NO. 3250    OF 2008\n            ===========================\n\n      Dated this the 28th day of October,2008\n\n                       ORDER\n<\/pre>\n<p>    Petitioner  is  the  de  facto  complainant  in<\/p>\n<p>C.C.864\/2003 on the file of Judicial Magistrate of<\/p>\n<p>I Class, Kodungallur.  Respondents 1 to 4 are the<\/p>\n<p>accused out of which second respondent is no more.<\/p>\n<p>First respondent is the husband of the petitioner.<\/p>\n<p>Petitioner lodged Ext.P7 complaint numbered as CMP<\/p>\n<p>8459\/2002 before Judicial First Class Magistrate.<\/p>\n<p>Learned Magistrate forwarded the complaint under<\/p>\n<p>section 156(3) of Code of Criminal Procedure for<\/p>\n<p>investigation based  on   which  Ext.P3  F.I.R  was<\/p>\n<p>registered.  Police after investigation laid the<\/p>\n<p>charge for the offences under sections 498A, 406,<\/p>\n<p>and 420 read with section 34 of IPC.        Accused<\/p>\n<p>appeared before the learned Magistrate and pleaded<\/p>\n<p>not guilty.  On the side of the prosecution, seven<\/p>\n<p>witnesses were examined and seven exhibits were<\/p>\n<p>marked.  Learned Magistrate on the evidence found<\/p>\n<p><span class=\"hidden_text\">CRRP3250\/2008               2<\/span><\/p>\n<p>the accused not guilty.     They were acquitted under<\/p>\n<p>section 248(1) of Code of Criminal Procedure.      The<\/p>\n<p>order of acquittal is challenged in this revision<\/p>\n<p>filed under section 397 read with section 401 of<\/p>\n<p>Code of Criminal Procedure.\n<\/p>\n<p>    2.      Learned counsel appearing for petitioner<\/p>\n<p>was heard.\n<\/p>\n<p>    3.       Learned counsel vehemently argued that<\/p>\n<p>learned Magistrate did not properly appreciate the<\/p>\n<p>evidence     and     appreciation  of   evidence  was<\/p>\n<p>perverse.     It was argued that the fact that first<\/p>\n<p>respondent husband admitted in Ext.P5 power of<\/p>\n<p>attorney that       gold ornaments of the revision<\/p>\n<p>petitioner,     his wife, were sold and the funds were<\/p>\n<p>utilised by the husband was not properly taken into<\/p>\n<p>consideration.      Learned counsel also argued that<\/p>\n<p>eventhough petitioner has no case that the 20 cents<\/p>\n<p>of property which was assigned by the father of the<\/p>\n<p>petitioner to first respondent was the subject<\/p>\n<p>matter    of   the  power  of  attorney  executed and<\/p>\n<p>learned Magistrate wrongly took it that way and     it<\/p>\n<p><span class=\"hidden_text\">CRRP3250\/2008              3<\/span><\/p>\n<p>establishes that      appreciation of evidence was<\/p>\n<p>perverse.     It was further   argued that   learned<\/p>\n<p>Magistrate    on  the  evidence  found  the   accused<\/p>\n<p>guilty     and  the  order   of  acquittal   is  not<\/p>\n<p>sustainable.    Learned counsel also made available<\/p>\n<p>copy of Ext.P7 complaint as well as Ext.P5 power of<\/p>\n<p>attorney     and the depositions of the witnesses<\/p>\n<p>examined.\n<\/p>\n<p>    4.    On hearing the learned counsel and on going<\/p>\n<p>through the judgments and the depositions made<\/p>\n<p>available, I do not find any reason to interfere<\/p>\n<p>with the order of acquittal passed by the learned<\/p>\n<p>Magistrate.    So long as   appreciation of evidence<\/p>\n<p>was not perverse it is not for this court to<\/p>\n<p>reappreciate    the  evidence   and  substitute  the<\/p>\n<p>findings of the learned Magistrate especially when<\/p>\n<p>no material evidence was overlooked by the learned<\/p>\n<p>Magistrate.    On going through the judgment and the<\/p>\n<p>evidence, it cannot be said that the view taken by<\/p>\n<p>the learned Magistrate on appreciation of evidence<\/p>\n<p>is not a possible or reasonable view that could be<\/p>\n<p><span class=\"hidden_text\">CRRP3250\/2008            4<\/span><\/p>\n<p>taken on the evidence.
