BALAKRISHNAN, J.\n<\/p>\n<p>\tAppellant   Addha, son of Rooplal, was tried by the First Additional Court<br \/>\nof Sessions, Mandla [Madhya Pradesh], along with four others, or the  offence<br \/>\npunishable under Section 302 read with Section 149 IPC.\t  The Sessions Court<br \/>\nheld that there was no unlawful assembly as alleged by the prosecution and   the<br \/>\nappellant was found guilty of the offence punishable under Section 302 for<br \/>\nhaving caused the death of one Sher Singh.   Two other accused, namely,<br \/>\nRooplal\t and  Buddhulal\t  were\tfound\tguilty\t of  the offence punishable under<br \/>\nSection 324 IPC.    The conviction and sentence of the accused\t were<br \/>\nconfirmed   by\t the  High Court.\n<\/p>\n<p>\tThe    incident\t   in question took place on   19.7.1986 at about 9.00 PM.<br \/>\nPW-1 Jugal Kishore, along  with\t  PW-3 Mishridas, was returning\t from  the<br \/>\nnearby\t flourmill and they saw accused\t Buddhulal in a wordy altercation with<br \/>\nPW-4, Pancham.\t  Jugal Kishore\t  intervened   and   tried   to\t dissuade  them<br \/>\nfrom  quarreling.    At that time,    Buddhulals father\t Rooplal came there and<br \/>\ntook his son  to his house.\t But   on   reaching\t   their house,\t  Buddhulal<br \/>\nand  Rooplal started hurling abusive words at PW-1, Jugal Kishore.   On hearing<br \/>\nthis, deceased Sher Singh,   PW-2 Gulab\t  and some  others persons  came to<br \/>\nthe place of occurrence\t and there ensued a quarrel.\t It is alleged that  while<br \/>\nBuddhulal was armed with an axe, Rooplal was armed with a Bichua and Addha<br \/>\nwas having a Lathi.   It  is the prosecutions\tcase that Rooplal   inflicted  an<br \/>\ninjury on PW-1 Jugal Kishore and Buddhulal  dealt a blow on the arm of Gulab.  It<br \/>\nis also\t the prosecutions  case\t that\tAddha dealt 2-3 blows on the head and<br \/>\nchest of the deceased  Sher Singh.\t   Deceased Sher Singh fell on the<br \/>\nground.\t     He\t  was\ttaken\tto   the nearby hospital where he was declared<br \/>\ndead.\n<\/p>\n<p>\tOn the next day by about 9.20 AM, PW-1 Jugal Kishore gave the F.I.<br \/>\nstatement before the  police and PW-6, Sub-Inspector of Nainpur Police Station,<br \/>\ntook over the investigation.   He held inquest on the  body of the  deceased   and<br \/>\nthe   dead body was then sent for post mortem examination.   PW-8 conducted<br \/>\nthe post-mortem\t  and\tit    was revealed that\t  7th and 8th ribs of left side of the<br \/>\nchest of the deceased were fractured.\tPW-8 deposed that the injuries on the<br \/>\nhead and the  ribs were sufficient in the ordinary course of nature to cause death<br \/>\nof the victim.\n<\/p>\n<p>\tWe heard  the  learned counsel on both sides.\tThe counsel for the<br \/>\nappellant  contended that the prosecution case is not true and correct and that<br \/>\nPW-1 Jugal Kishore,    deceased Sher Singh,   PW-2 Gulab and others came<br \/>\nand attacked the accused.   It\t was also contended that the  accused Rooplal<br \/>\nand others had sustained injuries in the course of the incident.   It was argued<br \/>\nthat the prosecution failed to prove that appellant    Addha caused the vital<br \/>\ninjuries to the deceased Sher Singh.\tWe find some force in the above<br \/>\ncontention.\n<\/p>\n<p>\tAccording to PW-1 Jugal Kishore,  when\the was coming along with PW-3<br \/>\nMishridas,  he\t saw   Buddhulal   and PW-4 Pancham quarrelling.   He<br \/>\nintervened in the quarrel and tried to send them away.\t    By the time the first<br \/>\naccused Rooplal\t also reached  there  and took\t Buddhulal  home.     PW-1 also<br \/>\nalleges that he was severely abused by the first accused Rooplal.   The incident<br \/>\nis alleged to have taken place near the house of Rooplal.      Even according to<br \/>\nthe F.I. statement given by PW-1 before the police,    after the first incident of<br \/>\nquarrel between Buddhulal and  Pancham,\t   PW-1 Jugal Kishore and others<br \/>\nproceeded to the house of Rooplal.   When they reached the house of Rooplal,<br \/>\nthe accused persons started attacking  PW-1 Jugal  Kishore  and others.\t  PW-2<br \/>\nGulab has  deposed that his house is located about half a mile from the place of<br \/>\nincident.    It is certain that he along with PW-1 and others must have\t come to<br \/>\nthe house of the accused with an intention to pick up a quarrel with them and<br \/>\nthere\tensued\t the   attack  and   the   counter-attack   and\t  in   that   incident,<br \/>\nPW-1,\tPW-2 and   the deceased Sher Singh sustained injuries.\t It is also<br \/>\npertinent to note that in the F.I. statement,\tPW-1 has not stated that the<br \/>\nappellant caused  any injuries to the deceased Sher Singh on his head.\t In the<br \/>\nF.I. statement, it is only stated that\tappellant Addha had given a Lathi blow on<br \/>\nthe ribs  of Sher Singh and as a result thereof Sher Singh sat down  and later<br \/>\ndied.  The other accused were also  armed with Lathis.\t There is also evidence<br \/>\nto the effect that there was complete darkness and it was not possible to  see<br \/>\nwho had caused the injuries.   PW-2 admitted in his cross-examination that when<br \/>\nhe proceeded from his house to the place of incident, it was dark.   PW-4 also<br \/>\nadmitted  in the cross-examination that there was complete darkness and he<br \/>\ncould identify only some of them.\n<\/p>\n<p>\tIn view of the failure of PW-1 to mention the details of  attack by the<br \/>\nappellant  as against deceased Sher Singh and in view of the  fact  that the entire<br \/>\nincident happened pursuant to a quarrel between two groups of people and that<br \/>\nthe appellant had no deliberate intention to cause death of  Sher Singh, we do<br \/>\nnot think that an offence under Section 302 IPC had been made out against the<br \/>\nappellant.    The incident was the result of a sudden quarrel between the two<br \/>\ngroups and in that melee  the appellant must have  used a Lathi which caused<br \/>\ninjury to  Sher Singh which ultimately resulted\t  in his death.\t In that background<br \/>\nit is difficult to hold\t that\tthe appellant committed\t the offence of murder.\t  The<br \/>\noffence\t would only come under Section 304 Part II of the  Indian Penal Code.<br \/>\nTherefore,  we\tacquit the appellant of the offence under Section 302 IPC and<br \/>\nfind him guilty of offence punishable under Section 304 Part-II of IPC.\n<\/p>\n<p>\tWe are told that the appellant has been undergoing imprisonment ever<br \/>\nsince the date of Sessions Courts judgment,   which was pronounced on<br \/>\n28.9.1988.   Therefore, we hold that the sentence already undergone by the<br \/>\nappellant is sufficient to meet the ends of justice.   In the circumstances of\tthe<br \/>\ncase,\tappellant   Addha, son of Rooplal is directed to be released forthwith,\t if<br \/>\nnot required in any other case.\t     The appeal would stand allowed accordingly.\n<\/p>\n<p>\t\t\t\t\t\t\tJ<br \/>\n\t\t\t\t\t\t\t(U.C.
