtue of the terms and<\/p>\n<p>conditions of the   contract,   the insurance     company  has<\/p>\n<p>undertaken to indemnify the liability of the owner, then the<\/p>\n<p><span class=\"hidden_text\">                            : 3 :<\/span><br \/>\nM.A.C.A.No.1097 OF 2009<\/p>\n<p>question of making payment of additional premium in such<\/p>\n<p>cases is not necessary and that    the insurance   company<\/p>\n<p>cannot get exonerated from the liability.<\/p>\n<p>       4. So, in   the light of these    two   authoritative<\/p>\n<p>pronouncements rendered by this Court, I have to hold that<\/p>\n<p>by virtue of the terms and    conditions of the policy, the<\/p>\n<p>insurance company is bound to indemnify and therefore, the<\/p>\n<p>direction given by the Motor Accidents Claims Tribunal to<\/p>\n<p>the insurance    company to pay the      amount cannot be<\/p>\n<p>interfered with.\n<\/p>\n<p>     Therefore, the appeal is devoid of any merit and it is<\/p>\n<p>dismissed.\n<\/p>\n<\/p>\n<p>                               M.N.
