\nhave gone through the reoord-so_f_  lo’vf_erV.C\u00bbot1rt.<\/p>\n
2. MFA, N91396:;\/2\u00a7oQ.\u00a7   the NWKRTC<\/p>\n
seekingvdvreduotifon :\u00a2o::lp;%_nsat:.oi\u00a5L awarded by the Tribunal
\non the ground _j:inj:u’red-respondent\/claimant also<\/p>\n
contributed  the n.eglig;en’oe with regard to the accident that<\/p>\n
“V”\u00ab–.oCcu.rreC;–.e,Aa11d a1s”o””o”n’V the ground that the quantum of<\/p>\n
  awarded by the Tribunal is on the higher side.<\/p>\n

3. The occurrence of accident on 1.05.92 on NH~4<\/p>\n
involving the KSRTC bus and the injured who __._was<\/p>\n
proceeding on his Hero Honda bike is not in
\nquestion is whether the injured also  ~
\nnegligence for the occurrence of the _ac.ci_der1t_\u00a7 ‘V’O’r1′::4Q:sf{1:Sa1VV05:
\nthe records it is seen that one MalliliarjuiiTwasthe”di*i;.\u00a7’e–r’.o\u00bbf_:<\/p>\n
the KSRTC bus who died subs’e.guerit:v.to ihef;i\u00a2.:\u00a2;d_eVm.\u00a5 on <\/p>\n
8.12.1992. Therefore, he was n_ot*.e_xan1ir1ed.~–iiowever, the
\nfact remains the bus  _Ap’.roc;eeVdi1ag\u00bb trotn Bangalore to
\nHaveri and definitely the~.ce’nd’u.c’:orl be one of the<\/p>\n
inmates of the;-.,bL1sC’ ,1i1\u00e9.a;ci&1e1_1\u20ac-.:o\u00a2’c%lri–ed in the rnid~night<\/p>\n
at  \u00a2’l.”lE::1′.l’g(“L’  is filed by the police
\nagainst bus. If the driver of the<\/p>\n
KSR’lfCV bus 4lagai11s\u00a7.,wij.9rq.– eharge sheet is filed could not be<\/p>\n
‘xV”‘v.eXal::ni’r1edi as he xdie’d”or1 8.12.1992, the Corporation could<\/p>\n
 _h’av_e” ‘exvarriined the conductor who was in the bus at the time<\/p>\n

\ninjures  grazed abrasion and other<\/p>\n
abrasiovns. Imri’1ediat:eiy: after the accident, he took treatment<\/p>\n

 was in~patient for 1 day. From there he<\/p>\n
Was””‘–shift.edv to St. John’s hospital and Victoria Hospital at<\/p>\n
th  ._mE3a,n”gaio1*e. He also took treatment at JEPMER (Jawaharlai<\/p>\n
“ins’titute of Post Graduate Medical Education Research)<\/p>\n
Hospital at Pondicherry. The evidence of the doctors and the<\/p>\n
medical records would indicate the fractures had<\/p>\n
reduced by open surgery and on account of the,?fracti_ire__”.of__ _<\/p>\n
the right femur, he developed osteornyelites”ariEj~..irifec’t.iorrif <\/p>\n
with which he has to Suffer throughout   if<\/p>\n
his evidence has indicated how thisA.v_ost.eomy’ei;ite’s coguid <\/p>\n
cause persistent inconvenience arid:9iiardshipjtotithe}patient.
\nWith ah the treatment;’:\u00ab– the  suffered
\ndisabilities iike shortenpingipoefihthe:  persistent
\ninfection  o:steCinive1.ite:s”:–xan.d.T:fa1so difficulty in<\/p>\n
chewing while  r  <\/p>\n
 The  ‘taking into account aii these
\nfacts awarded  towards injury, pain and<\/p>\n
suffeijingiiapart other amounts under un~\u00bb1iquidated and<\/p>\n
 damages. The main grievance of the injured<\/p>\n
fappfeiiantidseernfsvto be not awarding any amount towards loss<\/p>\n
of future”i1ic:onie. On perusal of the records, we note that<\/p>\n
Tthesppetitioner was on leave for almost 579 days. This is<\/p>\n
  spoken. to by accounts officer from HMT who is examined as<\/p>\n
P.W.2 where the appellant was working. Though there is<\/p>\n
evidence to show that he was on leave for 579 days
\npay, there is nothing on record to show that_.\u00a7lthereQ-  _
\nmedical advice for applying leave for  long l'()l:n’-they: it <\/p>\n
other hand, there is also evidencelaon recordersto..lshov=i”V-tthatl.l<\/p>\n
during his treatment period, hisytrife loominitte\ufb02y
\nto depression” as he met  apccide-nit: serious
\ninjuries. Apparently, heavasVtliepilaeensedvvinulthe said
\ncase. The fact rernains  medically to
\ntake this long   leave ‘ilealye was utilised for
\nsome other  remains he was out
\nof    also note that except
\nRs.1O,O(llO\/Vl~= loss of amenities, no other<\/p>\n
amount is a:Warded”V’ine’luld’ing permanent disability. Having<\/p>\n
  the faet””‘ti1.at loss of pay being assessed at<\/p>\n
 any proper evidence, we are of the<\/p>\n
opinion thefsaid amount could be considered as amount<\/p>\n
lx__towaro~s permanent disability and loss of amenities of life.<\/p>\n
‘~:”So far as other heads of compensation, having regard to the<\/p>\n
fact that the accident being of the year 1992, we are qf the<\/p>\n
opinion the quantum of compensation awarded_.vby-\u00ab._ethe<\/p>\n
Tribunai is just and proper. Therefore, we are 0f-\u00a7i.he4i7p1i1–1i:ef;.._ ‘ .<\/p>\n
there is no need to interfere with thegwpard of ‘the–  ‘<\/p>\n
Accordingly, both the appeals <\/p>\n
