Shah, J.).<br \/>\nPara 2 reads as under:\n<\/p>\n<p>&#8220;2.\tShri<br \/>\nMankad, learned advocate appearing on behalf of the respondents<br \/>\nherein-heirs of the original workman have stated at the bar that if<br \/>\nthe petitioners are directed to pay the retirement benefits, which<br \/>\nare available to the original workman, treating him as daily wager,<br \/>\nthe respondents will be satisfied and they have no objection if the<br \/>\nimpugned judgement and award declared by the Industrial tribunal is<br \/>\nset aside.&#8221;\n<\/p>\n<p>2.\tIt<br \/>\nis the case of the learned advocate for the petitioner that what was<br \/>\nwaived by the petitioner there, were the benefits flowing from<br \/>\nthe judgement and award of the Industrial Tribunal and therefore, the<br \/>\npetitioner is entitled to claim retiral benefits even if the<br \/>\ndeceased-workman was treated as a daily wager. Making it more clear<br \/>\nlearned advocate Mr.Mankad submitted that even if he is treated to be<br \/>\na daily wager since the date he joined services of the District<br \/>\nPanchayat, Amreli by virtue of Government Resolution dated 17th<br \/>\nOctober 1988, and another Government Resolution dated 5th<br \/>\nJune 1989, the family will be entitled to receive pension also.\n<\/p>\n<p>3.\tAs against<br \/>\nthis, the case of the learned advocate for the<br \/>\nrespondent-establishment is that the petitioner having waived his<br \/>\nright flowing from the judgement and award, cannot claim any other<br \/>\nbenefits than what is already paid.\n<\/p>\n<p>4.\tTaking into<br \/>\nconsideration the aforesaid controversy between the learned advocates<br \/>\nit is deemed proper that the Registry be directed to place the matter<br \/>\nbefore the Hon&#8217;ble the Acting Chief Justice to pass necessary orders<br \/>\nto enable the parties to address the learned Judge for interpretation<br \/>\nof the aforesaid para 2.\n<\/p>\n<p>(RAVI<br \/>\nR.
