MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\nwrit petition was preferred by the petitioner against the action<br \/>\ntaken by the respondent &#8211; bank under Section 14 of the Securitization<br \/>\nand Reconstruction of Financial Assets and Enforcement of Security<br \/>\nInterest Act, 2002 [hereinafter referred to as &#8220;the<br \/>\nSecuritization Act&#8221; or &#8220;the Act&#8221;] qua the property of<br \/>\nthe first petitioner situated at C\/12, Shrijidham Society, Part-II in<br \/>\nthe lane of Kishan Samosa, College Road, Nadiad.\n<\/p>\n<p>2.\tWhen<br \/>\nit was brought to the notice of the counsel that there is a remedy of<br \/>\nappeal under Section 17 of the Securitization Act, it is contended<br \/>\nthat the Debts Recovery Tribunal is generally not entertaining any<br \/>\napplication against the steps taken under Section 14 of the Act on<br \/>\nthe ground that the possession has not been taken and thereby the<br \/>\nmeasures under Section 13(4) of the Act have not been taken.\n<\/p>\n<p>\tIt<br \/>\nis contended that in the present case, the respondent &#8211; bank<br \/>\nhighlighted Section 13(3A) of the Act.  Inpsite of the reply given by<br \/>\nthe petitioner to the notice issued under Section 13(2), the bank<br \/>\nwithout giving any reason for rejecting the prayer, has taken steps<br \/>\nto take possession under Section 14 of the Act.\n<\/p>\n<p>3.\tThe<br \/>\nlearned counsel appearing on behalf of the bank while accepts that<br \/>\nsteps have been taken under Section 14, requested to vacate the<br \/>\ninterim order passed by this Court on the ground that the installment<br \/>\nas ordered to be paid by this Court is less than the installment<br \/>\nwhich the petitioner is liable to pay as per the agreement.  It is<br \/>\nfurther contended that the petitioner never filed any representation<br \/>\nwithin a period of 60 days as stipulated under Section 13(2) of the<br \/>\nAct and only when the measures were taken under Section 14, such<br \/>\nrepresentation has been filed.\n<\/p>\n<p>4.\tWe<br \/>\nhave heard the learned counsel for the parties and perused the<br \/>\nrecord.\n<\/p>\n<p>5.\tSection<br \/>\n13(4) enables the secured creditor to take recourse to one or more<br \/>\nmeasures mentioned therein. If the borrower fails to discharge its<br \/>\nliability, under Section 13(4)(a) possession of the secured assets of<br \/>\nthe borrower including the right to transfer by way of lease,<br \/>\nassignment or sale for realizing the secure asset can be taken by the<br \/>\nsecured creditor.  For the purpose of taking over management of the<br \/>\nbusiness of the borrower including the right to transfer by way of<br \/>\nlease, assignment or sale for realizing the secure asset, possession<br \/>\ncan be taken under Clause (b) of sub-section (4) of Section 13 of the<br \/>\nSecuritization Act.  While Rule 4 of the Security Interest<br \/>\n(Enforcement) Rules, 2002 provides for taking possession of the<br \/>\nmovable property, similar provision has been made to take possession<br \/>\nof the immovable property for the purpose of sale under Rule 8 of the<br \/>\n2002 Rules.  In case the borrower fails to give possession, it is<br \/>\nopen to the secured creditor to take possession of the secured asset<br \/>\nwith the assistance of the Chief Metropolitan Magistrate or the<br \/>\nDistrict Magistrate under Section 14 of the Act.\n<\/p>\n<p>6.\tFrom<br \/>\nthe aforesaid provisions, it will be evident that the assistance if<br \/>\ntaken under Section 14 of the Act for possession of the secured<br \/>\nassets, the same amounts to taking measures under Section 13(4) of<br \/>\nthe Act.  In such case, even at the stage of taking possession under<br \/>\nSection 14, an appeal under Section 17 is maintainable.\n<\/p>\n<p>7.\tIn<br \/>\nthe present case, as we find that the respondent &#8211; bank has taken<br \/>\nmeasures under Section 14 of the Act. thereby the measures taken<br \/>\nunder Section 13(4) of the Act, we are of the opinion that the<br \/>\npetitioner in such case should take the recourse of appeal under<br \/>\nSection 17 of the Act.  If any such appeal is preferred by the<br \/>\npetitioner within three weeks, the Debts Recovery Tribunal, taking<br \/>\ninto consideration the fact that the petitioner was pursuing the<br \/>\nmatter before this Court, will entertain the appeal and decide all<br \/>\nthe questions as raised in this case on merits after notice to the<br \/>\nrespondent &#8211; bank.  It will be open to the petitioner to ask for<br \/>\ninterim relief in view of the fact that the interim relief was<br \/>\ngranted by this Court and the Tribunal will pass appropriate orders<br \/>\non the same in accordance with law.  As we have not decided the case<br \/>\non merits, but remitted the matter for determination of the issue by<br \/>\nthe Debts Recovery Tribunal, and that this Court had granted interim<br \/>\norder in favour of the petitioner, it is desirable that the bank<br \/>\nshould not take any coercive steps against the petitioner, till the<br \/>\nappeal alongwith the petition for interim relief is filed and some<br \/>\norder is passed by the Tribunal on the same.  However, if the appeal<br \/>\nor the petition for interim relief is not filed within the period<br \/>\naforesaid, it will be open to the bank to proceed in accordance with<br \/>\nlaw.\n<\/p>\n<p>8.\tBoth<br \/>\nthe writ petition and the Civil Application stand disposed of with<br \/>\nthe aforesaid observations and directions.
