No.283\/2011-I\n              ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n          Dated this the 5th day of January, 2011\n\n                    J U D G M E N T\n<\/pre>\n<p>    The petitioner herein was initially appointed as<\/p>\n<p>U.P.S.A under the fourth respondent from 19\/07\/1999 and<\/p>\n<p>was later promoted as H.S.A (Maths) against a leave<\/p>\n<p>vacancy from 05\/06\/2004.\n<\/p>\n<\/p>\n<p>    2.   It is the case of the petitioner that when a<\/p>\n<p>regular vacancy of H.S.A (Maths) arose on 16\/02\/2008,<\/p>\n<p>instead of accommodating the petitioner, the fifth<\/p>\n<p>respondent H.S.A. (S.S) has been adjusted against it.<\/p>\n<p>It is contended that the petitioner ought to have been<\/p>\n<p>accommodated against the regular vacancy in the light<\/p>\n<p>of the principles stated by this Court in various<\/p>\n<p>decisions.\n<\/p>\n<\/p>\n<p>    3.   The  petitioner  has  already   approached the<\/p>\n<p>Government by filing Ext.P13 revision petition under<\/p>\n<p>Rule 92 of Chapter XIVA K.E.R.    It is prayed that the<\/p>\n<p>Government may be directed to take a decision on<\/p>\n<p>Ext.P13.   The writ petition is hence disposed of<\/p>\n<p>directing the first respondent to take a decision on<\/p>\n<p>Ext.P13 revision petition after hearing the petitioner,<\/p>\n<p>W.P.(C). No.283\/2011<br \/>\n<span class=\"hidden_text\">                         -:2:-<\/span><\/p>\n<p>Manager and the fifth respondent and any other person<\/p>\n<p>likely to be affected by the decision within a period<\/p>\n<p>of three months from the date of receipt of a copy of<\/p>\n<p>this Judgment. The petitioner will produce a copy of<\/p>\n<p>the writ petition along with a copy of the Judgment<\/p>\n<p>before the first respondent for compliance. No costs.<\/p>\n<p>                      (T.R.
