Heard       learned         counsels          for     the<\/p>\n<p>                   petitioner and the State.\n<\/p>\n<p>                             The    petitioner        is    apprehending his<\/p>\n<p>                   arrest in a case registered under Sections<\/p>\n<p>                   395 and 397 of the Indian Penal Code. Later<\/p>\n<p>                   on Section 396 of the I.P.C. was also added.<\/p>\n<p>                             It    is    alleged      that      during        dacoity<\/p>\n<p>                   one Rajendra Paswan was apprehended by the<\/p>\n<p>                   villagers who disclosed the name of eight<\/p>\n<p>                   persons in which the petitioner&#8217;s name did<\/p>\n<p>                   not   figure.     Subsequently,             one    of    the    co-<\/p>\n<p>                   accused Amarnath Kumar @ Guddu Kumar Paswan<\/p>\n<p>                   named    the    petitioner         to    the       effect      that<\/p>\n<p>                   pistol was brought by Amarnath Kumar from<\/p>\n<p>                   the   petitioner&#8217;s        house       and    the     petitioner<\/p>\n<p>                   participated         in    other        dacoity         alongwith<\/p>\n<p>                   Amarnath Kumar.\n<\/p>\n<p>                             The statement has been made in the<\/p>\n<p>                   supplementary affidavit filed on behalf of<\/p>\n<p>                   the     petitioner        to    the     effect          that    the<\/p>\n<p>                   petitioner has never been made accused under<\/p>\n<p>                   Section    395       of   the     I.P.C.          except       three<\/p>\n<p>                   excise cases in which the petitioner is on<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>        bail. It is submitted by the learned counsel<\/p>\n<p>        for the petitioner that no recovery has been<\/p>\n<p>        made from possession of petitioner.<\/p>\n<p>                  Considering          the        fact        that     only<\/p>\n<p>        confession       of      subsequently             apprehended<\/p>\n<p>        accused is against the petitioner, let the<\/p>\n<p>        petitioner, above named, be released on bail<\/p>\n<p>        in the event of arrest or surrender before<\/p>\n<p>        the learned court below within a period of<\/p>\n<p>        twelve weeks from today in connection with<\/p>\n<p>        Daudnagar    P.S.       Case     No.       53    of     2011    on<\/p>\n<p>        furnishing       bail     bond       of     Rs.10,000\/-(Ten<\/p>\n<p>        Thousand)    with       two    sureties          of    the     like<\/p>\n<p>        amount    each    to     the     satisfaction            of     the<\/p>\n<p>        learned   C.J.M.
