Shah for petitioner and learned AGP<br \/>\nMr.Amit Patel for respondent No.1.\n<\/p>\n<p>2.\tThe<br \/>\ngrievance of present petitioner is that in birth certificate which<br \/>\nhas been obtained from Mamlatdar, Choryasi and Talati-cum-Mantri of<br \/>\nMohini Gram Panchayat, Taluka   Choryasi, District   Surat where<br \/>\nname of father of petitioner is wrongly recorded. The real name of<br \/>\nfather is &#8216;Hargovanbhai&#8217; but, it has been wrongly recorded as<br \/>\n&#8216;Harkishandas&#8217; which required to be corrected. For that, petitioner<br \/>\nhas approached to Civil Court by application No.37 of 1993 on<br \/>\n9.12.1993 where Civil Court, Surat has directed to Mamlatdar,<br \/>\nChoryasi to issue birth certificate of petitioner on the basis of<br \/>\ndetails mentioned in school leaving certificate, which came to be<br \/>\nallowed.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr.Shah submitted that in that order also, by mistake, name<br \/>\nof father of petitioner is remained as  Harkishandas  and not<br \/>\ncorrected as  Hargovanbhai .\n<\/p>\n<p>4.\tIn<br \/>\nlight of this background, let petitioner may again approach to Civil<br \/>\nCourt by filing separate fresh application giving correct details in<br \/>\nrespect to name of father of petitioner, within a period of one month<br \/>\nfrom date of receiving copy of present order.\n<\/p>\n<p>5.\tAs<br \/>\nand when concerned Civil Court \/ Magistrate Court, Surat receives<br \/>\nsuch application from petitioner, it is directed to concerned   Civil<br \/>\nCourt \/ Magistrate Court, Surat to consider application made by<br \/>\npetitioner and also investigate and inquire the original documents<br \/>\nwhich will be produced by petitioner and thereafter, to pass<br \/>\nappropriate reasoned order after considering the original record,<br \/>\nwithin a period of two months from date of receiving copy of such<br \/>\napplication from petitioner and communicate the decision to<br \/>\npetitioner.\n<\/p>\n<p>6.\tIn<br \/>\nview of aforesaid observations and directions, present petition is<br \/>\ndisposed of without expressing any opinion on merits.
