Heard      learned     counsels      for   the<\/p>\n<p>                   petitioners and the State.\n<\/p>\n<p>                            The petitioners are apprehending<\/p>\n<p>                   their arrest in a case registered under<\/p>\n<p>                   Sections 409, 420, 467, 468, 471, 477,<\/p>\n<p>                   511,   120B   of      the     Indian    Penal     Code,<\/p>\n<p>                   Section 13(2) read with Section 13(1)(d)<\/p>\n<p>                   of the Prevention of Corruption Act.<\/p>\n<p>                            It   is      submitted   by    the     learned<\/p>\n<p>                   counsel for the petitioners that though<\/p>\n<p>                   the    accusation      has    been     levelled     for<\/p>\n<p>                   defalcation      of     Rs.65,85,864\/-in         repair<\/p>\n<p>                   work    of    the      Road     Bridge     but      the<\/p>\n<p>                   petitioners have already retired from the<\/p>\n<p>                   services several years back.<\/p>\n<p>                            It is submitted by senior counsel<\/p>\n<p>                   for the Vigilance that the F. I. R. was<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>lodged in pursuant to the direction given<\/p>\n<p>by    this     Hon&#8217;ble       Court        in    L.P.A.        and<\/p>\n<p>without       allocation         of    fund     repair       work<\/p>\n<p>was undertaken by the petitioners.<\/p>\n<p>          It     is       also    submitted       by     senior<\/p>\n<p>counsel       for     the    petitioners             that     the<\/p>\n<p>Superintending            Engineer,        namely,          Bhola<\/p>\n<p>Nath Puran, who sanctioned the estimate,<\/p>\n<p>has     already       been       granted        anticipatory<\/p>\n<p>bail vide Cr. Misc. No. 36967 of 2010 by<\/p>\n<p>this court.\n<\/p>\n<p>          Considering            the     fact     that      other<\/p>\n<p>accused       has     been       granted        anticipatory<\/p>\n<p>bail and the fact that the petitioners<\/p>\n<p>have already retired from the services,<\/p>\n<p>let     the     petitioners,             Sudhir       Kumar     @<\/p>\n<p>Sudhir        Prasad,       Trilokeshwar             Prasad     @<\/p>\n<p>Milokeshwar         Prasad,       Sitapati        Sharan      and<\/p>\n<p>Tribhuwan       Prasad       Sinha       be     released       on<\/p>\n<p>bail in the event of arrest or surrender<\/p>\n<p>before the learned court below within a<\/p>\n<p>period    of     twelve          weeks    from       today     in<\/p>\n<p>connection with Vigilance Case No. 50 of<\/p>\n<p>2010,    Special          Case    No.     18    of    2010     on<\/p>\n<p>furnishing bail bond of Rs. 10,000\/-(Ten<\/p>\n<p>Thousand) each with two sureties of the<\/p>\n<p>like amount each to the satisfaction of<br \/>\n<span class=\"hidden_text\">                      3<\/span><\/p>\n<p>        the learned Special Judge, Vigilance-II,<\/p>\n<p>        Patna, subject to the conditions as laid<\/p>\n<p>        down under Section 438(2) of the Cr.
