According to prosecution, on 07.11.2008, the excise<\/p>\n<p>party received information that Ganja was being transported by<\/p>\n<p>the accused in a vehicle and on proceeding to the place, they<\/p>\n<p>found a vehicle being parked, in which the petitioner was sitting.<\/p>\n<p>On search of the vehicle, it was found to contain 1.015 Kgs. of<\/p>\n<p>Ganja. The petitioner was arrested and mahazar was prepared. A<\/p>\n<p>crime is registered under Section 20(b)(ii)B of Narcotic Drugs<\/p>\n<p>and Psychotropic Substances Act, 1985.\n<\/p>\n<p>     3. Learned counsel for petitioner submitted that a false<\/p>\n<p>case has been foisted against petitioner alleging that he was<\/p>\n<p>found transporting Ganja in a vehicle driven by him. Later, when<\/p>\n<p>they understood that petitioner does not even know driving and<\/p>\n<p>also that he does not have a driving licence. The excise officials<\/p>\n<p>went to his house and told his mother that a person should be<\/p>\n<p>pointed out as a driver of the vehicle, if it is not do so, her son<\/p>\n<p>would be made an accused etc. She was also threatened by the<\/p>\n<p>excise officials. She made a complaint before the Superintendent<\/p>\n<p>B.A.7359 of 2008<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>of Police in respect of such atrocities committed by the excise<\/p>\n<p>officials.\n<\/p>\n<p>       4. Learned counsel for petitioner also submitted that<\/p>\n<p>excise officials on knowing that a mistake was committed by<\/p>\n<p>them deliberately deviated from their version and it was alleged<\/p>\n<p>that vehicle was found parked beneath the tree and from the said<\/p>\n<p>vehicle Ganja was seized. It was also alleged that the petitioner<\/p>\n<p>was sitting in the vehicle in the passengers seat. If these<\/p>\n<p>allegations are true, certainly there will be an investigation<\/p>\n<p>regarding the driver of the vehicle and accused himself would be<\/p>\n<p>asked about the details of the driver. But the mahazar does not<\/p>\n<p>show that any attempt was made by the excise officials to<\/p>\n<p>ascertain such details of the driver to petitioner. This itself is an<\/p>\n<p>indication that the original case of the excise officials is that the<\/p>\n<p>petitioner himself was driving the vehicle. Petitioner&#8217;s statement<\/p>\n<p>was also recorded by the excise officials under his signature,<\/p>\n<p>wherein it is clearly stated that he was arrested while he was<\/p>\n<p>transporting the Ganja. Therefore there is evidently a deviation<\/p>\n<p>from the original case and petitioner has a strong case to put<\/p>\n<p>forward. Hence, petitioner may be granted bail, it is submitted.<\/p>\n<p>B.A.7359 of 2008<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>       5. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that the Ganga seized is more than 1 kg., which is<\/p>\n<p>more than small quantity and the petitioner was involved in<\/p>\n<p>another crime also of similar nature. The specific case of the<\/p>\n<p>prosecution is that Ganja was transported in the vehicle and the<\/p>\n<p>details of the petitioner were stated in the mahazar itself. The<\/p>\n<p>petitioner was arrested from the spot and the allegations to the<\/p>\n<p>contrary are false and those are put forward by him only for the<\/p>\n<p>sake of a defence. It is not fit to grant bail at this stage, since<\/p>\n<p>investigation is being conducted into the source of the articles, it<\/p>\n<p>is submitted.\n<\/p>\n<p>       6. Learned counsel for petitioner submitted that it is true<\/p>\n<p>that the petitioner was involved in another crime, but thereafter<\/p>\n<p>he was leading a proper life, as a law abiding citizen and he<\/p>\n<p>purchased a vehicle and he is eking his livelihood by running it<\/p>\n<p>as a taxi. He also has a driver for driving the vehicle as a taxi, it<\/p>\n<p>is submitted.\n<\/p>\n<p>       On hearing both sides and on going through the records, I<\/p>\n<p>am satisfied that the petitioner has a strong defence to advance.<\/p>\n<p>If the petitioner is detained in custody further, it may result in<\/p>\n<p>B.A.7359 of 2008<br \/>\n<span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>great injustice.\n<\/p>\n<p>       Hence, bail is granted to the petitioner on the following<\/p>\n<p>terms and conditions :\n<\/p>\n<blockquote><p>          (i) Petitioner shall execute a bond for Rs.50,000\/-<\/p>\n<\/blockquote>\n<blockquote><p>               with two solvent sureties each for like sum to the<\/p>\n<p>               satisfaction of the Magistrate court concerned.<\/p>\n<\/blockquote>\n<blockquote><p>          (ii) Petitioner shall report before Investigating<\/p>\n<p>               Officer on every Monday between 10 a.m. and 1<\/p>\n<p>               p.m. until further orders.\n<\/p><\/blockquote>\n<blockquote><p>          (iii) Petitioner shall not influence or intimidate any<\/p>\n<p>                witness or tamper with evidence or commit any<\/p>\n<p>                offence while on bail and in case of breach of<\/p>\n<p>                this condition, bail is liable to be cancelled.<\/p>\n<p>       The petition is allowed.<\/p><\/blockquote>\n<p>                                K.HEMA, JUDGE<\/p>\n<p>pac<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Lalu vs State Of Kerala on 3 December, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7359 of 2008() 1.
