DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/11\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tRule.\n<\/p>\n<p>Learned APP, waives service of notice of Rule for respondent &#8211;<br \/>\nState.\n<\/p>\n<p>2.\t\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I 34 of 2010 with Maliya-Hatina Police Station,  for the<br \/>\noffences punishable under Sections 394, 504, 506(2), 114 of   the<br \/>\nIndian Penal Code and section 135 of the Bombay Police Act.\n<\/p>\n<p>\t\tHeard learned<br \/>\nAPP Mr.  for the respondent &#8211; State.\n<\/p>\n<p>3.\t\tHaving heard<br \/>\nlearned counsel for the parties and perusing the record of the case<br \/>\nand taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the accused and punishment prescribed<br \/>\nfor the alleged offences and the bare averments made in the<br \/>\ncomplaint,  I am inclined to enlarge the applicant on bail.\n<\/p>\n<p>\t\tLearned counsel<br \/>\nfor the parties do not press for further reasoned order.\n<\/p>\n<p>3.\t\tIn the facts<br \/>\nand circumstances of the case, the application is allowed and the<br \/>\napplicant is ordered to be released on bail in connection with first<br \/>\ninformation report registered being C.R. No.I 34 of 2010 with<br \/>\nMaliya-Hatina  Police Station on executing a bond of Rs.5,000\/-<br \/>\n(Rupees Five thousand only) with one surety of the like amount to the<br \/>\nsatisfaction of the trial Court and subject to the conditions that he<br \/>\nshall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\tpassport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\tpresence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\t\tThe<br \/>\nAuthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\t\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\t\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>\t\tRule<br \/>\nis made absolute to the aforesaid extent.
