The appeal is pending and hearing is likely to<br \/>\ntake time being the appeal of 2010. The applicant prays for<br \/>\ndisbursement of the awarded amount. Considering the escalation of<br \/>\nprices of land, paying 50% of the awarded amount without security to<br \/>\nthe original land owner is not going to cause any risk to the<br \/>\ninterest of the opponent-appellants.\n<\/p>\n<p>4.\tUnder<br \/>\nthe circumstances, the Reference Court is directed to pay 50% of the<br \/>\namount deposited to the applicant by crossed account payee cheque.<br \/>\nThe remaining 50% of the amount deposited by the opponent-appellants<br \/>\nwould be placed in a Fixed Term Deposit with any nationalized bank in<br \/>\nthe name of the Nazir of the Court, initially for a period of three<br \/>\nyears, to be renewed thereafter for one year automatically on each<br \/>\noccasion till further orders of this Court.\n<\/p>\n<p>5.\tLearned<br \/>\nadvocate Mr Shah appearing with Mr Gandhi states  that a coordinate<br \/>\nBench has already taken a decision in respect of Block No.27, which<br \/>\nis adjacent to the land in question, and that judgment has been<br \/>\naccepted by the other side.  In that view of the matter, let the<br \/>\nappeal be listed for final hearing in the month of January, 2011.\n<\/p>\n<p>6.\tThe<br \/>\napplication stands disposed of. Rule is made absolute accordingly.
