respondents\u00a0have\u00a0stopped\u00a0supply\u00a0of\u00a0coal\u00a0for\u00a0the\u00a0reason\u00a0that\u00a0the\u00a0linkage\u00a0<br \/>\n            stands\u00a0lapsed\u00a0as\u00a0on\u00a0today.\u00a0The\u00a0prayer\u00a0is\u00a0for\u00a0an\u00a0appropriate\u00a0direction\u00a0to\u00a0<br \/>\n            resume\u00a0the\u00a0coal\u00a0supply\u00a0in\u00a0favour\u00a0of\u00a0the\u00a0petitioner\u00a0forthwith.\u00a0\n<\/p>\n<p>                           The\u00a0petitioner\u00a0established\u00a0a\u00a0manufacturing\u00a0unit\u00a0at\u00a0Phoolpur,\u00a0<br \/>\n            Varanasi \u00a0 (U.P.) \u00a0 and \u00a0 the \u00a0 unit \u00a0 was \u00a0 registered \u00a0 under \u00a0 the \u00a0 Industries\u00a0<br \/>\n            Department.\u00a0The\u00a0respondents\u00a0granted\u00a0coal\u00a0linkage\u00a0in\u00a0favour\u00a0of\u00a0the\u00a0unit\u00a0<br \/>\n            for\u00a0quantity\u00a0of\u00a02400\u00a0M.T.\u00a0per\u00a0month.\u00a0Since\u00a0the\u00a0coal\u00a0being\u00a0the\u00a0raw\u00adcoal\u00a0to\u00a0<br \/>\n            run\u00a0the\u00a0Industry,\u00a0the\u00a0petitioner\u00a0used\u00a0to\u00a0lift\u00a0coal\u00a0from\u00a0the\u00a0respondents.\u00a0<br \/>\n            The \u00a0 Deputy \u00a0 Commissioner, \u00a0 Varanasi \u00a0 on \u00a0 the \u00a0 basis \u00a0 of \u00a0 certain \u00a0 enquiries\u00a0<br \/>\n            cancelled\u00a0the\u00a0permanent\u00a0registration\u00a0of\u00a033\u00a0units\u00a0including\u00a0the\u00a0petitioner\u00a0<br \/>\n            vide \u00a0 order \u00a0 dated \u00a0 31st \u00a0 July, \u00a0 1999. \u00a0 Subsequently, \u00a0 the \u00a0 petitioner\u00a0<br \/>\n            approached\u00a0the\u00a0Industries\u00a0Department\u00a0by\u00a0way\u00a0of\u00a0appeal\u00a0and\u00a0the\u00a0Joint\u00a0<br \/>\n            Director, \u00a0 Industries \u00a0 (Eastern \u00a0 Region) \u00a0 Varanasi \u00a0 Division \u00a0 after \u00a0 being\u00a0<br \/>\n            satisfied \u00a0 that \u00a0 the \u00a0 petitioner&#8217;s \u00a0 unit \u00a0 was \u00a0 bona \u00a0 fidely \u00a0 utilizing \u00a0 the \u00a0 coal,\u00a0<br \/>\n            restored \u00a0 the \u00a0 registration \u00a0 of \u00a0 the \u00a0 unit \u00a0 vide \u00a0 order \u00a0 dated \u00a0 17th \u00a0 December,\u00a0<br \/>\n            1999\u00a0(Annexure\u00ad4\u00a0to\u00a0this\u00a0writ\u00a0petition).\u00a0Consequent\u00a0to\u00a0the\u00a0revival\u00a0of\u00a0the\u00a0<br \/>\n            registration, \u00a0 the \u00a0 petitioner \u00a0 approached \u00a0 the \u00a0 Sales \u00a0 and \u00a0 Marketing\u00a0<br \/>\n            Department\u00a0of\u00a0M\/s\u00a0B.C.C.L.\u00a0for\u00a0resumption\u00a0of\u00a0coal\u00a0supply.\u00a0This\u00a0was\u00a0not\u00a0<br \/>\n            done\u00a0and\u00a0finally\u00a0W.P.(C)No.5618\u00a0of\u00a02001\u00a0was\u00a0preferred\u00a0for\u00a0restoration\u00a0of\u00a0<br \/>\n            the\u00a0linkage.\u00a0The\u00a0Writ\u00a0Petition\u00a0was\u00a0finally\u00a0disposed\u00a0of\u00a0with\u00a0the\u00a0direction\u00a0<br \/>\n            that\u00a0the\u00a0petitioners\u00a0may\u00a0approach\u00a0the\u00a0Coal\u00a0Company\u00a0and\u00a0repeat\u00a0their\u00a0<br \/>\n            prayer\u00a0\u00a0\u00a0\u00a0\u00a0before\u00a0\u00a0\u00a0the\u00a0\u00a0competent\u00a0\u00a0authority\u00a0\u00a0such\u00a0\u00a0as\u00a0\u00a0the\u00a0\u00a0Chief\u00a0\u00a0General\u00a0<br \/>\n<span class=\"hidden_text\">                                       2.<\/span><br \/>\nManager \u00a0 (Sales) \u00a0 or \u00a0 any \u00a0 other \u00a0 Officer \u00a0 delegated \u00a0 with \u00a0 the \u00a0 power, \u00a0 who\u00a0<br \/>\nshall \u00a0 look \u00a0 into \u00a0 the \u00a0 matter \u00a0 and \u00a0 pass \u00a0 necessary \u00a0 orders \u00a0 restoring \u00a0 fresh\u00a0<br \/>\nlinkage. \u00a0 The \u00a0 order \u00a0 in \u00a0 the \u00a0 Writ \u00a0 Petition \u00a0 is \u00a0 dated \u00a0 10th \u00a0 September,\u00a0<br \/>\n2002(Annexure\u00ad8 \u00a0 to \u00a0 the \u00a0 Writ \u00a0 Petition). \u00a0 The \u00a0 petitioners \u00a0 submitted \u00a0 the\u00a0<br \/>\naforesaid\u00a0order\u00a0of\u00a0the\u00a0Writ\u00a0Petition\u00a0before\u00a0the\u00a0concerned\u00a0authority\u00a0but\u00a0<br \/>\nthe\u00a0revival\u00a0of\u00a0the\u00a0coal\u00a0supply\u00a0was\u00a0refused\u00a0on\u00a0account\u00a0of\u00a0the\u00a0reason\u00a0that\u00a0<br \/>\nthe\u00a0linkage\u00a0had\u00a0already\u00a0lapsed\u00a0and\u00a0there\u00a0was\u00a0no\u00a0rule\u00a0for\u00a0revival\u00a0of\u00a0the\u00a0<br \/>\nlinkage\u00a0at\u00a0that\u00a0point\u00a0of\u00a0time\u00a0and\u00a0it\u00a0can\u00a0be\u00a0considered\u00a0only\u00a0after\u00a0the\u00a0new\u00a0<br \/>\npolicy\u00a0comes\u00a0into\u00a0effect.\u00a0The\u00a0claim\u00a0of\u00a0the\u00a0petitioner\u00a0is\u00a0that\u00a0though\u00a0the\u00a0<br \/>\nrespondents \u00a0 refused \u00a0 linkage \u00a0 with \u00a0 the \u00a0 petitioner\u00adCompany \u00a0 but\u00a0<br \/>\nconsequently\u00a0restored\u00a0the\u00a0linkage\u00a0of\u00a07\u00a0different\u00a0units\u00a0in\u00a0the\u00a0month\u00a0of\u00a0<br \/>\nJune,\u00a02003\u00a0whereby\u00a0they\u00a0claimed\u00a0that\u00a0they\u00a0have\u00a0been\u00a0discriminated.\u00a0It\u00a0is\u00a0<br \/>\nfurther\u00a0stressed\u00a0that\u00a0clause\u00a03\u00a0of\u00a0the\u00a0terms\u00a0and\u00a0conditions\u00a0of\u00a0the\u00a0linkage\u00a0<br \/>\nprovide\u00a0that\u00a0in\u00a0the\u00a0event\u00a0of\u00a0failure\u00a0to\u00a0lift\u00a0coal\u00a0by\u00a0the\u00a0unit\u00a0for\u00a0consecutive\u00a0<br \/>\n12\u00a0months\u00a0or\u00a0more,\u00a0the\u00a0linkage\u00a0will\u00a0be\u00a0treated\u00a0as\u00a0snapped.\u00a0In\u00a0the\u00a0event\u00a0<br \/>\nany \u00a0 consumer \u00a0 desires \u00a0 to \u00a0 draw \u00a0 coal \u00a0 after \u00a0 the \u00a0 linkage \u00a0 of \u00a0 the \u00a0 coal \u00a0 is\u00a0<br \/>\nsnapped, \u00a0 he \u00a0 will \u00a0 have \u00a0 to \u00a0 apply \u00a0 for \u00a0 restoration \u00a0 of \u00a0 linkage \u00a0 and \u00a0 only\u00a0<br \/>\nthereafter \u00a0 the \u00a0 consumer \u00a0 will \u00a0 be \u00a0 entitled \u00a0 to \u00a0 lift \u00a0 the \u00a0 coal. \u00a0 Several\u00a0<br \/>\nrepresentations \u00a0 were \u00a0 filed \u00a0 before \u00a0 the \u00a0 respondents, \u00a0 which \u00a0 were \u00a0 finally\u00a0<br \/>\nrejected\u00a0by\u00a0means\u00a0of\u00a0order\u00a0dated\u00a01st\u00a0June,\u00a02009\u00a0(Annexure\u00ad19\u00a0to\u00a0the\u00a0<br \/>\nWrit\u00a0Petition)\u00a0passed\u00a0by\u00a0the\u00a0General\u00a0Manager,\u00a0(\u00a0S\u00a0&amp;\u00a0M).\u00a0This\u00a0order\u00a0is\u00a0<br \/>\nimpugned\u00a0in\u00a0the\u00a0instant\u00a0Writ\u00a0Petition.\u00a0\n<\/p>\n<p>               I\u00a0have\u00a0gone\u00a0through\u00a0the\u00a0entire\u00a0order\u00a0and\u00a0the\u00a0main\u00a0ground\u00a0<br \/>\nfor \u00a0 declining \u00a0 resumption \u00a0 of \u00a0 linkage \u00a0 is \u00a0 that \u00a0 the \u00a0 Ministry \u00a0 of \u00a0 Coal,\u00a0<br \/>\nGovernment\u00a0of\u00a0India\u00a0has\u00a0framed\u00a0New\u00a0Coal\u00a0Distribution\u00a0Policy\u00a0(N.C.D.P.\u00a0<br \/>\nin\u00a0short)\u00a0in\u00a0October,\u00a02009\u00a0superseding\u00a0the\u00a0previous\u00a0linkage\u00a0system\u00a0and\u00a0<br \/>\nall\u00a0earlier\u00a0decisions\u00a0in\u00a0respect\u00a0of\u00a0release\u00a0of\u00a0coal\u00a0whether\u00a0linked\u00a0or\u00a0non\u00ad<br \/>\nlinked \u00a0 at \u00a0 any \u00a0 point \u00a0 of \u00a0 time \u00a0 can \u00a0 also \u00a0 source \u00a0 its \u00a0 requirement \u00a0 of \u00a0 coal\u00a0<br \/>\nthrough \u00a0 e\u00adAuction \u00a0 which \u00a0 is \u00a0 being \u00a0 regularly \u00a0 being \u00a0 conducted \u00a0 by\u00a0<br \/>\nrespondent\u00a0BCCL\u00a0and\u00a0other\u00a0subsidiaries\u00a0of\u00a0Coal\u00a0India\u00a0Limited\u00a0engaged\u00a0in\u00a0<br \/>\nraising\u00a0and\u00a0selling\u00a0of\u00a0coal.\u00a0Since\u00a0the\u00a0old\u00a0system\u00a0of\u00a0linkage\u00a0has\u00a0been\u00a0done\u00a0<br \/>\naway\u00a0with\u00a0on\u00a0coming\u00a0into\u00a0force\u00a0of\u00a0NCDP,\u00a0the\u00a0revival\u00a0of\u00a0the\u00a0linkage\u00a0was\u00a0<br \/>\nnot\u00a0possible.\u00a0\n<\/p>\n<p>               After\u00a0giving\u00a0careful\u00a0consideration\u00a0to\u00a0the\u00a0argument\u00a0advanced\u00a0<br \/>\nby\u00a0Mr.\u00a0Anoop\u00a0Kumar\u00a0Mehta,\u00a0appearing\u00a0on\u00a0behalf\u00a0of\u00a0the\u00a0respondents\u00a0as\u00a0<br \/>\nwell\u00a0as\u00a0the\u00a0Counsel\u00a0appearing\u00a0on\u00a0behalf\u00a0of\u00a0the\u00a0petitioner,\u00a0I\u00a0am\u00a0of\u00a0the\u00a0<br \/>\nconsidered\u00a0view\u00a0that\u00a0the\u00a0respondents\u00a0had\u00a0no\u00a0other\u00a0option\u00a0but\u00a0to\u00a0decline\u00a0<br \/>\n<span class=\"hidden_text\">                                3.<\/span><br \/>\nthe \u00a0 revival \u00a0 of \u00a0 the \u00a0 linkage \u00a0 on \u00a0 account \u00a0 of \u00a0 advent \u00a0 of \u00a0 the \u00a0 new \u00a0 policy.\u00a0<br \/>\nHowever,\u00a0it\u00a0is\u00a0also\u00a0noteworthy\u00a0that\u00a0the\u00a0petitioner\u00a0could\u00a0not\u00a0lift\u00a0coal\u00a0for\u00a0a\u00a0<br \/>\nperiod \u00a0 of \u00a0 continuous \u00a0 12 \u00a0 months \u00a0 which \u00a0 consequently \u00a0 resulted \u00a0 into \u00a0 in\u00a0<br \/>\nsnapping\u00a0of\u00a0the\u00a0linkage\u00a0which\u00a0was\u00a0for\u00a0the\u00a0reasons\u00a0beyond\u00a0his\u00a0control.\u00a0<br \/>\nAfter\u00a0revival\u00a0of\u00a0petitioner&#8217;s\u00a0unit,\u00a0he\u00a0is\u00a0not\u00a0able\u00a0to\u00a0function\u00a0only\u00a0because\u00a0of\u00a0<br \/>\nnon\u00adsupply\u00a0of\u00a0coal,\u00a0and\u00a0this\u00a0is\u00a0evidently\u00a0resulting\u00a0in\u00a0heavy\u00a0loss\u00a0to\u00a0the\u00a0<br \/>\npetitioner. \u00a0 In \u00a0 view \u00a0 of \u00a0 all \u00a0 these \u00a0 circumstances, \u00a0 I \u00a0 do \u00a0 not \u00a0 think \u00a0 that\u00a0<br \/>\npendency\u00a0of\u00a0this\u00a0writ\u00a0petition\u00a0is\u00a0going\u00a0to\u00a0yield\u00a0any\u00a0fruitful\u00a0result.\n<\/p>\n<p>               \u00a0In\u00a0the\u00a0circumstances,\u00a0I\u00a0dispose\u00a0of\u00a0this\u00a0Writ\u00a0Petition\u00a0with\u00a0the\u00a0<br \/>\ndirection\u00a0to\u00a0the\u00a0respondents\u00a0to\u00a0consider\u00a0the\u00a0petitioner&#8217;s\u00a0supply\u00a0of\u00a0coal,\u00a0if\u00a0<br \/>\na\u00a0fresh\u00a0application\u00a0for\u00a0supply\u00a0is\u00a0made\u00a0under\u00a0the\u00a0New\u00a0Policy\u00a0and\u00a0looking\u00a0<br \/>\ninto \u00a0 the \u00a0 entire \u00a0 history \u00a0 of \u00a0 the \u00a0 case \u00a0 and \u00a0 also \u00a0 that \u00a0 the \u00a0 petitioner \u00a0 was\u00a0<br \/>\nprevented\u00a0from\u00a0lifting\u00a0the\u00a0coal\u00a0for\u00a0certain\u00a0circumstances\u00a0which\u00a0was\u00a0not\u00a0<br \/>\nwithin \u00a0 his \u00a0 control. \u00a0 The \u00a0 respondents \u00a0 shall \u00a0 examine \u00a0 the \u00a0 matter \u00a0 and\u00a0<br \/>\nconsider\u00a0the\u00a0case\u00a0of\u00a0the\u00a0petitioner\u00a0on\u00a0a\u00a0priority\u00a0basis.\u00a0A\u00a0fresh\u00a0agreement\u00a0<br \/>\nmay\u00a0be\u00a0entered\u00a0into,\u00a0suitable\u00a0steps\u00a0shall\u00a0be\u00a0taken\u00a0to\u00a0revive\u00a0supply\u00a0of\u00a0<br \/>\ncoal,\u00a0expeditiously,\u00a0to\u00a0enable\u00a0the\u00a0petitioner\u00a0to\u00a0start\u00a0his\u00a0unit\u00a0as\u00a0early\u00a0as\u00a0<br \/>\npossible.\u00a0\n<\/p>\n<p>               With\u00a0these\u00a0observations\u00a0and\u00a0directions,\u00a0this\u00a0writ\u00a0petition\u00a0is\u00a0<br \/>\ndisposed\u00a0of.\u00a0\n<\/p>\n<p>               The \u00a0 petitioner \u00a0 may \u00a0 approach \u00a0 the \u00a0 respondents \u00a0 with \u00a0 the\u00a0<br \/>\ncertified \u00a0 copy \u00a0 of \u00a0 this \u00a0 order \u00a0 which \u00a0 shall \u00a0 be \u00a0 looked \u00a0 into \u00a0 and \u00a0 examined\u00a0<br \/>\nwithin\u00a0a\u00a0period\u00a0of\u00a04\u00a0weeks\u00a0from\u00a0the\u00a0date\u00a0the\u00a0application\u00a0is\u00a0made\u00a0to\u00a0avoid\u00a0<br \/>\nany\u00a0further\u00a0delay\u00a0and\u00a0final\u00a0order\u00a0for\u00a0supply\u00a0of\u00a0coal,\u00a0shall\u00a0be\u00a0passed\u00a0in\u00a0<br \/>\naccordance\u00a0with\u00a0law\u00a0within\u00a0the\u00a0period\u00a0of\u00a0four\u00a0weeks.\u00a0\u00a0\u00a0\n<\/p>\n<p>
