While passing the order of<br \/>\ndetention the detaining authority has considered the fact of<br \/>\nregistration of three cases   CR no.5207\/2007 dt.05.09.2007, CR<br \/>\nno.5051\/2008 dt.26.02.2008 and CR no.5052\/2008 dt.27.02.2008, first<br \/>\nto be punishable under Sections 661B,  65AE, 116B and 81 and other<br \/>\ntwo for the offence punishable under Secs.66 1B, 65AE of the Bombay<br \/>\nProhibition Act and the statement of the accused in the prohibition<br \/>\ncases. The petitioner-detenu was found in possession of total 183<br \/>\nlitres of foreign liquor.\n<\/p>\n<p>4.<br \/>\nThe learned Advocate for the petitioner-detenu has assailed the order<br \/>\nunder challenge on various grounds as mentioned in the memo of<br \/>\npetition. However,this petition is capable of being disposed of on<br \/>\nthe sole ground as to whether there was cogent and credible material<br \/>\nplaced before the detaining authority to come to the conclusion that<br \/>\nby the activities of the petitioner, the public order was disturbed.\n<\/p>\n<p>5.<br \/>\nTo reach to the subjective satisfaction that the bottlegging<br \/>\nactivities of the petitioner were prejudicial to the maintenance of<br \/>\npublic order, the detaining authority must rely upon credible and<br \/>\ncogent material indicating that the activities of the detenu directly<br \/>\nor indirectly were causing or were likely to cause harm, danger or<br \/>\nalarm or feeling of insecurity among the general public or any<br \/>\nsection thereof or a grave or widespread danger to life, property<br \/>\netc. While undertaking this exercise, the detaining authority has to<br \/>\ndraw a clear line between the cases falling within the category of<br \/>\nbreach of law and order and the cases falling within the category of<br \/>\nbreach of public order.\n<\/p>\n<p>6.<br \/>\nIn the present case, the three pending criminal cases registered<br \/>\nagainst the petitioner under the Prohibition Act and the activities<br \/>\nof the petitioner of engaging himself in the illegal sale and<br \/>\ndistribution of country liquor can at the most be said to be<br \/>\ninvolving law and order problem  for which the petitioner can be<br \/>\nadequately punished. It is therefore difficult for this Court to<br \/>\naccept that the petitioner has been rightly detained as the<br \/>\nactivities of the petitioner can at the most be termed as affecting<br \/>\nlaw and order. In short, no further discussion on the other points<br \/>\nraised in this petition is required as in the opinion of this Court,<br \/>\nthe order of detention is not sustainable in the eye of law. In this<br \/>\ncontext reference may be had to the decision rendered in the case of<br \/>\nHarpreet Kaur vs. State of Maharashtra, reported in<br \/>\n1992 SC 797, wherein it has been held that involvement of the<br \/>\naccused in fourteen offences including lifting of gas cylinders<br \/>\ncannot be said to be prejudicial to the maintenance of public<br \/>\ntranquility and the authority was not justified in arriving at the<br \/>\nsubjective satisfaction that the activities of the petitioner were<br \/>\nlikely to affect the maintenance of public tranquility..\n<\/p>\n<p>7.<br \/>\nIn the result, the petition is allowed. The impugned order of<br \/>\ndetention dated 14.03.2008 passed by the Police Commissioner,<br \/>\nAhmedabad City, is hereby quashed and set aside and detenue is hereby<br \/>\nordered to be set at liberty forthwith, if not required to be<br \/>\ndetained in any other case. Rule is made absolute.
