Sonu Kumar\n                                             -----------\n<\/pre>\n<p>4.   26.7.2011                Heard learned counsel for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              The petitioner is apprehending his arrest in a<\/p>\n<p>                 case registered under Sections 342, 328 and 302\/34 of<\/p>\n<p>                 the Indian Penal Code.\n<\/p>\n<p>                              The allegation against the petitioner, who is<\/p>\n<p>                 the father-in-law of the deceased, is that he poisoned his<\/p>\n<p>                 son-in-law along with other accused persons. During<\/p>\n<p>                 investigation it transpired that the deceased was a<\/p>\n<p>                 veteran drunkard and had died probably on account of<\/p>\n<p>                 toxic liquor.\n<\/p>\n<p>                              Considering the same, let the petitioner above<\/p>\n<p>                 named be released on anticipatory bail in the event of<\/p>\n<p>                 arrest or surrender before the learned court below within<\/p>\n<p>                 a period of 12 weeks from the date of receipt of this order<\/p>\n<p>                 in connection with Cheriya Bariyarpur (Manjhaul) P.S.<\/p>\n<p>                 case No.83 of 2010          on furnishing bail bonds of<\/p>\n<p>                 Rs.10,000\/- (Ten thousand) with two sureties of the like<\/p>\n<p>                 amount each to the satisfaction of the Chief Judicial<\/p>\n<p>                 Magistrate, Begusarai, subject to the conditions as laid<\/p>\n<p>                 down under Section 438(2) of the Code of Criminal<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>            Procedure as also the conditions (i) That one of the bailor<\/p>\n<p>            will be a close relative of the petitioner who will give an<\/p>\n<p>            affidavit giving genealogy as to how he is related with the<\/p>\n<p>            petitioner. The bailor will undertake to furnish information<\/p>\n<p>            to the Court about any change in address of the<\/p>\n<p>            petitioner. (ii) That the affidavit shall clearly state that the<\/p>\n<p>            petitioner is not an accused in any other case and if he is<\/p>\n<p>            he shall not be released on bail, (iii) That the bailor shall<\/p>\n<p>            also state on affidavit that he will inform the court<\/p>\n<p>            concerned if the petitioner is implicated in any other case<\/p>\n<p>            of similar nature after his release in the present case and<\/p>\n<p>            thereafter the court below will be at liberty to initiate the<\/p>\n<p>            proceeding for cancellation of bail on ground of misuse,<\/p>\n<p>            (iv) That the petitioner will give an undertaking that he will<\/p>\n<p>            receive the police papers on the given date and be<\/p>\n<p>            present on date fixed for charge and if he fails to do so on<\/p>\n<p>            two given dates and delays the trial in any manner, his<\/p>\n<p>            bail will be liable to be cancelled for reasons of misuse,<\/p>\n<p>            (v) That the petitioner will be well represented on each<\/p>\n<p>            date if he fails to do so on two consecutive dates, his bail<\/p>\n<p>            will be liable to be cancelled.\n<\/p>\n<\/p>\n<pre>Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ram Dular Singh vs The State Of Bihar &amp; Anr on 26 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
