No.323 of 2010\n                       *********************\n              Dated this the 30th day of August, 2010\n\n                           JUDGMENT\n<\/pre>\n<p>BASANT, J.\n<\/p>\n<p>      Petitioners, the maternal grandparents of a young girl<\/p>\n<p>Keerthana.S, aged 19 years (date of birth &#8211; 23.12.1990) have<\/p>\n<p>come to this Court with this petition for issue of a writ of habeas<\/p>\n<p>corpus to search for, trace and produce the said Keerthana<\/p>\n<p>(hereinafter referred to as `the alleged detenue&#8217;). According to<\/p>\n<p>the petitioners, the alleged detenue is under the illegal<\/p>\n<p>confinement and detention of the 3rd respondent. Respondent<\/p>\n<p>Nos.4 and 5 are the parents of the alleged detenue.            The<\/p>\n<p>petitioners came to this Court with the grievance that<\/p>\n<p>respondent Nos.4 and 5 are not taking any action to secure the<\/p>\n<p>release of the alleged detenue from the illegal custody of the 3rd<\/p>\n<p>respondent. She was being illegally detained and confined at<\/p>\n<p>Ahmadabad, Gujarat, complained the petitioners.<\/p>\n<p>      2.    Respondent Nos.4 and 5 were not initially impleaded<\/p>\n<p>in this petition.  The matter came up for hearing and after<\/p>\n<p>discussions at the Bar, the petitioners impleaded respondent<\/p>\n<p>Nos.4 and 5 also. This petition was filed on 10.08.2010. The<\/p>\n<p>same was admitted later on 11.08.2010. Notice was ordered to<\/p>\n<p><span class=\"hidden_text\">W.P(Crl.) No.323 of 2010        2<\/span><\/p>\n<p>the respondents. We directed respondents 1 and 2 to ensure<\/p>\n<p>that the alleged detenue is produced before us.<\/p>\n<p>     3.    This judgment must be read in continuation of the<\/p>\n<p>earlier orders passed by this Court resting with the order dated<\/p>\n<p>20.08.2010.\n<\/p>\n<p>     4.    The alleged detenue was traced at Ahmadabad by the<\/p>\n<p>police and brought to Kerala.    She was produced before the<\/p>\n<p>learned Chief Judicial Magistrate, Trivandrum, in accordance<\/p>\n<p>with the directions issued by this Court on 20.08.2010. The<\/p>\n<p>learned C.J.M in charge directed that the alleged detenue be<\/p>\n<p>accommodated at Mahila Mandiram, Poojappura, Trivandrum,<\/p>\n<p>and directed Superintendent of that institution to ensure that the<\/p>\n<p>alleged detenue is produced before this Court on 30.08.2010.<\/p>\n<p>     5.    Today when the case is called, the petitioners are<\/p>\n<p>present.    They are represented by their counsel.        The 3rd<\/p>\n<p>respondent has appeared before Court. He is represented by his<\/p>\n<p>counsel. Respondent Nos.4 and 5 have also appeared before<\/p>\n<p>Court. They are not represented by any counsel. The alleged<\/p>\n<p>detenue has been produced before Court from the Mahila<\/p>\n<p>Mandiram, Trivandrum, where she was accommodated from<\/p>\n<p>21.08.2010 to this date as per the directions of the C.J.M in<\/p>\n<p>charge, Trivandrum.\n<\/p>\n<p><span class=\"hidden_text\">W.P(Crl.) No.323 of 2010         3<\/span><\/p>\n<p>      6.   As the alleged detenue comes not from the custody of<\/p>\n<p>her parents and maternal grandparents &#8211; the petitioners, and she<\/p>\n<p>was allegedly traced in the custody of the 3rd respondent, we<\/p>\n<p>permitted the petitioners as also respondent Nos.4 and 5 and the<\/p>\n<p>younger sister of the alleged detenue to have interactions with<\/p>\n<p>her in the Chamber.\n<\/p>\n<p>      7.   After the lunch recess, we interacted with the alleged<\/p>\n<p>detenue alone initially. Later we interacted with the petitioners.<\/p>\n<p>Subsequently we interacted with respondent Nos.4 and 5. Still<\/p>\n<p>later we interacted with the 3rd respondent. The learned counsel<\/p>\n<p>for the petitioners, the learned counsel for the 3rd respondent<\/p>\n<p>and the learned Government Pleader were also involved in the<\/p>\n<p>interactions.\n<\/p>\n<p>      8.   The alleged detenue states before us that she had<\/p>\n<p>gone to Ahmadabad along with the 3rd respondent. She wanted<\/p>\n<p>to continue her studies in Music there at Darppana Academy.<\/p>\n<p>She had secured some voluntary engagement (employment)<\/p>\n<p>there. She was residing along with the 3rd respondent in an<\/p>\n<p>apartment taken on hire by him. She was traced by the police<\/p>\n<p>and was brought to Kerala and as per the directions of this Court, the<\/p>\n<p>learned C.J.M had directed that she be accommodated at Mahila<\/p>\n<p>Mandiram. There she was given opportunity to interact with her<\/p>\n<p><span class=\"hidden_text\">W.P(Crl.) No.323 of 2010       4<\/span><\/p>\n<p>grandparents and parents. The alleged detenue was also given<\/p>\n<p>counselling at Mahila Mandiram by a counsellor by name<\/p>\n<p>Dr.Seema Bhaskar.\n<\/p>\n<p>     9.   In the course of our interactions with the alleged<\/p>\n<p>detenue, the alleged detenue stated before us that she does not<\/p>\n<p>want to continue to reside with the 3rd respondent and that she<\/p>\n<p>would now choose to go along with her parents. She admitted<\/p>\n<p>that she was residing along with the 3rd respondent in an<\/p>\n<p>apartment at Ahmadabad. She hastened to state before us that<\/p>\n<p>there was no improper relationship between her and the 3rd<\/p>\n<p>respondent.\n<\/p>\n<p>     10. Respondent Nos.4 and 5, the parents of the alleged<\/p>\n<p>detenue, stated before us that they are now willing to take the<\/p>\n<p>alleged detenue with them.     The alleged detenue wants to<\/p>\n<p>continue the counselling with Dr.Seema Bhaskar and respondent<\/p>\n<p>Nos.4 and 5 agree that the needful shall be done to help the<\/p>\n<p>alleged detenue to get continued counselling support from the<\/p>\n<p>said Counsellor Dr.Seema Bhaskar. Respondent Nos.4 and 5 had<\/p>\n<p>undertaken before us to do everything that is necessary to give<\/p>\n<p>proper support, guidance and patronage to the alleged detenue.<\/p>\n<p>     11. The petitioners, the maternal grandparents of the<\/p>\n<p>alleged detenue, state before us that they are perfectly happy<\/p>\n<p><span class=\"hidden_text\">W.P(Crl.) No.323 of 2010          5<\/span><\/p>\n<p>with the arrangement of the alleged detenue going along with<\/p>\n<p>respondent Nos.4 and 5 and that that is what they always wanted<\/p>\n<p>to happen. It is true that the petitioners initially had a grievance<\/p>\n<p>that respondent Nos.4 and 5 were trusting the 3rd respondent<\/p>\n<p>unnecessarily and unreasonably and were giving needless and<\/p>\n<p>undeserved opportunity for the 3rd respondent to interact with<\/p>\n<p>the alleged detenue. They are happy if respondent Nos.4 and 5<\/p>\n<p>shall look after all her necessities and genuine interests.<\/p>\n<p>      12. The 3rd respondent stated before us that he had taken<\/p>\n<p>the alleged detenue from the house of respondent Nos.4 and 5 at<\/p>\n<p>Gudallur. According to him this was done by him admittedly<\/p>\n<p>without the consent of respondent Nos.4 and 5. But he would<\/p>\n<p>assert that he did so only in the interest of the alleged detenue.<\/p>\n<p>He is a Music Therapist and according to him the alleged<\/p>\n<p>detenue requires Music Therapy and he had been giving such<\/p>\n<p>therapy to the alleged detenue. According to the 3rd respondent<\/p>\n<p>it was as requested by the 4th respondent, the father of the<\/p>\n<p>alleged detenue, that he started Music Therapy for the alleged<\/p>\n<p>detenue. However, he accepts that he had taken the alleged<\/p>\n<p>detenue from the house of respondent Nos.4 and 5 without<\/p>\n<p>informing respondent Nos.4 and 5. This he had done only at the<\/p>\n<p>request of the alleged detenue, submits the 3rd respondent. He<\/p>\n<p><span class=\"hidden_text\">W.P(Crl.) No.323 of 2010       6<\/span><\/p>\n<p>further admits that he had taken her to Ahmadabad. He had got<\/p>\n<p>her admitted to the Darpana Academy. He had helped her to<\/p>\n<p>secure a voluntary engagement (employment) there. She was<\/p>\n<p>being accommodated along with him in an apartment taken on<\/p>\n<p>hire by him. He would hasten to admit that he had no improper<\/p>\n<p>relationship with the alleged detenue.      The 3rd respondent<\/p>\n<p>asserts that the alleged detenue had while at Ahmadabad joined<\/p>\n<p>B.A. Psychology Course conducted by the I.G.N.O.U &#8211; a distance<\/p>\n<p>education course.\n<\/p>\n<p>      13. In response to our queries, the 3rd respondent states<\/p>\n<p>that if respondent Nos.4 and 5 do not want him to have any<\/p>\n<p>relationship with the alleged detenue, he does not want to<\/p>\n<p>continue any relationship with the alleged detenue.        He is<\/p>\n<p>perfectly happy if respondent Nos.4 and 5 agree and undertake<\/p>\n<p>to take care of their daughter, the alleged detenue.          He<\/p>\n<p>undertakes before Court that he shall not hereafter have any<\/p>\n<p>relationship with the alleged detenue and that he shall not<\/p>\n<p>interfere in the management of the affairs of the alleged detenue<\/p>\n<p>by her parents, respondent Nos.4 and 5.\n<\/p>\n<p>      14. The learned Government Pleader on behalf of<\/p>\n<p>respondent Nos.1 and 2 submits that though no crime has been<\/p>\n<p>registered regarding the alleged disappearance of the alleged<\/p>\n<p><span class=\"hidden_text\">W.P(Crl.) No.323 of 2010        7<\/span><\/p>\n<p>detenue from the house of respondent Nos.4 and 5, the police, as<\/p>\n<p>directed by this Court, had made endeavour to trace the alleged<\/p>\n<p>detenue and she was ultimately traced in the company of the 3rd<\/p>\n<p>respondent at Ahmadabad. According to the police they were<\/p>\n<p>living together and the learned Government Pleader points out<\/p>\n<p>that the police have information that the relationship was not<\/p>\n<p>proper or fair. The 3rd respondent, a married person who has<\/p>\n<p>strained relationship with his wife, had taken the alleged<\/p>\n<p>detenue along with him and was having an objectionable live in<\/p>\n<p>relationship with her at Ahmadabad.\n<\/p>\n<p>      15. Be that as it may, we feel that it is unnecessary for us<\/p>\n<p>to delve deeper into the various controversies raised. We take<\/p>\n<p>note of the fact that respondent Nos. 4 and 5 as also the alleged<\/p>\n<p>detenue agree that the alleged detenue shall go along with<\/p>\n<p>respondent Nos.4 and 5.      We take note of the stand of the<\/p>\n<p>petitioners that they are happy if the alleged detenue leaves the<\/p>\n<p>Court along with respondent Nos.4 and 5. We take note of the<\/p>\n<p>undertaking given by the 3rd respondent before us in person in<\/p>\n<p>the presence of his counsel that he shall not in any way interfere<\/p>\n<p>with the relationship between the alleged detenue and<\/p>\n<p>respondent Nos.4 and 5. We take note of, record and accept his<\/p>\n<p>undertaking that he shall not in any way contact the alleged<\/p>\n<p><span class=\"hidden_text\">W.P(Crl.) No.323 of 2010          8<\/span><\/p>\n<p>detenue or have any relationship with her hereafter. We are<\/p>\n<p>satisfied, in these circumstances, that this Writ Petition can now<\/p>\n<p>be disposed of with appropriate directions.<\/p>\n<p>      16. In the result:\n<\/p>\n<p>      i)    This Writ Petition is allowed;\n<\/p>\n<p>      ii)   We permit the alleged detenue to go from Court along<\/p>\n<p>with her parents, ie. respondent Nos.4 and 5 as desired by her;<\/p>\n<p>      iii)  We record the undertaking of respondent Nos.4 and 5<\/p>\n<p>that they shall take proper care of the alleged detenue and shall<\/p>\n<p>afford her support of counselling by Dr.Seema Bhaskar, who has<\/p>\n<p>been counselling her after she was admitted to the Mahila<\/p>\n<p>Mandiram;\n<\/p>\n<p>      iv)   We take note of, record and accept the undertaking of<\/p>\n<p>the 3rd respondent that he shall not in any way interfere with the<\/p>\n<p>continued residence of the alleged detenue with respondent<\/p>\n<p>Nos.4 and 5 and that he shall not in any way contact the alleged<\/p>\n<p>detenue hereafter;\n<\/p>\n<p>      v)    We record the undertaking of the learned Government<\/p>\n<p>Pleader that respondent Nos.4 and 5 or the petitioners or the<\/p>\n<p>alleged detenue can make appropriate complaint before<\/p>\n<p>respondent Nos.1 and 2 or before any other police officer if the<\/p>\n<p>3rd respondent violates the above undertaking and that the police<\/p>\n<p><span class=\"hidden_text\">W.P(Crl.) No.323 of 2010         9<\/span><\/p>\n<p>shall do the needful if there be any improper and culpable<\/p>\n<p>conduct on the part of the 3rd respondent;\n<\/p>\n<p>      vi)  We record that the alleged detenue has accordingly<\/p>\n<p>left the Court along with her parents &#8211; respondent Nos.4 and 5.<\/p>\n<p>      Hand over copes of this judgment to the learned<\/p>\n<p>Government Pleader, the learned counsel for the petitioners and<\/p>\n<p>the learned counsel for the 3rd respondent.<\/p>\n<p>                                  (R.BASANT, JUDGE)<\/p>\n<p>                           (M.L.JOSEPH FRANCIS , JUDGE)<br \/>\nrtr\/<\/p>\n<p><span class=\"hidden_text\">W.P(Crl.) No.323 of 2010<br \/>\n                     *********************<br \/>\n            Dated this the 20th day of August, 2010<\/p>\n<p>                           ORDER<\/p>\n<p>BASANT, J.\n<\/p>\n<p>    Petitioners are present.    They are grandparents of the<\/p>\n<p><span class=\"hidden_text\">W.P(Crl.) No.323 of 2010        11<\/span><\/p>\n<p>alleged detenue. The learned Government Pleader on behalf of<\/p>\n<p>the police submits that the alleged detenue has already been<\/p>\n<p>traced at Ahmadabad in Gujarat and she is being brought to<\/p>\n<p>Kerala. The police party shall start with the alleged detenue only<\/p>\n<p>today. Before the closing of Courts, it is impossible hence to<\/p>\n<p>cause production of the alleged detenue before this Court. The<\/p>\n<p>learned counsel for the petitioners prays that the alleged<\/p>\n<p>detenue may be permitted to be produced before this Court and<\/p>\n<p>some interim arrangements may be made for the custody of the<\/p>\n<p>alleged detenue till she is produced before this Court.       The<\/p>\n<p>learned counsel for the petitioners submits that the 3rd<\/p>\n<p>respondent has no authority to keep the alleged detenue with<\/p>\n<p>him.   Respondent Nos.4 and 5, the parents of the alleged<\/p>\n<p>detenue, have also appeared before this Court today. They are<\/p>\n<p>not represented by any counsel.        We have interacted with<\/p>\n<p>respondent No.4. Respondent No.4 submits before us that he<\/p>\n<p>has also not given any authority for the 3rd respondent to keep<\/p>\n<p>his daughter, the alleged detenue, in his custody. The learned<\/p>\n<p>Government Pleader submits that no crime having been<\/p>\n<p>registered, appropriate directions may be issued to the police as<\/p>\n<p>to what the police should do with the alleged detenue when she<\/p>\n<p>is brought to Kerala at a time when this Court is not sitting.<\/p>\n<p><span class=\"hidden_text\">W.P(Crl.) No.323 of 2010          12<\/span><\/p>\n<p>     2.    A telegram is received by the Registrar from the 3rd<\/p>\n<p>respondent, in which he has raised certain contentions.<\/p>\n<p>     3.    Having considered all the relevant inputs, we direct<\/p>\n<p>that this case be called before this Court again on 30.08.2010, ie.<\/p>\n<p>the next date of sitting. In the meantime, it is directed that the<\/p>\n<p>alleged detenue shall be produced before the learned Chief<\/p>\n<p>Judicial Magistrate as soon as the alleged detenue reaches<\/p>\n<p>Trivandrum. The petitioners as also respondent Nos.4 and 5<\/p>\n<p>shall be informed of the date and time of production of the<\/p>\n<p>alleged detenue before the learned C.J.M by respondent No.2.<\/p>\n<p>The learned C.J.M shall hear all the parties including the alleged<\/p>\n<p>detenue and the 3rd respondent (if he appears), and take an<\/p>\n<p>appropriate decision regarding accommodation\/residence of the<\/p>\n<p>alleged detenue from the date of production till 30.08.2010. The<\/p>\n<p>learned C.J.M shall ensure that the alleged detenue appears<\/p>\n<p>before this Court on 30.08.2010, whatever be the interim<\/p>\n<p>arrangements regarding the accommodation of the alleged<\/p>\n<p>detenue till then.\n<\/p>\n<p>     4.    Call on 30.08.2010.\n<\/p>\n<p>     5.
