Govt. Pleader for the<\/p>\n<p>    respondent no.3, waive service.\n<\/p>\n<p>            Heard by consent.\n<\/p>\n<p>    2.    The petitioner has challenged the order of the School<\/p>\n<p>    Tribunal    dated   17.7.2008        dismissing     the      petitioner&#8217;s<\/p>\n<p>    appeal.     The petitioner&#8217;s appointment as a Teacher on open<\/p>\n<p>    category    has   been   held    to    be   beyond     the      prescribed<\/p>\n<p>    percentage for reserved category candidates.\n<\/p>\n<p><span class=\"hidden_text\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 14:17:11 :::<\/span><\/p>\n<p>                              -:    2    :-\n<\/p>\n<p>    3.     There are three units of deaf and dumb students which<\/p>\n<p>    are sanctioned in the school.              The petitioner was employed<\/p>\n<p>    in    one of the units.        Her services were terminated.                       The<\/p>\n<p>    petitioner       challenged        the     termination.             The       School<\/p>\n<p>    Tribunal    held that each of the aforesaid units will                            have<\/p>\n<p>    to    be taken separately for applying prescribed percentage<\/p>\n<p>    of    reservation.      When it is so applied, the                  petitioner&#8217;s<\/p>\n<p>    appointment      cannot be sustained because there are already<\/p>\n<p>    two open category teachers in the unit and, therefore, the<\/p>\n<p>    third    teacher    will      have    to     be   a      reserved          category<\/p>\n<p>    candidate    which the petitioner is not.                  Taking this view,<\/p>\n<p>    the    School    Tribunal<br \/>\n                             ig    has       held   that       the      petitioner&#8217;s<\/p>\n<p>    appointment is illegal and non est in the eyes of law.\n<\/p>\n<p>    4.    Having heard the parties, it appears that the order of<\/p>\n<p>    the    School Tribunal suffers from an error of law apparent<\/p>\n<p>    from    the face of the record, in that rule 9 has not                            been<\/p>\n<p>    correctly    applied.      Rule 9(7), as it read at the relevant<\/p>\n<p>    time, is as follows:-\n<\/p>\n<blockquote><p>              &#8220;(7)    The    Management shall reserve 34                   per<\/p>\n<p>              cent    of    the total number of posts of                   the<\/p>\n<p>              teaching      as well as non-teaching staff for<\/p>\n<p>              the     members      of     the    Scheduled          Castes,<\/p>\n<p>              Scheduled      Castes      converts      to       Buddhism,<\/p>\n<p><span class=\"hidden_text\">                                                          ::: Downloaded on &#8211; 09\/06\/2013 14:17:11 :::<\/span>\n<\/p><\/blockquote>\n<blockquote><p>                              -:    3   :-\n<\/p><\/blockquote>\n<blockquote><p>                Scheduled       Tribes,     Denotified       Tribes,<\/p>\n<p>                Nomadic    Tribes and other Backward         Classes<\/p>\n<p>                as follows, namely:<\/p><\/blockquote>\n<pre>\n\n\n\n\n                                                                            \n                  (a)    Scheduled Castes and Scheduled\n\n\n\n\n                                                   \n                         Castes converts to Buddhism.                 13%\n\n\n\n                  (b)    Scheduled Tribes including those\n\n\n\n\n                                                  \n                         living outside the specified                   7%\n\n                         areas.\n\n\n\n\n                                           \n                  (c)    Denotified Tribes and Nomadic\n                            \n                         Tribes.                                        4%\n                           \n                  (d)    Other Backward Classes.                    10%\"\n\n\n\n    The    mandate of the Rule is that 34 per cent of the total\n      \n\n\n    number      of posts of the teaching as well as            non-teaching\n   \n\n\n\n<\/pre>\n<blockquote><p>    staff in the school should be reserved for the categories<\/p>\n<p>    mentioned      therein.      It does not warrant the breaking               up<\/p>\n<p>    of    any    category    of teachers into     specific        units        and<\/p>\n<p>    applying the prescribed percentage of reservation to such<\/p>\n<p>    a    unit.    The mandate of the Rule is that the             prescribed<\/p>\n<p>    percentage      shall    be applied to the entire teaching                 and<\/p>\n<p>    non-teaching        staff    in the school.   Had this        rule       been<\/p>\n<p>    properly applied, it would not have been possible for the<\/p>\n<p><span class=\"hidden_text\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 14:17:11 :::<\/span>\n<\/p><\/blockquote>\n<blockquote><p>                              -:   4    :-\n<\/p><\/blockquote>\n<p>    Tribunal      to hold that the petitioner&#8217;s appointment is in<\/p>\n<p>    contravention       of the prescribed percentage because there<\/p>\n<p>    are    already two teachers belonging to the open                     category<\/p>\n<p>    in the unit where the petitioner is working.\n<\/p>\n<p>    5.     The    learned Asstt.       Govt.Pleader,        however,         argued<\/p>\n<p>    that    the defect arose on account of the practice of                         the<\/p>\n<p>    respondent-management         in    maintaining a separate               roster<\/p>\n<p>    for    the    three   units.       The   learned      counsel         for      the<\/p>\n<p>    management submits that this practice is followed because<\/p>\n<p>    of     a    direction    from      the   Department        of     Education.\n<\/p>\n<p>    Whatever be the reason, in case the respondent-management<\/p>\n<p>    is<\/p>\n<p>          not maintaining a roster, in accordance with law, the<\/p>\n<p>    Department       of Education may call upon it to do so.                     That<\/p>\n<p>    is    no reason for permitting a breach of rule 9(7), as it<\/p>\n<p>    stood      at the relevant time, under which the total number<\/p>\n<p>    of    teaching and non-teaching staff has to be taken as                          a<\/p>\n<p>    whole      for   calculating      the    prescribed        percentage           of<\/p>\n<p>    reservation.\n<\/p>\n<p>    6.    In this view of the matter, the impugned order is set<\/p>\n<p>    aside, since there is no other justification put forth by<\/p>\n<p>    the    respondents      for   termination     of      the      petitioner&#8217;s<\/p>\n<p>    service,      except that her appointment was not as per                       the<\/p>\n<p>    roster      and was in violation of the rule of                reservation.\n<\/p>\n<p>    The respondent no.3 is directed to consider and grant the<\/p>\n<p><span class=\"hidden_text\">                                                       ::: Downloaded on &#8211; 09\/06\/2013 14:17:11 :::<\/span>\n<\/p>\n<p>                          -:   5   :-\n<\/p>\n<p>    petitioner&#8217;s approval, in accordance with law.           Upon such<\/p>\n<p>    grant   of   approval, the petitioner shall be entitled              to<\/p>\n<p>    all benefits therefrom.\n<\/p>\n<p>    7.
