Gokak.\n\n4j..&#039;_l&#039;vi&#039;h.el&quot;&#039;2:_.s narrated by claimants before the Tribunal is not\n\nH  Hence, without dwelling upon the facts of the case, we\n\n4%\/.\n\n\n\nare examining the correctness and legality and award passed in\n\nthe above MVC. No. 1395\/2000.\n\n2. The claimants contended that on accounte-f  of&quot;  \n\nPundalik Akkappa Sultanpuri, who is  soiniof \n\nand 2 on 26\/04\/2000 in a road tra\u00e9f\ufb01c accident  peti&#039;tio&#039;ni:&quot;&#039;g\n\nseeking compensation was \ufb01led. The    gotiiegcamined\nas P.W.1 and examined one Irappa  was P.W.2,\nwho was the eye--witness to  of their claim,\nclaimants got  ito  did not lead\nany oral evidencetii\\\\\\,-ipinsnranc\ufb01 policy of the\nvehicle  came to be marked as\n\nEx.R--1.\n\n&#039;  Qn consideringi\ufb02iei pleadings, evidence on record and\n\nsubirhi&#039;ssio_n&#039;s   Tribunal by its judgment and award dtd.\n\n05\/ allowed the claim petition in part and awarded a\n\n-&lt;i.i.i&#039;_cornp.ensationvicf Rs. 3,44,000\/-- to be paid by the respondents\n\n severally with interest at 7% pa. from the date of\n\n\u00a2\/i\n\n\n\npetition till realisation. It is this award, which is now challenged in\n\nthe present appeal by the claimant seeking enhancement.\n\n4. We have heard the learned counsels appearingfoirl &#039;pa&#039;irt.ies-,  _\n\nIt is contended by the appellants that the &#039;\u00a7ribunal&quot;ought:  have&#039; \n\ntaken the income of the deceased at Rs. 6,t)3OOshlo1ild::l1_av=:ve Al\n\ncomputed the compensation payab1e\u00bbato..__the legal heirs:\naccordingly. Having not done so theitiliiare in this aiplpeallifgseeking\nenhancement. Per contra,   icoiinsel appearing for\nrespondent would subrnit  taken into\n\nconsideration the evifdengcel placed bieforewit &#039;avnd has awarded the\n\ncompensationiiwhicihellaridaflaasonaljle and accordingly prays\nthat appeal be ldismissedf   \n\n\ufb02\n\n 4. Hai(ing.heard&quot; learned counsel for parties, the point\narises for _cion.si..deration is;\n ._  award passed by the Tribunal is in\n\ngranting _ vcornpensation of Rs. 3,44,000\/- is just and\n\nlii&quot;&#039;...ul&#039;reasonable or the claimants entitled for any\n\n A ..jerinan,cement? And if so, to what amount?&quot;\n\nW\n\n\n\n5. It is seen from the perusal of judgment and award as also\n\nthe evidence let in by the claimants that deceased was worlgingiiaps\n\na maistry from past two years prior to the date of  _\n\ngetting a salary of Rs. 6,000 \/ ~. However, in the crossreri\u00e9aminationxl &quot;  \n\nit is admitted by the Witnesses i.e., the:=.AfatheI;n.l\n\nSalary Certi\ufb01cate had not been proc&#039;iuc__ed to..demon5~trate:&#039;_that;  \n\nwas being paid Rs. 6,000\/- salary.  begvveighed\nfrom the point of View of wha&#039;t:has   thevpetition and\nthe probable income that Cie(.:_ep_as\u00a2.=;rjV   the time of\naccident.   we are of the\nopinion that the  during his life time\nWhile   Rs.4,000\/- per month.\nAccordingly, v\\ie\u00abholdl that was earning Rs.4,000\/ -- per\n\nmonth.\n\n .6;ll  compensation to be awarded under the\n\n v\u00a2i&quot;&quot;l=1&#039;eading loss of .income to the dependants, if the income is taken as\n\n~ \/ -- per month, the deceased being a bachelor and who was\n\nl~--laged&#039;--ai:~o1it&quot;A_\u00ab2l years as per the post--mortem report, which is at\n\nH &#039;l:Ex..ll?;5,lgwe are of the opinion that 50% is to be deducted towards\n\n\ufb01x\n\n\n\nhis personal expenses and in doing so the monthly income arrived\n\nat is Rs.2,000\/--- per month. We \ufb01nd from the order of Tribunal\n\nthat, the Tribunal has applied 18 as the appropriate multiplier\n\nbased on the aged of deceased. This \ufb01nding is erroneous\u00ab~~si&#039;i&amp;1cee-the&quot; \n\nage of parents have to be taken into consideration andas  the \n\nage of the mother being 45 in View of  fact. that  \n\nhusband being 50 and that of the _ deceased&#039;-.at  \n\nmother, who is claimant No.2, is tal\u00e9eriiand We._ll&#039;inr.l[=\ndictum of the Sarala Verma&#039;&quot;s~..V_case&#039;&quot;lthei..:ljappr_opriate&quot;multiplier,\nwhich is required to be applied liwouldilbe  &#039;accordingly by\n\napplying the multiplier.y:V&lt;&#039;3:-f. 14&#039;,  tota*l&#039;_j_comp&#039;ensation payable\n\nunder the heee,dingliloss.. of theldependantga would be Rs.\n3,536,000\/\u00ab i.e.i&quot;\u00ab(Rs.4&#039;,o&#039;0o\/2]&#039;i~2.ei;&#039;2,0oox12x 14). Hence, the total\ncompensation payable  heading loss of income to the\n\ndependantsilwould be Rs. 3&#039;;36i0O0 \/ --.\n\n We&quot;F1nd_&#039;ithVatV..~under the conventional heads a sum of\n\n v.:liRs;i3!O,00(i)&#039;,--*.;  awarded by the Tribunal. This being on the\n\n We  it just and proper to award Rs. 30,000\/~ in\n\n substi&#039;tiutionf.--&#039;to what has been awarded by the Tribunal. Thus, the\n\n are entitled in all for a sum of Rs. 3,66,000\/-- in this\n\n\u00a7(,\n\n\n\nappeal.
