\nthe seventh respondent   of the

\nConservator” of  per the proceedings
\ndated 24.03.2008, -thieqiinpugned land is shown as<\/p>\n
‘Raja.i.hadripura\u20ac~.tate Forest’. it is also brought to our<\/p>\n

\ufb01restraininlg the Forest Department from interfering<\/p>\n

    Taking note of the above fact, this Court by an
\n order dated 17.11.2008, called for the records in<\/p>\n

opinion, once it is treated as a forest land, viz., <\/p>\n
‘Rajathadripura State Forest’ Section 2 of the Forest;_l”~.._il’~<\/p>\n
(Conservation) Act operates and, by operation of   . Al<\/p>\n
the seventh respondent is not entitled to carrygl on-_ <\/p>\n
mining operation of iron ore in the\u00bb.impugr1ledi 0<\/p>\n
though the Government has granted miniAIigl*lease”—in”VE<\/p>\n
favour of the seventh respondent since} <\/p>\n
9.2 Of course, learned 0}ox_ie1*n_me1i.t’-.l?\u00a7d\\}’ocate
\nsubmitted that till the*.p.assin’g” “tlie_._procee’di1*1gls
\ndated 24.03.2008, by the :.0hie:f._Conservator
\nof Forests, the irnpugned…land vsias:bgn(‘).t’vconsidered as<\/p>\n
forest land.\n<\/p>\n
9.3 that.Vasi\/:it.lin:\ufb01l$l;’.by virtue of proceedings
\ndated 24.03′;–7?,;008g, the’.irr1p1’igned land is not available<\/p>\n
for operation of miningv lease as the same is a forest<\/p>\n
0′ “land”, unless” agclearance is obtained under Section 2 of<\/p>\n
 the’F’ore’st'{-Coziservation) Act, ‘i980.<\/p>\n
9.4,!  alternate, Mr. lZL).L.N.Rao, learned Senior<\/p>\n
 Counsel suggested that since the seventh respondent<\/p>\n
 ,:ha.s_.already been granted mining lease in the adjacent<\/p>\n
 .1and,i.–lie., Sy.No.1S0 and since he has no objection to<\/p>\n
take the said extent of land, in lieu. of an extent of<\/p>\n
71.20 acres located in Sy.No.95, for which, the <\/p>\n
petitioners cannot have any objections.<\/p>\n
9.5 In the light of the submissions made  <\/p>\n
learned counsel for the parties and inmview ofthve ‘ V
\nthat admittedly, right from 1976, it  Cxolveriimieint.
\nwhich has ‘granted an extent of 71.2l0,_aer_e.s of  ins, 2′
\nSy.No.95 of Rajathadripuralivillage, Tiptzlr
\nTurnkur District, treating it asH’a._Vlglrevgenue”land
\nthere was no fault on tiie..,_part”loi”l   resplendent
\nand thereafter, on the pariiof ,re’spondent-
\ntransferee whatsoever tilidatexand have also
\nbeen paying ,”royjal’t ,   towlfldirect the
\nGovernment  grant of 71.20
\nacres  land0gVin’.VS;t\u00a7i’Io.’1S0.._in- lieu of 71.20 acres of
\nland in AS\u00ab_vV.Nop.95   the seventh respondent,
\nprovided, area’ to  eittent of 71.20 acres located
\nin Sy_\u00a7l,No;’l 50 is”a.._rever1ue land and the Principal Chief
\n,.,.,QQf1se;~{,f;itorVl’   also certi\ufb01es that it is not a
\n ,_iforest,,la–n_d  the said land is available for grant of<\/p>\n

  Pursuant to the said interim order 06.08.2009, learned<\/p>\n
–:’Golvernment_Advocate and based on instructions from the revenue<\/p>\n
 authorities by their proceedings dated 11.08.2009, submits that<\/p>\n

the total area of an extent of 265.34 acres located in Sy.No.15Q in<\/p>\n
Rajathadripura village, Tiptur Taluk, Tumkur District c1assiEeii._4asV<\/p>\n

Forest Department has planted trees, neither lthef:F.orest<\/p>\n
Department nor the learned GovernrneintmlAdvocate\u00abare, in-bra <\/p>\n
position to clarify under what circumstancesand to”What ‘S*::s\u00e9ter1.tiV”<\/p>\n
the trees have been planted in the reniaining area. ‘ . V\n<\/p>\n
5. On the other hand, Mr.~Lx).L.Ne.lRao,.:l’learned senioncounsel
\nappearing for 7th respondent submilts.\u00bblthat__lan_d.to an extent of<\/p>\n
71.20 acres in Sy.No,<;'SDof  was granted<\/p>\n
by the respondents the said land as revenue
\nland and the   were in possession of the
\nsame for "past  and they are not at all at fault at any
\n'of.  said area is claimed to be a forest<\/p>\n
land, i'resp'onde.n'tsiE5  '7 are entitled for mining lease to the same<\/p>\n
l'v.__li"eXtent of–~..__reve'r1u_e:'.i' land in different survey number and the<\/p>\n
_. ..Qfesplondents\u00a7mining authorities are under an obligation to provide<\/p>\n
'*~.a1'ter:1ativel'1area of same extent, namely, '71.20 acres of revenue<\/p>\n
.   the neighbouring Sy.No.1SO of Rajathadripura village,<\/p>\n
 Taluk, Tumkur District, where the respondents have<\/p>\n

already granted mining lease in favour of Respondent No.7 herein<\/p>\n
or in any other revenue land. Accordingly respondents 5 <\/p>\n
have also agreed to make necessary representation for allotnierit''oflV'' ,.<\/p>\n
alternative revenue land of the same extent, namely, "'\/1_,20,"acres, <\/p>\n
either in sy.No.i5o of Rajathadripurafvillage,'..pTiptur\u00ab.Ta1ul<,<\/p>\n
Tumkur District or in any other such available-area and also  "<\/p>\n
permission for approach road to carry the V_m'i:1era1s'*-randll to<\/p>\n
transport the sarne.\n<\/p>\n
6. We have given our careful conside_ration~~.to’theesubmission of<\/p>\n
all the parties<\/p>\n
‘7. It is not in’d\ufb02ispute” axreziitent of 71.20 acres in Sy.No.95
\nof _ Rajathadripura village, Tiptur Taluk, Turnkur District was
\ntreateldaisvillrevenuel land by the Revenue Department at the time of<\/p>\n
grantiof ‘~:;;i;i1eg-.1eas”.eto S91 respondent which was subsequently<\/p>\n
W__i”transferred.__ toV_v’\/’thvirespondent. But, the impugned area, namely<\/p>\n
 acres ‘sy_No.95 of Rajathadripura village, Tiptur Taiuk,<\/p>\n
 Dilstrict is now found to be a forest land. Therefore, the<\/p>\n
‘:re*sp;ondoents–5 and ‘7 cannot be found at fault and hence they are<\/p>\n

District, which is admittedly a revenuefi1anid’e_ven .as.iV:on._ date, <\/p>\n
respondents 5 and 7 are entitled to clairritarr.a1terria_tiVe-a’~reaiiofAii’<\/p>\n
same extent ie., 71.20 acres in
\nvillage, Tiptur Taluk, Tumkurv}L1i.strig1;i.g11’id_: respondentgiatithorities
\nare under an obligation to  verepresentation, in
