    Revision  petitioner  is  the  accused  and<\/p>\n
second   respondent    the    complainant    in<\/p>\n
S.T.447\/2006 on the file of Judicial First<\/p>\n
Class Magistrate Court II, Sulthan Bathery.<\/p>\n
Revision petitioner was convicted and sentenced<\/p>\n
to simple imprisonment for six months and a<\/p>\n
compensation  of  Rs.75,000\/-  and  in  default<\/p>\n
simple imprisonment for two months. Revision<\/p>\n
petitioner is challenging the conviction and<\/p>\n
sentence  before  Additional   Sessions  Court,<\/p>\n
Kalpetta in Crl.A.124\/2007.  Learned Additional<\/p>\n
Sessions Judge on reappreciation of evidence<\/p>\n
confirmed  the  conviction   and  sentence  and<\/p>\n
dismissed the appeal. It is challenged in the<\/p>\n
revision.\n<\/p>\n
    2.    Learned  counsel  appearing  for  the<\/p>\n
revision petitioner was heard.\n<\/p>\n

     3.     Learned counsel submitted that in view of<\/p>\n
the evidence on record and the concurrent findings<\/p>\n
of fact revision petitioner is not challenging the<\/p>\n
conviction     but  sentence   may  be  modified  and<\/p>\n
revision petitioner may be granted six months time<\/p>\n
to pay the compensation.\n<\/p>\n
     4.      On going through the judgments of the<\/p>\n
courts below, I find no reason to interfere with<\/p>\n
the conviction.\n<\/p>\n
     5. Evidence establish that revision petitioner<\/p>\n
borrowed     Rs.70,000\/-  and  towards  its repayment<\/p>\n
issued Ext.P1 cheque       which was dishonoured for<\/p>\n
want    of    sufficient  funds  when  presented  for<\/p>\n
encashment.      It was also established that second<\/p>\n
respondent had complied with all the statutory<\/p>\n
formalities provided under section 138 and 142 of<\/p>\n
Negotiable Instruments Act.     In such circumstance,<\/p>\n
conviction     of  the  revision  petitioner for  the<\/p>\n
offence under section 138 of Negotiable Instruments<\/p>\n
Act is perfectly legal.\n<\/p>\n

     6.     Then the only question is regarding the<\/p>\n
sentence.     So long as the sentence is not altered<\/p>\n
or    varied    against   the  interest   of   second<\/p>\n
respondent, it is not necessary to issue notice to<\/p>\n
second respondent.    As per the sentence awarded by<\/p>\n
the Magistrate as confirmed by learned Sessions<\/p>\n
Judge second respondent is to get a compensation of<\/p>\n
Rs.75,000\/-.    Ext.P1 cheque is for Rs.70,000\/-.  In<\/p>\n
such circumstance, considering the entire facts and<\/p>\n
circumstance of the case, interest of justice will<\/p>\n
be met if the sentence is modified to imprisonment<\/p>\n
till rising of court and fine with a direction to<\/p>\n
pay compenstion out of the fine so realised.<\/p>\n
     Revision is allowed in part.   Conviction of the<\/p>\n
revision petitioner for the offence under section<\/p>\n
138 of Negotiable Instruments Act is confirmed.<\/p>\n
Sentence     is modified.    Revision  petitioner  is<\/p>\n
sentenced to imprisonment till rising of court and<\/p>\n
a  fine     of  Rs.76,000\/-  and in  default   simple<\/p>\n
imprisonment for two months.      On realisation of<\/p>\n
CRRP 4114\/2008            4<\/span><\/p>\n
fine, Rs.75,000\/- to be paid to second respondent<\/p>\n
as compensation under section 357(1)(b) of the Code<\/p>\n
of Criminal Procedure.     Revision petitioner is<\/p>\n
granted six months time to pay the fine.   Revision<\/p>\n
petitioner     is directed to  appear  before   the<\/p>\n
Judicial First Class Magistrate, Sulthan Bathery on<\/p>\n
