Heard Shri Prakash Kumar, learned counsel<\/p>\n<p>                 for   the    appellant   on    Interlocutory      Application<\/p>\n<p>                 i.e. I.A. No.6491 of 2011, which has been filed<\/p>\n<p>                 with a prayer for enlargement of time for filing<\/p>\n<p>                 certified copy of the impugned order.<\/p>\n<p>                             The present appeal was preferred against<\/p>\n<p>                 the order dated 7.1.2010 passed by the Deputy<\/p>\n<p>                 Labour      Commissioner-cum-Commissioner             under     the<\/p>\n<p>                 Workmen&#8217;s     Compensation      Act   in    C.W.C.      No.23   of<\/p>\n<p>                 2006. By the said order, the learned court below<\/p>\n<p>                 had directed the appellant to pay compensation<\/p>\n<p>                 amount to the applicant-claimant i.e. respondent<\/p>\n<p>                 no.1,    whose   husband      died    in   a    motor    vehicle<\/p>\n<p>                 accident. It was claimed that the husband of the<\/p>\n<p>                 respondent     no.1   was     employed     on   the    offending<\/p>\n<p>                 Dumper bearing Registration No.JH-05J-9019.<\/p>\n<p>                             The appeal was filed on 12.5.2010 without<\/p>\n<p>                 certified copy of the impugned order. The Stamp<\/p>\n<p>                 Reporter pointed out the defect and thereafter on<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>        23.8.2010, on the prayer made by learned counsel<\/p>\n<p>        for the appellant, four weeks&#8217; time was granted<\/p>\n<p>        by the Lawazima Board for filing certified copy<\/p>\n<p>        of     the    impugned       order.     Since   order    was   not<\/p>\n<p>        complied       with     by    order     dated   6.1.2011,      the<\/p>\n<p>        Lawazima       Board    placed     the    matter    before     the<\/p>\n<p>        Bench. On 12.9.2011, one week time was granted by<\/p>\n<p>        this    Court    for     filing   impugned      order,    failing<\/p>\n<p>        which it was directed that appeal shall stand<\/p>\n<p>        rejected without further reference to a Bench.<\/p>\n<p>        Even till date, certified copy of the impugned<\/p>\n<p>        order has not been filed and a petition has been<\/p>\n<p>        filed i.e. I.A. No.6491 of 2011 for enlargement<\/p>\n<p>        of the time for filing certified copy.<\/p>\n<p>                     The court is of the opinion that in the<\/p>\n<p>        matter relating to compensation due to death in<\/p>\n<p>        an accident, such indulgence may not be granted.<\/p>\n<pre>                     Accordingly,         the       petition       stands\n\n        dismissed.\n\n\nN.H.\/                          ( Rakesh Kumar,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders National Insurance Co.
