\nRural v”PoliCeV  registered for the offences<\/p>\n
punishableiinderg 341, 302 r\/w 34 IPC., alleging<\/p>\n
  that’itheoigaccuseddare—–ii1vo1ved in the murder of Panchayath<\/p>\n
 President untoward incident that occurred at the<\/p>\n
Jathra.  incident was between the deceased and other<\/p>\n
 peoole.  that xdllage and so also the other Village.<\/p>\n
3′ “V.:ijV\u00bbt!lccording to the investigating agency, they filed an<\/p>\n
 application before the learned Magistrate ie, the<\/p>\n
V W\u00e9ornmittal Court seeking direction to accused Nos. 1 to 3 to<\/p>\n
have Narco Analysis Test by the expert at Forensic Science<\/p>\n
Laboratory {FSL] at Bangalore. This was opposed by the<\/p>\n
accused persons and the learned Magistrate rejected”–.the<\/p>\n
said application, which was challenged before..__thle_’efirst<\/p>\n
Revisional Court and the learned Sessionspdudigeijallottredl K it <\/p>\n
Criminal Revision Petition No..’h1mO\/2006 <\/p>\n
handing over or directing the acclusedy\ufb01to  <\/p>\n
Analysis test is not handing ovento police  it  C\n<\/p>\n
3. Aggrieved by the sai.dllord:e;r of~the Sessions Court,
\nthe present petition is tiled’  settingaside the orders<\/p>\n
of the revisiona’lCourt.\u00a5_ On eariier’ occasion when there was<\/p>\n
disputelwlithl accused Nos. 1 to 3 to
\nthe police .euotoo\u00a7j_eebe’ts,z\u00a7{ee.o,..16.11.2005 till 18.11.2005 to<\/p>\n
undergo poiygrapiitest at”CClBangalore, there was controversy<\/p>\n
   the parties—-\u00aband the matter reached up to High<\/p>\n
 pl orders of the learned Magistrate to hand over<\/p>\n
‘eeo’oeeo’  I to 3 to the police custody came to be<\/p>\n
 oooengeo in Criminal Revision Petition No. 305\/2005 and<\/p>\n
A X1′ ‘revision petition was dismissed con\ufb01rming the order of<\/p>\n
the ‘learned Magistrate. The same came to be challenged in<\/p>\n
 Criminal Petition No. 4686\/2005 before this Court.<\/p>\n
4. The learned Single Judge of this Court while<\/p>\n
disposing of Criminal Petition No. 4686\/2005, directed to<\/p>\n
strictly adhere to the provisions of Section
\nplacing reliance on the judgments of the  it
\nholding that, the police cannot
\nmonths of their arrest and therefore’,   <\/p>\n
violation of mandate of pro\\}1s_i:ori.,s of l’<\/p>\n
According to the learned..Single*Judge,*-the  period
\nallowable under Section’l’1t;i7  custody was
\nover and therefore,there”caijnot\u00ab..heV_litirtherllpolice custody
\nof the accuj:sed”..,_  direction to him
\nand other -A   Narco Analysis Test is
\nnothingllbuit  police custody and therefore,<\/p>\n
theprders of thelllirst Revisional Court deserves to be set<\/p>\n
 aside. ‘T?here\u00ab,..e_Lre three accused persons in the present case,<\/p>\n
 The third~\u00ab.,acc.usved is on bail and other two accused are in<\/p>\n
juoi..cial,_v’custody. Even for practical purpose though the<\/p>\n
 pl third ‘accused person is on bail, still he has to be held as a
\nit  in judicial custody till the criminal case against him<\/p>\n
  completed and disposed of and he will be expected to<\/p>\n
follow the directions of the Court.\n<\/p>\n<\/p>\n
5. So far as accused Nos. 1 and 2 are concerned,<\/p>\n
they are in judicial custody and the investigating <\/p>\n
of the opinion that, if the accused persons  ”
\nundergo Narco Anaiysis Test,  it
\ncommission of murder of political <\/p>\n
would give some information for compietingi the <\/p>\n
investigation. Apparently beca:use”‘–.of  faeie case
\nagainst the accused  aiso arrayed as
\naccused in thecase.  1 and 2,
\nwho are in  the expert to
\nundergo_the’~.N:artf;o__  directing the accused.
\nwho  on “before the FSL at Bangalore for
\nNarco   will not amount to handing<\/p>\n
ovef\ufb01dttr\ufb01m to’M.pV_o1Vice custody. The persons in judicial<\/p>\n
it  cl. be directly produced before the expert on the<\/p>\n
A    expert for such test by the jail authorities.<\/p>\n
This has nothing to do with the police taking to their<\/p>\n
  custody and producing them before the expert. The person
\nit on-bail has to appear before the concerned expert for such<\/p>\n
”  ….test as directed by the Magistrate. Therefore viewed from<\/p>\n
any angle, one cannot say that the directions issued by the<\/p>\n
First Revisional Court allowing the appiication o*F–__the<\/p>\n
investigating agency amounts to police custody. it  ”<\/p>\n
