He submitted, on<br \/>\n\tinstructions, that he is prepared to hand over the land back and<br \/>\n\tcomplainant has no objection.\n<\/p>\n<p>\tLearned<br \/>\n\tAdvocate Mr.Rajkumar Chaumal appears for complainant and confirms<br \/>\n\tthat there is some understanding arrived at and there is no<br \/>\n\tobjection.\n<\/p>\n<p>\tLearned<br \/>\n\tAdditional Public Prosecutor Ms.Manisha L Shah\u00a0for respondent<br \/>\n\tState has referred to the nature of offence and submitted that it<br \/>\n\ttranspires that applicant is bona fide purchaser<br \/>\n\tand when the dispute arose he has shown his willingness to give back<br \/>\n\tthe land to the complainant.\n<\/p>\n<p>\tHaving<br \/>\n\theard Mr.Abhaykumar Shah, learned advocate for applicant, Mr.Chaumal<br \/>\n\tlearned advocate for complainant and Ms.Manisha Shah, learned APP<br \/>\n\tand having considered the nature of offence and other attending<br \/>\n\tcircumstances as reflected hereinabove, present application deserves<br \/>\n\tto be allowed in light of guidelines\/principles laid with regard to<br \/>\n\texercise of discretion under section 438 of Cr.P.C.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tthe present application is allowed. The applicant is ordered to be<br \/>\n\treleased on bail in the event of his arrest in connection with<br \/>\n\tI-C.R.No.150\/2010 registered with Kalol Taluka Police Station,<br \/>\n\tDist.Gandhinagar in respect of the offence alleged against him on<br \/>\n\this executing bond of Rs.5,000\/- (Rupees Five thousand only) with<br \/>\n\tone solvent surety of the like amount, by her, by the concerned<br \/>\n\tPolice Officer and on conditions that he shall;\n<\/p>\n<p> a)\tremain present before the trial Court regularly as and when directed on the dates fixed;\n<\/p>\n<p>b)\tremain present at the concerned Police Station on 02.11.2010 between 11.00 a.m. and 4.00 p.m;\n<\/p>\n<p>c)\tmake himself available for interrogation by Police Officer between 11:00 a.m. to 05:00 p.m. &#8211; before sunset;\n<\/p>\n<p>d)\tnot directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the \tcase so as to dissuade him from disclosing such facts to the \tCourt or to any Police Officer;\n<\/p>\n<p>e)\tnot to obstruct or hamper the police investigation \tand not to play mischief with the evidence collected or yet to be collected by the police;\n<\/p>\n<p>f)\tat the time of execution of bond, furnish his address to the Investigating Officer and the Courts concerned, \tand shall not change his residence till the final disposal of the case or till further orders;\n<\/p>\n<p>g)\tnot leave India without the permission of the Court and if having Passport, shall deposit the same before the trial Court within a week;\n<\/p>\n<p>h)\tIt<br \/>\nshould be open to the Investigating Officer to file an application<br \/>\nfor remand if he considers it proper and just; and the learned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>This<br \/>\n\torder will hold good if the applicant is arrested at any time within<br \/>\n\t90 days from today. The order for release on bail will remain<br \/>\n\toperative only for a period of ten days from the date of her arrest,<br \/>\n\tduring which it will be open to the applicant to make fresh<br \/>\n\tapplication for being enlarged on bail in usual course which when it<br \/>\n\tcomes before the competent Court, will be disposed of in accordance<br \/>\n\twith law, having regard to all the attending circumstances and the<br \/>\n\tmaterials available at the relevant time uninfluenced by the fact<br \/>\n\tthat anticipatory bail was granted.\n<\/p>\n<p>Rule<br \/>\n\tis  made absolute to the aforesaid extent.
