Appellant&#8217;s\u00a0RTI\u00adapplication\u00a0dated\u00a016.07.2009\u00a0was\u00a0replied\u00a0to\u00a0by\u00a0the\u00a0<br \/>\nCPIO \u00a0 on \u00a0 18.08.2009, \u00a0 in \u00a0 which, \u00a0 CPIO \u00a0 declined \u00a0 to \u00a0 disclose \u00a0 any \u00a0 of \u00a0 the\u00a0<br \/>\nrequested \u00a0information \u00a0except \u00a0item\u00a0no.4, \u00a0in\u00a0respect \u00a0of\u00a0which, \u00a0he\u00a0stated\u00a0<br \/>\nthat \u00a0 as \u00a0 per \u00a0 his \u00a0 records \u00a0 there \u00a0 were \u00a0 no \u00a0 cases \u00a0 of \u00a0 late \u00a0 sanction\/issue \u00a0 of\u00a0<br \/>\ndrawback \u00a0 letters. \u00a0 \u00a0 The \u00a0 reply \u00a0 to \u00a0 this \u00a0 query, \u00a0 according \u00a0 to \u00a0 CPIO, \u00a0 was\u00a0<br \/>\ntherefore\u00a0&#8216;NIL&#8217;.\n<\/p>\n<p>3.      Appellate\u00a0Authority,\u00a0through\u00a0his\u00a0order\u00a0dated\u00a009.10.2009,\u00a0upheld\u00a0the\u00a0<br \/>\nfirst\u00adappeal\u00a0and\u00a0directed\u00a0the\u00a0CPIO\u00a0to\u00a0respond\u00a0to\u00a0the\u00a0appellant&#8217;s\u00a0queries.\n<\/p>\n<p>4.    Accordingly, \u00a0 CPIO \u00a0 furnished \u00a0 further \u00a0 reply \u00a0 to \u00a0 the \u00a0 appellant \u00a0 on\u00a0<br \/>\n13.10.2009.\n<\/p>\n<p>5.     The\u00a0queries\u00a0and\u00a0the\u00a0replies\u00a0are\u00a0discussed\u00a0below:\u00ad<\/p>\n<p>CIC_AT_A_2010_000187.doc\u00a0<br \/>\n                                                                                 Page\u00a01\u00a0of\u00a04<br \/>\n Query\u00a0at\u00a0Sl.No.1:\u00a0 &#8220;Ref.\u00a0our\u00a0following \u00a0Applications \u00a0for\u00a0fixation\u00a0of\u00a0Brand \u00a0<br \/>\nrate\u00a0of\u00a0Duty\u00a0Drawback<\/p>\n<p>       a)      cpc\/kab\/2008\u00ad09\/114 \u00a0 dtd. \u00a0 17th\u00a0 dec.2008 \u00a0 received \u00a0 by \u00a0 your \u00a0<br \/>\n               dept.\u00a019.12.08.\n<\/p>\n<p>       b)      cpc\/kab\/2009\u00ad10\/ \u00a0dt.13.4.09 \u00a0received \u00a0 by \u00a0your \u00a0dept. \u00a0 on \u00a017th\u00a0<br \/>\n               April\u00a009<\/p>\n<p>       What \u00a0 are \u00a0 the \u00a0 procedures \u00a0 for \u00a0 moving \u00a0 Application \u00a0 file \u00a0 within \u00a0 the \u00a0<br \/>\n       C.Excise\u00a0Dept\u00a0\/\u00a0Authorities?\u00a0and<\/p>\n<p>       Time \u00a0taken \u00a0by \u00a0each \u00a0 Authorities \u00a0\/\u00a0officers \u00a0concerned \u00a0with \u00a0Name, \u00a0<br \/>\n       Qualification,\u00a0and\u00a0Salary\u00a0with\u00a0Allowances\u00a0for\u00a0last\u00a010\u00a0years.&#8221;\n<\/p>\n<p>6.     As\u00a0regards\u00a0the\u00a0first\u00adpart\u00a0(i.e.\u00a0procedures),\u00a0it\u00a0is\u00a0seen\u00a0that\u00a0CPIO\u00a0had\u00a0<br \/>\nprovided\u00a0to\u00a0the\u00a0appellant\u00a0the\u00a0procedure\u00a0for\u00a0dealing\u00a0with\u00a0applications\u00a0for\u00a0<br \/>\nfixation \u00a0 of \u00a0 brand \u00a0 rate \u00a0 of \u00a0 duty \u00a0 drawbacks \u00a0 in \u00a0 general \u00a0 and \u00a0 to \u00a0 specific\u00a0<br \/>\npetitions\u00a0in\u00a0particular.\n<\/p>\n<p>7.   The\u00a0reply\u00a0given\u00a0by\u00a0the\u00a0CPIO\u00a0fully\u00a0meets\u00a0the\u00a0query\u00a0appellant\u00a0has\u00a0<br \/>\nmade.\u00a0\u00a0There\u00a0shall\u00a0be\u00a0no\u00a0further\u00a0disclosure\u00a0in\u00a0regard\u00a0to\u00a0this\u00a0query.\n<\/p>\n<p>8.    As\u00a0regards\u00a0the\u00a0second\u00adpart\u00a0of\u00a0this\u00a0query\u00a0(i.e.\u00a0time\u00adtaken\u00a0by\u00a0each\u00a0<br \/>\nAuthority),\u00a0it\u00a0is\u00a0best\u00a0answered\u00a0by\u00a0allowing\u00a0the\u00a0appellant\u00a0to\u00a0inspect\u00a0the\u00a0files\u00a0<br \/>\nin\u00a0which\u00a0the\u00a0officers\u00a0handled\u00a0the\u00a0two\u00a0cases\u00a0mentioned\u00a0by\u00a0him\u00a0in\u00a0this\u00a0item\u00a0<br \/>\nof\u00a0query.\n<\/p>\n<p>9. The\u00a0main\u00a0point\u00a0in\u00a0this\u00a0query\u00a0is\u00a0the\u00a0chronology\u00a0in\u00a0which\u00a0the\u00a0variety\u00a0<br \/>\nof\u00a0requests\u00a0appellant\u00a0has\u00a0mentioned\u00a0were\u00a0handled\u00a0by\u00a0the\u00a0public\u00a0authority.\u00a0<br \/>\nAppellant&#8217;s \u00a0point \u00a0is\u00a0that \u00a0the\u00a0officers \u00a0of\u00a0the\u00a0public \u00a0authority \u00a0decided \u00a0the\u00a0<br \/>\napplications \u00a0 at \u00a0their \u00a0 whims \u00a0and \u00a0 fancies \u00a0and \u00a0 not \u00a0 strictly \u00a0 in \u00a0 the \u00a0 order \u00a0 in\u00a0<br \/>\nwhich\u00a0they\u00a0were\u00a0received.\n<\/p>\n<p>11. It\u00a0is\u00a0directed\u00a0that\u00a0the\u00a0chronology\u00a0of\u00a0the\u00a0receipt\u00a0of\u00a0the\u00a0applications\u00a0<br \/>\nmentioned\u00a0by\u00a0the\u00a0appellant,\u00a0the\u00a0dates\u00a0on\u00a0which\u00a0these\u00a0were\u00a0taken\u00adup\u00a0for\u00a0<br \/>\nprocessing\u00a0and\u00a0the\u00a0dates\u00a0of\u00a0final\u00a0orders\u00a0shall\u00a0be\u00a0provided\u00a0to\u00a0him\u00a0within\u00a0<br \/>\ntwo\u00a0weeks\u00a0of\u00a0the\u00a0receipt\u00a0of\u00a0this\u00a0order.\n<\/p>\n<p>Item \u00a0 at \u00a0 Sl.No.4:\u00a0 &#8220;If \u00a0 any \u00a0 late \u00a0 Drawback \u00a0 letter \u00a0 issued \u00a0 by \u00a0 the \u00a0 C.Ex. \u00a0<br \/>\nAuthorities,\u00a0(a)\u00a0reason\u00a0of\u00a0it\u00a0(b)\u00a0interest\u00a0paid\u00a0by\u00a0the\u00a0Govt.,\u00a0Will\u00a0it\u00a0be\u00a0to\u00a0the \u00a0<br \/>\nAccount\u00a0of\u00a0the\u00a0Officers\u00a0concerned\u00a0for\u00a0late\u00a0Application\u00a0process?\u00a0\u00a0OR\u00a0the \u00a0<br \/>\nsame\u00a0is\u00a0in\u00a0to\u00a0at\u00a0Govt.\u00a0Account?&#8221;\n<\/p>\n<p>12.
