Dadwal, Advocate.\n\n\n                             .     .      .\n\nAJAI LAMBA, J (Oral)\n\n<span class=\"hidden_text\">                  This      petition          under      Section          438<\/span>\n\n<\/pre>\n<p>Cr.P.C. prays for bail to the petitioners in case<\/p>\n<p>FIR No.203 dated 7.10.2008 under Sections 326, 325,<\/p>\n<p>324, 323, 452, 148, 149 IPC, Police Station, Model<\/p>\n<p>Town, Hoshiarpur.\n<\/p>\n<p>                  The petitioners, in this petition, are<\/p>\n<p>Tarsem Lal, Baljit Singh @ Sonu and Mandeep Singh @<\/p>\n<p>Monu. The allegations against the petitioners are in<\/p>\n<p>the following terms:-\n<\/p>\n<blockquote><p>                     &#8220;&#8230; Then at about 6.30 P.M. I was present at shop<br \/>\n                  no.28 in sabzi Mandi where they came. Tarsem, Baljit,<br \/>\n                  Mandeep and three more unknown persons at once<br \/>\n                  entered the shop and seeing them I went to Chobara<br \/>\n                  then Mandip alias Monu gave a kirpan blow on me<br \/>\n                  which hit on my left leg. Then Baljit alias Sonu gave<br \/>\n Crl. Misc. No. M-30029 of 2008                                         [2]<\/p>\n<p>                      datar blow on me which hit left side of my head then,<br \/>\n                      Tarsem gave Kirpan blow which hit on my left ear.<br \/>\n                      Thereafter three unknown persons and Santokh Singh<br \/>\n                      and out of them some one gave kirpan on my left<br \/>\n                      finger, I fell on the floor and while lying down the<br \/>\n                      assailants caused me more injuries with their weapons.<br \/>\n                      On raising raula the assailants ran away from the spot<br \/>\n                      with their weapons and during the occurrence the gold<br \/>\n                      chain around my neck and Rs.8250\/- from the pocket of<br \/>\n                      my shirt and my mobile Nokia &#8211; 9914 9914026240 fell<br \/>\n                      and were not traced&#8230;&#8221;<\/p><\/blockquote>\n<p>                      Learned      counsel       for     the      petitioners<\/p>\n<p>contends that only Mandeep Singh has been ascribed<\/p>\n<p>injury on account of which Section 326 IPC has been<\/p>\n<p>invoked. Mandeep Singh however is a juvenile. So far<\/p>\n<p>as Tarsem Lal and Baljit Singh are concerned, they<\/p>\n<p>have not been ascribed any such injury that would be<\/p>\n<p>sufficient to invoke Section 326 IPC.<\/p>\n<p>                      I have considered the contentions of<\/p>\n<p>the learned counsel. Vide Order dated 18.11.2008,<\/p>\n<p>the    petitioners        were     required       to    show      as   to      why<\/p>\n<p>procedure as given out in Juvenile Justice (Care &amp;<\/p>\n<p>Protection       of     Children)        Act,     2000      has     not      been<\/p>\n<p>followed.\n<\/p>\n<p>                      Learned      counsel       for     the      respondent-<\/p>\n<p>State, on instructions from ASI Surdev Singh, has<\/p>\n<p>informed the Court that petitioner, Mandeep Singh,<\/p>\n<p>has not made any such application.<\/p>\n<p>                      I have also considered the contention<\/p>\n<p>of     learned        counsel        for       the     petitioner            that<\/p>\n<p>petitioner Nos.1 and 2 have not been ascribed any<\/p>\n<p>injury that would invite provisions of Section 326<\/p>\n<p>IPC.\n<\/p>\n<p>                      Considering        the     manner      in    which       the<br \/>\n Crl. Misc.
