Tiwari\n\nHon'ble Abdul Mateen,J.\n<\/pre>\n<p>Hon&#8217;ble Vedpal,J.\n<\/p>\n<p>Heard learned counsel for the petitioners and learned Additional<br \/>\nGovernment Advocate.\n<\/p>\n<p>The petitioners by means of this writ petition under Article 226 of<br \/>\nConstitution, have prayed for quashing FIR relating to case crime<br \/>\nno. 435 of 2010 under Sections 323, 498-A &amp; 506 IPC read with<br \/>\nsection 3\/4 of the Dowry Prohibition Act of Police Station Inayat<br \/>\nNagar, district Faizabad.\n<\/p>\n<p>We have gone through the FIR as well as the divorce suit filed by<br \/>\npetitioner No. 1 Durgesh Pratap Singh, who is the husband of<br \/>\nopposite party no. 4 Dimple Singh, filed as far back as in the year<br \/>\n2007.\n<\/p>\n<p>Argument advanced by the learned counsel for the petitioners is<br \/>\nthat the dispute between the parties relates to matrimonial dispute<br \/>\nand no serious allegations have been made in the FIR against the<br \/>\npetitioners. It is further stated that petitioner no. 1 is ready to keep<br \/>\nopposite party no. 4 as his wife provided she comes and resides<br \/>\nwith the petitioner and performs her marital obligations. Learned<br \/>\ncounsel for the petitioners submits that if the matter is referred to<br \/>\nthe Mediation and Conciliation Centre of this Court, there is every<br \/>\nlikelihood that the parties may reconcile their dispute.\n<\/p>\n<p>Having gone through the contents of the FIR and considering the<br \/>\nsubmissions made by the learned counsel for the petitioners, we<br \/>\ndirect that the petitioners shall deposit an amount of Rs. 10,000\/<br \/>\n(Rupees ten thousand) in this Court within ten days from today. If<br \/>\nthe aforesaid amount is deposited as directed above, an amount of<br \/>\nRs. 8,000\/ (Rupees eight thousand) shall be paid to opposite party<br \/>\nno. 4 Dimple Singh on her appearance before the Mediation &amp;<br \/>\nConciliation Centre and the remaining amount of Rs. 2,000\/<br \/>\n(Rupees two thousand) shall be deposited in the accounts of<br \/>\nMediation &amp; Conciliation Centre<br \/>\n                                  _2_<\/p>\n<p>Thereafter, notices shall be issued to opposite party no. 4 Dimple<br \/>\nSingh through Chief Judicial Magistrate, Faizabad for her<br \/>\nappearance before this Court on 15th July 2010 to enable this<br \/>\nCourt to inquire from her as to whether she is agreeable for<br \/>\nreferring the matter to the Mediation &amp; Conciliation Centre or not.\n<\/p>\n<p>List the case on 15th July 2010<\/p>\n<p>Till next listing, arrest of the petitioners in the above mentioned<br \/>\ncase shall remain stayed.\n<\/p>\n<p>It is clarified that if the petitioners fails to deposit the aforesaid<br \/>\namount of Rs. 10,000\/ within the stipulated time, benefit of this<br \/>\norder will not be available to them and the police of the police<br \/>\nstation concerned will be at liberty to proceed against them in<br \/>\naccordance with law.\n<\/p>\n<p>Order Date :- 28.6.2010<br \/>\nanb\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Durgesh Pratap Singh &amp; Others vs State Of U.P., Thru.
