Justice V.GIRI\n\n Dated :16\/07\/2008\n\n O R D E R\n                          V.GIRI,J.\n                     -------------------------\n                 W.P ( C) No.17248 of 2007\n                     --------------------------\n               Dated this the 16th July, 2008\n\n                       J U D G M E N T\n<\/pre>\n<p>     Petitioner is working as Panchavadyam Performer in<\/p>\n<p>the   Punnapuram     Krishnan      Kovil     at Trivandrum.<\/p>\n<p>According to him, he was injured in an accident that took<\/p>\n<p>place on 19.12.1999, when he was actually on duty in the<\/p>\n<p>temple premises.    He was admitted to the Government<\/p>\n<p>Medical College Hospital in Trivandrum and according to<\/p>\n<p>him, he was subjected to chest pain. He finds it difficult<\/p>\n<p>to play the Panchavadyam instrument.           He therefore<\/p>\n<p>sought for a category change by way of appointment as<\/p>\n<p>Peon. The stand taken by the Devaswom Board is that<\/p>\n<p>there is no vacancy in the post of Peon. Devaswom Rules<\/p>\n<p>do not permit the petitioner `s claim to be considered.<\/p>\n<p>     2.     In my view, if there is a genuine disability<\/p>\n<p>incurred by a person in discharging the duties assigned to<\/p>\n<p>him or which is assigned to the post as such, the Board<\/p>\n<p>shall look into the question as to whether he can be<\/p>\n<p>W.P ( C) No.17248 of 2008<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>fruitfully employed in another post of equated category,<\/p>\n<p>especially where there is no additional          financial<\/p>\n<p>commitment incurred by the Board. Petitioner is due to<\/p>\n<p>retire in November, 2008.\n<\/p>\n<p>      3.
