It is  inter alia<br \/>\nstated that because of  intra-department  and inter-department<br \/>\nprocedure for obtaining sanction from the competent officer in the<br \/>\noffice of the Municipal Commissioner (Tax), Ahmedabad Municipal<br \/>\nCorporation, to file appeals, considerable time is consumed and after<br \/>\nobtaining sanction, the appeals have been drafted  and in the said<br \/>\nprocess also, considerable time has been spent and, therefore, the<br \/>\ndelay has been occurred.  It is, therefore, prayed to condone the<br \/>\ndelay.\n<\/p>\n<p>3\t\tHaving<br \/>\nconsidered the  averments made in the applications,  which is<br \/>\nsupported by an affidavit sworn by Shri Kelvin Chandravadan Kapadia,<br \/>\nDeputy Assessor and Tax Collector, in the office of the Municipal<br \/>\nCommissioner, Ahmedabad Municipal Corporation, this Court   has no<br \/>\nreason to disbelieve the affidavit sworn by a public officer  and<br \/>\nalso considering the celebrated principles governing the<br \/>\ndiscretionary exercise of power conferred under  Section-5 of the<br \/>\nAct,  so also  the reported decisions of the Hon&#8217;ble Supreme Court<br \/>\nconstruing Section 5 of the Act liberally,  we are of the considered<br \/>\nopinion that, delay caused in filing the above stamp numbered  First<br \/>\nAppeals has been  aptly, elaborately and  sufficiently explained. The<br \/>\nrecord does not  indicate  that there was inaction or negligence  on<br \/>\nthe part of the applicant in prosecuting the Appeals.  The applicant<br \/>\nhas  never abandoned   the lis.   The explanation for condonation of<br \/>\ndelay offered by the applicant  is not only plausible but<br \/>\nacceptable.\n<\/p>\n<p>4\t\tSeen<br \/>\nin the above context,  the instant batch of 74 applications  seeking<br \/>\ncondonation of delay  deserves to be allowed by condoning the delay<br \/>\nas prayed for.\n<\/p>\n<p>5\t\tFor<br \/>\nthe foregoing reasons,  instant batch of 74 applications succeeds and<br \/>\n   accordingly they are  allowed.
