Request   of   the   learned   counsel   for   the<\/p>\n<p>petitioner   to   that   effect   is   accepted   and   this   Crl.M.C.   is   dismissed   as<\/p>\n<p>unnecessary now.\n<\/p>\n<\/p>\n<p>                                                               (R. The   petitioner   has   entered<\/p>\n<p>appearance.           According   to   the   petitioner,   initiation   of<\/p>\n<p>proceedings   under   Section   133   Cr.P.C   is   not   legally   proper,<\/p>\n<p>correct   or   justified   in   the   light   of   a   Division   Bench   decision   of<\/p>\n<p>this Court in <a href=\"\/doc\/1305317\/\">Reliance Infocom Ltd. v. Chemancherry Grama<\/p>\n<p>Panchayat<\/a>  [2006   (4)   KLT   695].     The   short   grievance   of   the<\/p>\n<p>petitioner that his objection  that proceedings under Section 133<\/p>\n<p>Cr.P.C   is   not   maintainable   is   not   being   considered   by   the   Sub<\/p>\n<p>Divisional Magistrate.\n<\/p>\n<\/p>\n<p>        2.    Call for a report from the Sub Divisional Magistrate as<\/p>\n<p>to   why   the   objections   raised   by   the   petitioner   is   not   being<\/p>\n<p>considered.     I   make   it   clear   that   I   expect   the   Sub   Divisional<\/p>\n<p>Magistrate   to   consider   the   said   objection   and   pass   appropriate<\/p>\n<p>orders on merits expeditiously.  The report of the Sub Divisional<\/p>\n<p>Magistrate must reach this court by  30.04.2007.<\/p>\n<p>        3.
