Justice V.GIRI\n\n Dated :13\/03\/2009\n\n O R D E R\n                    V.GIRI, J\n                  -------------------\n               Crl.R.P.1047\/2001\n                 --------------------\n     Dated this the 13th day of March, 2009\n\n                     ORDER\n<\/pre>\n<p>    The complainant in C.M.P.No.6581\/2000         on<\/p>\n<p>the files of the Judicial Magistrate of First<\/p>\n<p>Class, Payyannur, is the petitioner in this<\/p>\n<p>revision.  The complaint         was dismissed under<\/p>\n<p>Section 203 of the Cr.P.C             and hence this<\/p>\n<p>revision.\n<\/p>\n<\/p>\n<p>2.  The case of the complainant           is that on<\/p>\n<p>12.3.2000,  the    complainant,         his  father,<\/p>\n<p>Chacko, mother, Thressiamma and a worker,<\/p>\n<p>Damodaran      had     gone        to  the  property<\/p>\n<p>belonging to the complainant&#8217;s           father  for<\/p>\n<p>attending   to maintenance work.             Accused<\/p>\n<p>persons came and trespassed into the property<\/p>\n<p>and   started    widening          a   road  without<\/p>\n<p>permission of the father or mother of the<\/p>\n<p>complainant.     Complainant&#8217;s           mother  was<\/p>\n<p>abused and the complainant was assaulted.<\/p>\n<p>Hence the complaint was lodged alleging that<\/p>\n<p>Crl.R.P.1047\/2001<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>the accused has committed offences punishable<\/p>\n<p>under Sections 447, 341, 323 and 506(ii) IPC<\/p>\n<p>read with Section 34 IPC.      Learned Magistrate<\/p>\n<p>recorded       the  statement of  CW1  and  then<\/p>\n<p>dismissed the complaint under Section 203 of<\/p>\n<p>the Cr.P.C declining to issue process on the<\/p>\n<p>ground       that it is clear   that a case was<\/p>\n<p>pending against the accused on the same date<\/p>\n<p>he attacked       the accused herein and that on<\/p>\n<p>moving such a case this complaint       has been<\/p>\n<p>filed.     I am not in a position to make out or<\/p>\n<p>understand       the reasoning    given  by  the<\/p>\n<p>learned Magistrate.       If there is already a<\/p>\n<p>case pending against the accused,      then,  it<\/p>\n<p>is understandable        as to why the learned<\/p>\n<p>Magistrate felt that the present complaint<\/p>\n<p>does not disclose enough materials to proceed<\/p>\n<p>with the case.         The order passed by the<\/p>\n<p>Magistrate is      clearly not satisfactory.<\/p>\n<p>3.    In the result,      the order is set aside<\/p>\n<p>and the learned Magistrate is directed        to<\/p>\n<p>Crl.R.P.1047\/2001<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>consider the matter afresh and if he finds<\/p>\n<p>that there are sufficient       grounds to proceed<\/p>\n<p>further with the case,          he may do so by<\/p>\n<p>issuing process under Section 204 of the<\/p>\n<p>Cr.P.C.
