BHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/05\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)<\/p>\n<p>1.0\tLearned<br \/>\nAdditional Public Prosecutor Mr. Pandya made available for perusal a<br \/>\ncommunication dated 27th April 2011 from the Medical<br \/>\nOfficer, Vadodara Central Jail to the Superintendent, Vadodara<br \/>\nCentral Jail.  Present Certificate (Communication) is dated 27th<br \/>\nApril 2011, whereas, along with application, the applicant has<br \/>\nenclosed the Certificate (Communication) dated 28th March<br \/>\n2011.\n<\/p>\n<p>2.0\tThe<br \/>\nreason for calling for the latest Medical Report was to find out as<br \/>\nto whether there is any improvement in the condition of the convict.<br \/>\nThe learned Additional Public Prosecutor asked for time to find out<br \/>\ntelephonically.  Hence, the matter was kept in the second half.\n<\/p>\n<p>2.1\tIn<br \/>\nsecond half, on telephonic instructions,<br \/>\nthe learned Additional Public Prosecutor States that there is no<br \/>\nimprovement in the condition of the convict since 28th<br \/>\nMarch 2011 till 27th April 2011.\n<\/p>\n<p>3.0\tIn<br \/>\nview of that it is deemed proper that the convict be released on<br \/>\nTemporary Bail so as to enable him to take treatment from a private<br \/>\nDoctor of his choice.  The conviction is under Sections 302, 394 and<br \/>\n34 of the Indian Penal Code.  That being so, there is no question of<br \/>\nthe convict having an occasion of enjoying furlough leave.  The<br \/>\nconvict has undergone 05 years, 10 months and 19 days as on 7th<br \/>\nApril 2011.\n<\/p>\n<p>4.0\tLooking<br \/>\nto the contents of the communication from the Medical Officer,<br \/>\nVadodara Central Jail it is deemed fit that the applicant be granted<br \/>\nTemporary Bail.\n<\/p>\n<p>5.0\tRule.\n<\/p>\n<p> Learned Additional Public Prosecutor Mr. Pandya waives service of<br \/>\nprocess of Rule.\n<\/p>\n<p>6.0\tTaking<br \/>\ninto consideration the contents of the application, the application<br \/>\nis allowed.  The applicant &#8211; convict is ordered to be released on<br \/>\nTemporary Bail for a period of 30 days from the date of<br \/>\nhis release, on his executing a personal bond of Rs.5,000\/-<br \/>\n(Rupees Five Thousand only) to the satisfaction of the jail<br \/>\nauthorities.\n<\/p>\n<p>6.1\tIt<br \/>\nis directed that the applicant &#8211; convict shall mark his<br \/>\npresence before the nearest Police Station on every Monday.\n<\/p>\n<p>6.2\tThe<br \/>\napplicant &#8211; convict shall surrender to the jail authorities on<br \/>\nexpiry of the Temporary Bail period.\n<\/p>\n<p>6.3\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>[<br \/>\nRavi R.
