MUKHOPADHAYA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/03\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(<br \/>\nPer : HONOURABLE MR.JUSTICE AKIL KURESHI )<\/p>\n<p>\tSpecial<br \/>\nCivil Application No.1586 has been preferred by the private<br \/>\nindividual students who had been admitted by the Shantaram Bhatt<br \/>\nCollege of Education (B.Ed.) for the academic year 2008-09 without<br \/>\nrecognition. They seek regularization of their admissions. Special<br \/>\nCivil Application No.1587 of 2009 has been filed by the Shantaram<br \/>\nBhatt College of Education (B.Ed.) challenging the decision of the<br \/>\nNational Council of Teacher Education (For short  NCTE ) not<br \/>\ngranting them recognition for the year 2008-2009 and of cancelling<br \/>\nthe recognition granted for the year 2009-2010.\n<\/p>\n<p>\tThe<br \/>\nCollege had asked for recognition by the NCTE for B.Ed. (Co-Ed.)<br \/>\ncourse for the year 2008-2009. Provisional recognition was granted by<br \/>\nthe NCTE by order dated 9th \/ 19th September<br \/>\n2008. Provisional recognition order clearly stipulated in Para-4 that<br \/>\nadmission should not be made until formal recognition order is<br \/>\ngranted by the NCTE and affiliation is obtained from the University.<br \/>\nIn Para-3 of the provisional recognition order it was provided inter<br \/>\nalia that before grant of formal recognition, the College shall make<br \/>\nappointment of Faculty \/ Staff by a duly constituted Selection<br \/>\nCommittee and ensure selection of candidates possessing qualification<br \/>\nas prescribed under the Rules. After obtaining provisional<br \/>\nrecognition, the College had to take certain important steps such as<br \/>\nappointment of qualified teaching and non-teaching staff before<br \/>\nseeking formal final recognition. The college was also informed in<br \/>\nclear terms not to admit the students before formal recognition.\n<\/p>\n<p>\tWithout<br \/>\nwaiting for formal recognition from the NCTE, the College admitted<br \/>\nthe students for the academic year 2008-2009 some time in October,<br \/>\n2008. However, NCTE did not recognize the said admissions, therefore,<br \/>\nthe students approached this Court by filing Special Civil<br \/>\nApplication No.1586 of 2009.\n<\/p>\n<p>\tWhen<br \/>\nthese facts came to the knowledge of NCTE, the NCTE also cancelled<br \/>\nthe subsequent recognition granted to the institution for the<br \/>\nacademic year 2009-2010. These decisions are questioned by the<br \/>\nCollege in Special Civil Application No.1587 of 2009.\n<\/p>\n<p>\tHaving<br \/>\nheard learned counsels for the parties, we notice that defying clear<br \/>\nconditions of the provisional recognition order, the College had<br \/>\nadmitted students on 02.08.2009. It is also admitted position that<br \/>\nfor the academic year 2008-2009, no final\/formal recognition was ever<br \/>\ngranted by the NCTE. In that view of the matter, the students cannot<br \/>\nseek regularization of their admissions for the academic course for<br \/>\nwhich recognition was never granted by the NCTE for that particular<br \/>\nacademic year.\n<\/p>\n<p>\tIn<br \/>\nview of the above facts, we see no merits in the challenge made by<br \/>\nthe students, so also by the College on this point. No direction can<br \/>\nbe given for granting recognition to the petitioner-college for the<br \/>\nacademic year 2008-2009. Further, it is also an admitted position<br \/>\nthat for academic year 2009-2010, in view of cancellation of<br \/>\nrecognition, the College had not admitted any students, nor the<br \/>\nUniversity had allocated students to the college. No retrospective<br \/>\norder can be granted giving recognition for the academic year<br \/>\n2009-2010. Both the petitions therefore must fail.\n<\/p>\n<p>\tDespite<br \/>\nabove order, it would be open for the petitioner- college to apply to<br \/>\nNCTE for fresh recognition in accordance with the Rules if the<br \/>\nCollege is fulfilling all the norms and conditions and in turn, the<br \/>\nNCTE shall consider such a request, if made. We are informed that the<br \/>\nstudents were admitted by the University in the petitioner-college in<br \/>\nthe year 2008-2009 and the University has also awarded degree<br \/>\ncertificates to the students upon completion of the course. It would<br \/>\nbe open for the students to apply for regularization of their<br \/>\nadmissions and also for notional recognition for the year 2008-2009<br \/>\nby making representation to the NCTE for consideration of their cases<br \/>\nsympathetically.\n<\/p>\n<p>\tWith<br \/>\nthe aforesaid observations and directions, both the Special Civil<br \/>\nApplications stand disposed of.\n<\/p>\n<p>(S.\n<\/p>\n<p>J.
