JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/03\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;A)\t<\/p>\n<p>Your<br \/>\nLordships may be please to admit and allow this application.\n<\/p>\n<p>B)<\/p>\n<p>Your<br \/>\nLordships may be please to quash and set a side the impugned order<br \/>\ndated June 09, 2010 (09.06.2010), September 20, 2008(20.09,2008),<br \/>\nNovember 21, 2008(21.11.2008), December 04, 2008(04.12.2008)as<br \/>\n Annexure-A colly.\n<\/p>\n<p>holding that the said order are illegal unjust, contrary to<br \/>\nprinciples of natural justice, null and void, with further directions<br \/>\nto the Respondents to stop recovery on basis of the above said orders<br \/>\nand refund the amount to Petitioner which is recovered from his<br \/>\nsalary on the basis of the said orders.\n<\/p>\n<p>C)<\/p>\n<p>Your<br \/>\nLordships be pleased to direct Respondent No.3 to release and Pay<br \/>\nHouse Rent Allowance to the Petitioner as per rules from March 14,<br \/>\n2009(14.03.2009) and may continue to pay him in accordance with<br \/>\nrules.\n<\/p>\n<p>D)<\/p>\n<p>Pending<br \/>\nadmission hearing and till final disposal of Petition, effect and its<br \/>\nfurther implementations of the communications dated June 09,<br \/>\n2010(09.06.2010), September 20, 2008 (20.09,2008), November 21,<br \/>\n2008(21.11.2008), December 04, 2008(04.12.2008) issued by Respondent<br \/>\nno 2 and 3 at  Annexure-A colly <\/p>\n<p>may<br \/>\nplease be stayed and Respondents may please be directed not to<br \/>\nrecover further amount from the salary of Petitioner on the basis of<br \/>\nthe above said orders.\n<\/p>\n<p>E)<\/p>\n<p>To<br \/>\npass any other and further orders as may be deemed fit and proper.&#8221;\n<\/p>\n<p>2.\tAt<br \/>\nthe very outset, Mr. B.B.
