THE BIHAR REGLIGIOUS TRUST BOARD THROUGH ITS\n          CHAIRMAN, BIHAR, PATNA\n                                -----------\n<\/pre>\n<p>06.   29.11.2010              Heard learned counsel for the petitioner, for<\/p>\n<p>                   the State and for the respondent nos. 5 and 6.<\/p>\n<p>                              The petitioner is aggrieved by the order<\/p>\n<p>                   dated 16.2.1010 passed by the District Sub-Registrar,<\/p>\n<p>                   refusing to register the Title Deed for the lands<\/p>\n<p>                   purchased by him from respondent no.5.<\/p>\n<p>                              Learned counsel for the petitioner submits<\/p>\n<p>                   that he is a bona fide purchase for value of the land in<\/p>\n<p>                   question   from   respondent    no.5.   The   registration<\/p>\n<p>                   authorities have no jurisdiction to go into the question<\/p>\n<p>                   of title and can only interfere with registration, subject<\/p>\n<p>                   to the conditions laid down in the Registration Act. He<\/p>\n<p>                   strongly relied upon a Division Bench order of this<\/p>\n<p>                   Court reported in A.I.R. 1989 page 144 (Bihar Deed<\/p>\n<p>                   Writers Association and Others. Versus State of Bihar<\/p>\n<p>                   and Others) holding at paragraphs 3 and 5 as follows:-<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>                      &#8220;3. It appears to us that this<br \/>\n          application can be disposed of at the<br \/>\n          stage of admission inasmuch as the<br \/>\n          point in issue is limited. In our view, if a<br \/>\n          document otherwise complying with the<br \/>\n          statutory requirements and formalities<br \/>\n          is presented for registration, the<br \/>\n          registering authority is bound to register<br \/>\n          it. It is not for the registering authority<br \/>\n          to enquire and ascertain the title to its<br \/>\n          own satisfaction. Under the provisions of<br \/>\n          the T.P. Act, 1888, if the transferor does<br \/>\n          not have any title or has an imperfect<br \/>\n          title to the property, the transferee on<br \/>\n          transfer will either get no title or he will<br \/>\n          get an imperfect title. This will be to the<br \/>\n          prejudice of the transferee and is not of<br \/>\n          any      concern    to    the     registering<br \/>\n          authority.&#8221;\n<\/p>\n<p>                      &#8220;5. Learned Advocate for the<br \/>\n          respondents also referred to S. 68 of the<br \/>\n          Registration Act, which empowers the<br \/>\n          Registrar to superintend and control<br \/>\n          Sub-Registrars. This power, in our view,<br \/>\n          is an administrative power conferred on<br \/>\n          the        Registrar        to       exercise<br \/>\n          superintendence and control over the<br \/>\n          Sub-Registrars. The Registrar, in our<br \/>\n          view, cannot in exercise of the power<br \/>\n          under the section, direct the Sub-<br \/>\n          Registrars not to register a document<br \/>\n          presented      for   registration    if   the<br \/>\n          document complies with the statutory<br \/>\n          requirements and formalities.&#8221;\n<\/p>\n<p>          Learned     counsel    for   respondent     no.6<\/p>\n<p>submits that there is a serious controversy with regard<\/p>\n<p>to ownership of the lands claimed by the Mahant vis-\u00e0-<\/p>\n<p>vis Bihar State Board of Religious Trust.<\/p>\n<p>          An order passed by a statutory authority not<\/p>\n<p>by application of his own mind but on direction and<\/p>\n<p>dictates of another apparent on basis of recitals<\/p>\n<p>contained in the order is per se illegal as it amounts to<\/p>\n<p>abdication of statutory powers. Presently, the Court<\/p>\n<p>does not consider it necessary to go into the issues<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>       sought to be urged from the Division Bench judgment.<\/p>\n<p>                 The objection on behalf of respondent no.6<\/p>\n<p>       to the remedy of an appeal is best answered on the<\/p>\n<p>       ground that, if the order is without jurisdiction, or<\/p>\n<p>       suffers   from    patent    arbitrariness,   existence    of<\/p>\n<p>       alternative remedy is no bar to the exercise of<\/p>\n<p>       discretion by the Writ Court.\n<\/p>\n<p>                 In     A.I.R.    1952   Supreme      Court     16<\/p>\n<p>       (Commissioner of Police, Bombay Versus Gordhandas<\/p>\n<p>       Bhanji) the Court has held at paragraph 10 as follows:-<\/p>\n<blockquote><p>                            &#8220;17. It is clear to us from a<br \/>\n                 perusal of these rules that the only<br \/>\n                 person vested with authority to grant or<br \/>\n                 refuse a license for the erection of a<br \/>\n                 building to be used for purposes of<br \/>\n                 public amusement is the Commissioner<br \/>\n                 of Police. It is also clear that under R.<br \/>\n                 250 he has been vested with the<br \/>\n                 absolute discretion at any time to cancel<br \/>\n                 or suspend any license which has been<br \/>\n                 granted under the rules. But the power<br \/>\n                 to do so is vested in him and not in the<br \/>\n                 State Government and can only be<br \/>\n                 exercised by him at his discretion. No<br \/>\n                 other person or authority can do it.&#8221;<\/p><\/blockquote>\n<p>                 The order dated 16.2.2010 by the statutory<\/p>\n<p>       authority in no uncertain terms states that registration<\/p>\n<p>       was refused on basis of instructions issued to it.<\/p>\n<p>                 The order dated 16.2.2010 is set aside. The<\/p>\n<p>       application stands allowed.\n<\/p>\n<\/p>\n<pre>P.K.
