SATHASIVAM\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<br \/>\nCIVIL APPEAL No. 593  OF 2002<\/p>\n<p>Dr. ARIJIT PASAYAT, J<\/p>\n<p>1.\tChallenge in this appeal is to the judgment of a Division<br \/>\nBench of the Gujarat High Court dismissing the writ petition<br \/>\nfiled by the appellants. Appellants are engaged in the business<br \/>\nof slaughter and selling of meat of bulls, bullocks and other<br \/>\nanimals.  In the writ petition, they challenged the validity of<br \/>\nNotification dated 11.12.1989 published in Government<br \/>\nGazette dated 13.12.1989 by the State of Gujarat. The<br \/>\nNotification was purported to have been issued in exercise of<br \/>\nits powers conferred under clause (b) of sub section (1) and<br \/>\nclause (g) of sub-section (2) of Section 4 and clause (a) of sub<br \/>\nsection (1) of Section 5 of the Gujarat Essential Commodities<br \/>\nand Cattle (Control) Act, 1958 (in short the &#8216;Act of 1958&#8217;) as<br \/>\napplicable to the State of Gujarat.\n<\/p>\n<p>2.\tThe High Court dismissed the writ petition on the ground<br \/>\nthat reasonable restriction was imposed for drastically<br \/>\nreducing the trade of slaughter of bulls and bullocks.\n<\/p>\n<p>3.\tLearned counsel for the appellants submitted that the<br \/>\nNotification was beyond the powers of the State government<br \/>\nand affected the fundamental rights of the appellants of<br \/>\ncarrying on their business of slaughter and selling of meat of<br \/>\nbulls and bullocks and other animals and also affected their<br \/>\nright to life.\n<\/p>\n<p>4.\tLearned counsel for the respondent on the other hand<br \/>\nsubmitted that the matter has been conclusively decided by<br \/>\nseveral judgments of this Court.\n<\/p>\n<p>5.\t<a href=\"\/doc\/55842\/\">In State of Gujarat v. Mirzapur Moti Kureshi Kassab<br \/>\nJamat &amp; Ors.<\/a> (2005 (8) SCC 534), it was inter-alia observed as<br \/>\nfollows:\n<\/p>\n<p>&#8220;10. This was followed by the impugned<br \/>\nlegislation, the Bombay Animal Preservation<br \/>\n(Gujarat Amendment) Act, 1994. The Bombay<br \/>\nAct of 1954 referred to as &#8220;the principal Act&#8221;<br \/>\nwas further amended by Section 2 of the<br \/>\namending Act which reads as under:<br \/>\n&#8220;2. In the Bombay Animal Preservation<br \/>\nAct, 1954 (hereinafter referred to as &#8216;the<br \/>\nprincipal Act&#8217;), in Section 5,<br \/>\n(1) in sub-section (1-A), for clauses<br \/>\n(c ) and (d), the following clauses<br \/>\nshall be substituted, namely<br \/>\n&#8216;(c) a bull;\n<\/p>\n<p>( d ) a bullock.&#8217;<br \/>\n(2) in sub-section (3)<br \/>\n( i ) in clause ( a ), sub-clauses<br \/>\n( ii ) and ( iii ) shall be deleted;\n<\/p>\n<p>(ii) in clause ( b ), after the<br \/>\nwords &#8216;calf of a cow&#8217;, the words<br \/>\n&#8216;bull or bullock&#8217; shall be<br \/>\ninserted.&#8221;\n<\/p>\n<p>\t\tXx\t\txx\n<\/p>\n<p>142. For the foregoing reasons, we<br \/>\ncannot accept the view taken by the<br \/>\nHigh Court.  All the appeals are allowed.<br \/>\nThe impugned judgment of the High<br \/>\nCourt is set aside. The Bombay Animal<br \/>\nPreservation (Gujarat Amendment) Act,<br \/>\n1994 (Gujarat Act 4 of 1994) is held to<br \/>\nbe intra vires the Constitution. All the<br \/>\nwrit petitions filed in the High Court are<br \/>\ndirected to be dismissed.&#8221;\n<\/p>\n<p>6.\tSimilarly in <a href=\"\/doc\/242440\/\">Akhil Bharat Goseva Sangh v. State of A.P. &amp;<br \/>\nOrs.<\/a> (2006(4) SCC 162) it was observed as follows:\n<\/p>\n<p> &#8220;64. Before concluding this issue, let us deal<br \/>\nwith Submission ( h ) made by Akhil Bharat<br \/>\nGoseva Sangh in CA No. 3968 of 1994. On<br \/>\nbehalf of Akhil Bharat Goseva Sangh in<br \/>\nSubmission ( h ) it was urged that the decision<br \/>\nin Mohd. Hanif Quareshi v. State of Bihar (AIR<br \/>\n1958 SC 731)would not help Al Kabeer in any<br \/>\nway as the position at present is completely<br \/>\ndifferent. In that decision, total ban on<br \/>\nslaughter of old cattle was struck down on the<br \/>\nground that there was scarcity of fodder<br \/>\nresources, which however, according to Akhil<br \/>\nBharat Goseva Sangh, does not exist any<br \/>\nlonger. <a href=\"\/doc\/55842\/\">In State of Gujarat v. Mirzapur Moti<br \/>\nKureshi Kassab Jamat<\/a> (2005(8) SCC 534) it has<br \/>\nalso been held that in view of the position that<br \/>\nexists now i.e. adequate availability of cattle<br \/>\nfeed resources, the question of striking down<br \/>\ntotal ban on slaughter of old cattle for scarcity<br \/>\nof fodder resources would not arise at all. In<br \/>\nour view, this position cannot be disputed.<br \/>\nHowever, in the present case, we are<br \/>\nconcerned with the A.P. Act, 1977 which does<br \/>\nnot impose a total ban on slaughter of a<br \/>\nparticular type of bovine animal, whereas in<br \/>\nMirzapur case (supra) this Court dealt with the<br \/>\nprovisions of the Bombay Animal Preservation<br \/>\n(Gujarat Amendment) Act, 1994 which<br \/>\nimposes a total ban on slaughter of cow and its<br \/>\nprogeny. So far as the A.P. Act, 1977 is<br \/>\nconcerned, there is no total ban on slaughter<br \/>\nof buffaloes. Therefore, in our view, this<br \/>\nsubmission of the Akhil Bharat Goseva Sangh<br \/>\ncannot at all be accepted, as we are not<br \/>\nconcerned with the case of striking down a<br \/>\nparticular provision which imposes an<br \/>\nabsolute prohibition of slaughter of particular<br \/>\ntypes of bovine animals. In Mirzapur case<br \/>\n(supra), it was, however, not held that<br \/>\npermitting slaughter of bovine cattle by itself is<br \/>\nunconstitutional. This being the position, we<br \/>\nare not in agreement with the learned counsel<br \/>\nfor the appellant that Submission (h) can come<br \/>\nto their assistance for the purpose of banning<br \/>\nof slaughter of buffaloes by Al Kabeer.&#8221;\n<\/p>\n<p>7.\tAbove being the position, this appeal is without merit,<br \/>\ndeserves dismissal which we direct.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Abdulsattar Yusufbhai Qureshi &amp; &#8230; vs State Of Gujarat on 26 February, 2008 Author: .
